for the recovery of valuable property, or the

be worth Come one million of dollars. An the
imbjeot has created great interest in the public
mind, we copy the following etatemeat of the
case,- which we bad in the Diapatek of Mon
day

burgh and others. The extensive claim made by
the heirs .of Thomas Cromwell, aompriving one
hundred and sixty acres ;of load In the borough
of Manchester, tea scree in Allegheny city, and
two large and valuable lets in thte city, Las at
tracted so much attention, that we have coo•

the cue, and the grenade open which the plain

William J. Slicer, and his children, Lawrence,
William C. and Ida ' VeitUa, of. Muytand—tdirtha
V. Berkley, of Virginia—and Dr. Jeremiah
Berry and Themes C. Berry, of Missouri, (here
of Thomas Cromwell,) the plaintiffs in the case,
have filed a bill in equity in the Circult,Coort of
the United States for this district, against the
Bonk of Pittsburgh, Mount Union Cemetery,
Thomas Biddle, Joseph If. Dellis, John Samp
les, Janie' Anderson, Cyrus Towasentl,Stmeiee
B. Phelps, John Martin, Mrs. Mary Burgess,
Jacob One, Boa., end Jacob Goss, Jr., in which
they mate the following allegations:
That Cromwell owned certain lands in this
county; and thatlo secure a debt which he owed
of $20.100, which he owed the Bank of Pitt,-
burg, ezeouted.a mortgage of the saute on May
18th, 1819. On June sth, 1820, the Banklasued
a +mire faciarthereon, which was returned 'rimm
ed" bye memorandum of such service, not on the
writ, but on the, envelope thereof—which they
contend was notiegaL Without any judgment on
said seas facial, the Bank got a toad facial',
and aold the property, purchasing it them
selves, for $18,160-being $6,805 for 170 acres
to t h e u nt o Te k e_t, and $6,855 for the two
stay lots. •
This property the Bank afterwards sold to
individuals,- (without warranting the title,) as

and confessed Judgment" for $21,740 40 and

of =motion," &c. The rule was granted, made
absolute on Dee, 14th, 1888, and judgment en
tered as of Sept: 181 h, 1820.

good—or, If imperfect, any each Imperfection
has been cored by lapse of time, they having
.hers in possession more than twenty-mt years.

ease, bat we do not perceive any equity-In the
claim, is !teems clear that Czonwitu owed the
Bank, and was 'Ming - they should do what they
pleased with the property to get Mukelf free
from the debt. In any event, there would be no
jostles in ejecting itatocent purchasers should the
claim be sustained' and we presume the claim
ants will prefer punning the Bank.

to law, as it will be tried . Wore the U. 8. Cir
cuit Conn, and will doubtless wn ycame before
the highest , tribunal in the Union—the U. 8. On
prime Curt, as the immense amount in contro
versy will Insure a writ of error on . the part of
whichever party loses in the Court below.
