said, have been seized, and, without stopping to
inquire whether rightfully or wrongfully, self
valiant patriots seem to assume the latter, and
make a display of their patriotism' by urging

We continued to enjoy the right oTfishing tins
! secured until 1812, when the wait put an end to
it; and it was not renewed by the\ treaty of
Faze. After the war of 1812 wee:tempted to
exercise the right granted treaty \f 1783.
and insisted that it was one of thoeo,rights not
abrogated by the war. Jong Q. ADAMS, our
Minister at the British Court at that time, made
a most able and ingenious argument in (avec i f
our claim, and was as ably answered •14 Lord
Bernen.sr, Secretary for the Colonies, in a teak

importance. Great Britain Bet up pretensions
that could.not be sustained by the law of nations:\
and we insisted on rights under the treaty of
1783 that by the same law were clearly abroga
' ted ; and the controversy finally resulted in the
treaty of 1818, by the first artiolo of which it-is
provided : '
Whereas differences have arisen respecting
the liberty claimed by the United States for the'
inhabitants thereof, to take, dry, and cure fish
on Certain coasts, bays, harbors, and creeks of
his Biitannie majesty's dominions in America, it
is agreed between the high contracting parties
that the inhabitants of tho said United States
shall have, forever, its oommonwith the subjects
of hie Britannic. Majesty, the liberty th.talce fide
of every kind en that part of the southere coast
of Newfoundland which extends from Cape Ray
to the Ramcan islands, on the western and north
ern coast of Newfoundland, from the said Cate
Boy to the Quirp t en Islands, on the shores of the
Magdalen Islands, and also on the coasts bays ,
harbors, and creeks, :from Mount Joly, on she
southern coast of Labrador, to and through the Straits of Belle Isle, and thence northwardly in.
definitely along the coast, without prejudice,
however, to any of the exclusive rights of the
Hudson Bay Campany; and-that tho American
fishermen shall also have liberty, forever, to dry
and core fish in any of the unsettled hays, har
bore, and creeks of the senthein part of the
otmstef Newfoundland hereabore deacribed, ant
of the coast of Labrador; bat so coon as the
same or any portion thereof shall be settled, it
shall not balawfol for the said fishermen to dry
or cure fish at such portion so settled, without
previous agrCement for each purpose with the
inhabitanti, •preprietors, or possessors. of the
- ground. And the \ United States hereby eenounce
forever any liberty heretoforeenjoyed or claim
ed by the inhabitants thereof, to take, dry ; or
cure fish on or within three marine miles of any
of the coasts, bays,:nreeks, or harbore of his
. Britannio Majesty's dominions in America, hot
included within the abovementioned limits
Provided, however,. that the. American fiebermen
shall be admitted to enter such bays or barbers
for the purpose of sheltie end of repairing dam—
ages therein, of purchasing 'wood, and obtaining
water, and for no other carper° whatever. Set
they shall be under such restrictions is may be
necessary to-,prevent their taking,. citylog, or
caring fish therein. or in any other manner
whatever abusing the privileges hereby reserved

It is under this article —whieti'llives us all
the rightwe have, and. which was intended to
define clearly the privilege& granted-,that the
present controversy arises. • It will be eeen by
comparison that this article is not the Same as
that iu the treaty cf 1783. This grants to us
certain privileges about which there is noenri•
ens difference of opinion.. And then, on Our
.part, We„"renottnee forever any -liberty thereto
fore enjoyed or claimed by the inhabitants of
the 'United Sfates, to take, dry, or cure fishon
or Within three marinemiles of any of the coasts,
bays, creeks, or harbors of the British elinninions
in America," Sta., with a proviso, that we may
enter such bays or harbors for shelter or repairs,
Zzo. Now, the British Government hes for many
years claimed and inetited, cert ainly " with great
plausibility, if not wilt entire correctnces, that,
by the true construction of this article, we re
nounced all right totish within threo miles of
,any bay or harbor, 11.11 well as within that die

that this is most manifest from the proviso,
which permits us to inter those hays sod her

precluding the inference that we could catty

Our. Government has by argument resisted
this construction of the treaty by Great Britain,
and the controversy has been going en for many
years; Our, fishing vessels have fronutime to
time been seised for fishing within the piobibit
