LXPONTANT WLWAY DECISION.
The decision noticed below, is reference to
the destruction of utile, sheep, !co.. on rail
roads, is one of much importance to farmers and
residents along the lines of railroads, as well as
to the companies themselves. Although the de•
cision was made in Canada, it : has the vireo
bearing on the subject as if made in Pennsylva
nia, soil is based on common law, which, in the
absence of any direct statute, is the only law
on which a decision could be founded in this
State. A. similar decision was mode in Connee•
dont, sad it will no doubt be universally estab
lisbedby the decieiotts of courts in a short time,
By this decision any . animals found on railways
are considered as trespaseing, and the owners
.are liable for any damages which might accrue
oti account of such trespass. People bare been
so long accustomed in this country to let their
animals stray at. barge in the public highways,
that they have come to consider it a right, and
not • trespass. A - little information and nflec
timi will convince :them that they are wrong,
mid they will take means to keep their stock
within enclosures. - ; goat persons who lose an

just claim upon the company for damages, net

The Doily Union makes the following vera
cious stetementi
"Whig papers say that Gen. Scott never lost a
battle, yet he was taken prisoner, with his
whole force at Chippewa." -
There is not an American school boy but
knows that the above is a wholesele falsehood.
On the plains of Chippeis Oen. SOorr with his
own brigade, whipped the British in a regular
pitched battle, on'a fair field, GUI. Ripley only
coming up as the British soldiers were showing
their books. Gen. Scott remained master of the
field. The British acknowledge the defeat of
their veteran soldiers, after about one third of
them had fallen in battle, with pain and mortifi
cation, and the desperate gelid they eubeequent
ly made at Lundy's Laue,:showed a determina
tion to wipe off the disgrace of their defeat at
Chippewa.
The same paper makes the following state
"Whig papers Bay that Gen. Scott never faint
ed battle: yet he did faint at Lundy'', Lane,
and was borne from the field."
Gen. Scott -was under fire in the thickest of
the fight, at Luady's Lane for many hours, un
til Ms brigade had dwindled down to a mere
handful. Near theclose of that sanguinary bat
tle, after the British had been repeatedly driven
from the hill at the point of the bayonet, Gen.
Scott was very badly wounded in the ehoulder,
entirely disabling him for the time from active
service. C. J. Ingersoll's account of this event
iv in the following words: .
"When information came that the British were
I advancing to retake the guns, Score led his &a
-1 talion brigade in an impetuous charge, which pat the

This looks like the Oct of a fainting man does
it not! Gen. Bolt bad been In the field six or
eight hours, most of the time in battle; he, as
well as his men, was worn out with fatigue and
excitement, nod dribg with thirst; his shoulder
ix horribly lacerated and fractured by a ball;
does be then faint? No, as he is borne bleeding
from the field, hie farewell order Is; ...Leaven
worth charge again.' Gen. Scott was not then
thirty years of age, and was brevetted a Major
General for his gallantry.
Our opponents would gladly bolster up their
Pointing General, by eo brilliant an example as
stoat of Gen. Scott, but history defies their ef
forts. If Gen. Scott had fainted after he was
borne from the field, from pain and exhaustion,
that would be no excuse for Gen. Pierce, who
fainted on going info battle, and before he was in
reach of the enemy's random shots! No wonder
the martial spirit of the American people revolts
at supporting each a fainting hero. All the
power of party drill can scarcely hold the rank
ad fileto such a candidate.
RATIONAL 13111 . 0 N CONTENTION.
For several days Gael: there have been rumors
Lt , a National Union Convention, which was held
'n Philadelphia, and nominated Mr. Webster.
As national conventions are public matters, the
rumor was treated ne apocryphal ; hut it now
comes out that this convention, called by nobody
tubbely, and composed of self-appointed dele
gates, did really hold its sessions in Philadel-
Ole, and go through the forms of nominating
Presidential candidate=. The proceedings are
given as follows, in the Philadelphia papers of
Tuesday:

yesterday afternoon, when the proceedings of
Saturday were made public. The following are

Yesterday afternoon, after providing for a ar
mai tender of nominations, the convention ad

The Philadelphia American accompanies its
report of these proceedings with the following
remarks
Our city reporters have (mnished us with the
tyllowlng report of the proceedings of the most I
mysterious body which has assembled herea
bouts for a long . time. Meeting without any
previous notice,'composed of nobody knows
whom, and sittig with closed doors, until after
their bneinetasuch as it was, was transacted,they
came like shadows and have so departed, leaving
tot trace of their Preemie° but the meagre com
mencement of their doings hereunto appended
Who is the Hon. J. W. Kennedy, of Pennsyl
vania, who has been ponored with the Vice Pre•
tidential nominniiod l We do not remember to
Ante heard of this gentleman, but since his dig
nities have fallen him, we may say with honest

ance with you." . Without any disparagement to
the Hon. Mr. Kennedy—whoever he may be—it
may, however, be pertinent to inquire why these
toperlative Unionists obese both their candidates
from the North, Surely, Mr. Webster might
have been considered as grits sufficient for one
tection: and besides, it was scarcely handsome
to forestall the Sail= of the Georgia Convention,
which has sufficiently indicated its purpose of
nominating Mr. Jenkins. What will Mrs. Grun
dy Bey to these extraordinary demonstrationst
The Ledger comments in the eame vein. It
says:
' , Hearing something, yesterday, of snob a
eouvention being about to commence its arduous
labors, we instituted a search for three mortal
hours, to find tt, hat all each efforts were vale,
politicians werti . (or once modest, and would not
ehow themselves to the public. In the meninx
somebody sent us a printed slip of what pur
ported to be the proceedings of the convention,
which informed ne that the body.had nominated
Daniel Webster for President, and J. W. Kenne
dy, of Pennsylvania, for Vice President. Who
Kennedy Is' we do not know; where the con
es:Alan was held we do not know; and we believe
no one else is apprized of the fact.

formed the convention met In the back room Ma
hotel in Walnut street, nose Fourth.

person of that name we know of in Pennsylvania.

