Qg • - UNITED Sraras CC/MT.—Judge Irwin on the Bench. • This Court was in session yesterday, to hear arguments on an application for a re-hearing on the motion to commit Kilpatrick, Kirkpatrick, j -Sherwin and Jacks, of Eric, for contempt of Court. ' Messrs. Hepburn, Black and Babbett appeared 1 for the !prisoners; A. -W. Loomis and Stanton resisted the application. A petition from Ira Sherwin was read. The I petition set forth that the petitioner is impris oned in the jail of Allegheny county for an al leged contempt of Court, in disobeying a certain preliminary injunction' , of the said Court, enjoin ing him front doing any injury to the track of the Erie and Nortli.:East Railroad Company; that notice of the rule for his commitment was served on him. on the of January, to appear and answer on the 6th; that the distance between Erie arid Pittsburgh being so great, it was im possible for him to procure his testimony and come prepared for a hearing on such short notice, particularly as the depositions against him were all taken' ez parte, without any notice; and he had no knowledge of the particular acts alleged as breattlitiv of the injunction, and at the time the notice was served on him to appear, nearly all the attorneys in Erie county being absent, ho had not the means of obtaining good legal advice. as to the proceeding against him. or what was necessary to be done in respect to it. Hence Ids case was forced to a hearing without a fair opportunity, for hint to procure testimony iu his defence, anti otherwise prepare himself or his counsel for the Controversy. 'The petition also set forth that the petitioner did not, at any time knowingly disobey the injunction; that he had not threatened to disobey the same, and bath not any design whatever to disobey the same in future, but will hereafter keep and observe the said injunction. The petition concluded by preying the Court to hear testimony in behalf of the petitioner, and make inch order inilee case, es equity and justice may dictate. Judge IlipburnaccoMpanied the petition: With a motion that the - former order of Court be coca _ ted and the prisoners be brought into Court and then have a final hearing. ' Mr. Staunton in'reply objected in the first place, that final action hod been . takeu ; that the prisoners had filed their affidavits, at the trial of the motion on which they were committal, and consequently had had a hearing; the opinion of the Court was founded on the testimony and affida vits, and the warrants for the arrest and commit tal, were issued in pursuance of that opinion; nothing more was to be done. The prisoners had no 'right to come in Court, until the offence for Which they were commithsl, should be expiated; they might, hoWever petitiontbut in that petition they had no right to controvert the opinion of the Court, nor declare themselves innocent as Sher win had done. The petition must be submissive _repentant, and the cause of the offence for which : they were committed must be removed. In this case, nothing could be done until the Marshal had made a return that the road had been repair ed; than the effects of their illegal sets being re paired, and upon expressing their submission, they couldreceive the pardon of the. Court. Mr. Stanton proceeded at great length to sub stantiate his positions. lion. A. W. Loomis followed in an eloquent speech::: Col. Black, for the prisoners, asked the Court as a matter of conscience, to grant a re•bearing, as it.was moratly impossible for the persons on the Counsel to be present at the first hearing.-- As fur the affidavits referred to, they were not everiread bithe Counsel. The speaker went on give the reasons for his absence on that day, and complained of a want of courtesy shown him by a non-continuance of the cause. Now he was however able to prove most 'con clusively the entire innocence of the fire persons, and be appealed to the conscience of the Court, whether they should be punished for that of which they were innocent. In the case of the Commonwealth vs. Neal Boyle, indicted for assault and battery on oath of Mary Karns, the jury returned a verdict of guilty. Neal was sentenced to pay is fine of $5 and costs of prosecution. Com. vs. Peter Hart: indictment, assault and battery with intent to - rnvish. The prosecutrix in this case was Mrs.3fCarty, and it was upon her daughter; a mere child, that the tosanit was committed. A verdict of guilty woo returned; the prisoner was remanded.
