oath of Joseph Justice, of the Mayor's Police.
The Indionnent contained four counts, founded
upon an article that - appeared in toe Chronicle
of the Bth of August, headed ..Tragedy and
Farce," in which a. polio° officer, rho was not
named, however, wee alluded to in severe terms,
for appearing as an informer before a hfegie•
trate, in a number of liquor eases, and in an
other article that appeared in the some paper on
the 16th of Angnet.
The prosecutor was sworn and testified that
he was a witness in a nunibeiof "selling liquor
ou &malty" eases before Aldernian Steele,on the
6th of August; on thelith the article appeared;
the witness bought a paper and presented it to
the Grind Jury; It was afterwards stolen from •
drawer in the Mayor's office; ho obtained anoth
er paper, which was also stolen.
[At this, point the prosecutor offered in eri
deuce a certified copy of the libelous article, is
lieu of the paper, which they were linable to ob
taispossesnion of.
Objected to by defence, on the ground that if
the papers werestolen it was their misfortune,
and wan not owing to the defence. The Millet
meat mild that the paper contained a libelous ar
ticle, and the paper must be presented to prove
ttto assertion;
The Court admitted the testimony with great
doubt; hat the defence oould take advantage of
the point, ie oath of a motion for anew trial
Alderman Steele testified to having made a
verbatim copy.
The defence produced some witnesses to
prove the seeertions made by tho Chronicle, as
Justice woe a public officer. Witnesses wore al
so produced, who etated that they did. not think
the article referred to Justice at all.
Darragh and Mellon appeared for the proaeon
floe; Meagre. Stokes and M'Caadlees for the de
feces.
Eloquent epeeohee were.made by the oouneel
on both &dee. The cue went to the jury, end
the Court adjourned before • verdict wee ren
dered.

was besot on /donday, at Berr's Island, by a