Lama—The Philadelphia Bulletin, of Wed
nesday afternoon, makes the following announce
ment: •
Mr. J. Wayne Kennedy hav written a letter,
declining the nomination for the Vice Presidency
tendered to hl© by the mysterious little conven
tion that mot here on Saturday, and diearowing
all knowledg.J - of, or connection with, its proceed

In Sandusky, Ohio, this fatal malady still pre
Tails. The Stow. of Monday states that eight
or ten cases of sickness resulted fetidly on Se
tordsy and Sunday. The sudden - change of
weather from hot tounseasonably cold produced
a marked aoe unhappy effect upon those who
had been laboring under desesse of • the bowels.
In those cases, when attendance was prompt
and medical prescriptions followed faithfully,
the denture yielded readily to treatment. The
weather on Monday was favorable, and the Reg
ister says...the change froni yesterday is striking
in its effects:upon both sick and well persona
The former, ao far se we have heard, with one
exception, are doing well, while the latter feel a
oorrespondinivigor of body and mind unknown
I for many days before. The deaths were among
foreigners of the imprudent or improvident class.
At Tolesii, the cholera has been very fatal to
the forego population, but has been mostly con
fined to than.
• Last week there were frequent cases of chol
era in Beak, and on Thursday four in one
family had , died of it, as had twain another
fimily residing near them. Still the disease

otmlind, fail. Daring that time, 'Wrens
cases, twenty-eight of them fatal, were reported
to the Board of Health. The Democrat Dave:—
"The mortality in a single block, in the north
part of the city, 'ram greater . than on any pre
vious day. Eighteeepereona died in the build
ing from Saturday to Monday morning, but an
examination of the premium explained the cause.
The basement was damp and closely shut op.
The wonder is that people could have lived there
so long.
Among those who died ore nomad Moses B.
Seward, proprietor of the Shawmut Mill; and
John O'Donoughoe for thirty years a citizen of
Rochester.
TSB HENRY CLAY TRAGEDY
The following is the verdict of the Coroner's
Jury, after a moat fair investigation of the facts
connected with the burning of the Henry Clay:
reamer.—The Jury find that on the 28th
day of July, 1852, the persona described as
having been found dead at Yonkers, were pas
sengers on board the Henry Clay, that she took
fire and was consumed, and that J. K. Simons,
one of the persons was burned to death, and that
all the other persons, either by reason of the
shock occasioned by the collision of the boat on
the land, were thrown overboard or that in or
der to save themselves from being burned, cast
themselves overboard and were drowned in the
Hudson River. That on the above named day
the Henry Clay left Albany, with passengers,
about 7 o'clock in the morning; that Captain
John P. Tallman was Captain, and part owner;
that Thomas Caliper wan also one of the owners,
James L. Jessup was clerk, Edward Hubbard
was pilot, James Hubbard !assistant pilot, John
Germain was engineer, Charles Merritt assistant
engineer ; that a certain young man whose name
is unknown to the Jury, but who was employed
to tend the bar of the eteambent, and that these
persons were on board at the time, and had each
of them part of the charge of the said boat ; and
that for the purpose of excelling in speed a cer
tain other steamboat called the Armenia, or for
the purpose of increasing the speed of the Henry
Clay, created no unusual and unsafe quantity of
steam, and in FO doing made excessive fires, and
did not use ordinary prudence in the manage
ment of raid fires: and, although being often re
monstrated with by different passengers, did for
a long time continue these excessive fires, and in
' consequence thereof, through their culpable neg- 1
ligenoe and criminal Teckleasneali, the Henry
Clay did, at fifteen minutes after 1 o'clock, P. 51.
take fire, and all the deaths of the. passengers
afore described enaned : so the Jurors say, that
the deaths of all the sahl persons, and of each
of them, were the result of an act perpetrated by
the said Jhbn V. Tallman, Thos. Collyer, James
E. Jeseop, James Meander!, Edward Hubbard,
John Germain, and said barkeeper. The act was
imminently dangerous to others, and evinced a
depraved mind, regardless of human life, al
though it was perpetrated without any premedi
tated design to effect the death of any particu
lar individual. . .
The wreck of the iienry Clay wov raised on
Tuesday, by the derrick, but no more bodies
were recovered. A quantity of gold, silver and
copper coin was discovered under the Captain's
office, melted together in one confused mss!.

Sir: I have been directed by her Majesty',
Government to bring to the knowledge of the
Government of the United States a measure
which has been adopted by her Majesty's Gov
ernment to prevent n repetition of the complaints
which have no frequently been made of the en
croachments of vessels belonging to citizens of
the United States and of France upon -the fish
ing groonds reserved to Great Britain by the
convention of 1818.
