Ninth Ward, his clothes, watob and money har
ing been taken from him.
A short time afterwards Quinn wu emoted
wearing, as Rhine testified, the identical pair of
pantaloons taken from him. He likewise identi
fied Quinn's person and was strongly of the
opinion, judging from their voices and figures,
that Rummy and Dolan were the other two men
who had joined Quinn in the attack. Evidence
elated toward. the close of Wt week,-rendered
the innocence of the awned *my probable, but
yesterday it vu put beyond ill doubt.
Truels Gormly, the keeper of a ball-alley,
003 the Fourth Street Bead, testified that over
three weeks ago, he saw Quinn wearing the pan
. teams In question. He saw them on him long
before this robbery was heard of.
.B. B. IlloCuteheon swore that he was a tailor
• and worked near Greemalrargk in Weetmonland
county, on the Central itaitrolui. A different
pair of pantaloons were first exhibited to him,
. which ho said he had not made, end never saw ;
subsequently the pair alleged to have been stolen
were shown and he stated that he had made that
pair about a month ago,for Christian Gorre, a
• workmen on finotigrase eectien of the railroad.
Ha knew both Gorre and Quinn. The former'
finding the pantaloons too small for him, after
wearing them a few hours, took them to Snod
pule store and left them there for sale. Quinn
_bought them and afterwards.took them to him,
the witocu, to have a bookie sewed on. He
than wrote name upon the waistband,
.- and ideoafied his handwriting.: • Saw the panta
loons on defendant about three. weeks ago.—
They were his make, and he Could have recog
nised them without the handiriting. •

In the, matter of the estate of E.. 1. Tiernan,
deceased,
Appeal from the Register to the Register's
Court; argued in July, 1852.
By will, probated 13th of March, 1848, the
decedent bequeathed to the Right Reverend
Michael O'Connor, Roman Catholic Bishop of
the Diocese of Pittsburgh, the sum of twenty
thousand dollars in tract for the Sisters of the
order of the eisterhood of Meng, it being au
association of ladies for charitable and religious

On t Bth of April, 1848, this order was in
corporated under the style and title of •• the
',Siam of Mercy" and is of Allegheny County.
The testator empowers the trustee to pay over
to the Sisters of Marcy, the said twenty thous
and dollars or any part thereof. It appears that
the trustee has paid over to the corporators the
whole sum of twenty thousand dollars.
The question is whether this pecuniary be
quest is liable for a collateral inheritance tat.
The Act of 7th of April, 1826, entitled "an act
restive-to collateral inheritances," section 1, ie
as follows: From and after the firth day of
May next, all estates, real, persona! and mixed,
of every kind whatsoever, peening from any per
son who may die ;seised, or potheassd of such
estate being within this Commonwealth, either by
trill, or under the intestate laws thereof or soy
part of tech estate or estates, or interest there.

made or outride,' to take effect in porsmaion or en
joyment efirr.the &rah of the rancor, or bargainer,
to any person or persons, or to AoPriers politic or

The Stith section of the net of 16th of April,
1838, is Se follows:
That from and after the dret day of May
next, all churches, meeting houses, or other
place' of stated religions worship with the

grounds belonging to any religious congregation,
all cuilversitirs, colleges, academies, and school
houses, belonging to any county, borough or
school district, incorporated, erected, endowed
or established by virtue of any law of this Com
monwealth, with the grounds thereto annexed,
all court houoee and jails, be, and the same um
hereby exempted from all and every county,
road, city, borough, poor and school tax and alt
taxes heretofore assessed on any such property,
shall not hereafter be collected, but the moped.

By act oh( July 2d, 1839, the exemption from
tires, from the foregoing act of 1939, is declared

The order of the Sisters of Mercy is not em
braced in, nor does It come under, the category
of those places which are exempted by the not
of 16th of April, 1838, bet it is specially exempt
ed by the tams of its chatter.
The order was Incorporated April 8, 1848.
The second section is In these words—
Section 21. **The stientiil objects of the said
corporation shall be, the relief and support of
the sick, destitute and dependant persons, the
maintenance of orphans, and the acre and edu

Tbebequest is not the roved sum or $20,000 to
the beneflaiw, but it is the cum of $20,070 in
numbered with the lien of a collateral tither--
tante tax, which mast he paid. And the net
sum bequeathed, is used and enjoyed by the
beneficiary, exempt from all tax.
And the collateral Inheritance tax, even when
a testator derbies to o father or a widow for
life, remainder ever to collateral helm, Is due
end payable to the Register of the proper coun
ty on the dceente of testator inunediately, without
waiting until the demur of denim., or until the
right of the remainder men to poen...ton at•
taahes. See Act of Assembly.
So far as regard, the interest on the collateral
Inheritance tax
The 18th section of the Act of 10th of April,
1844, is u follows:
"On all estates of decedents las hove been
dead more than one year, and srboso came are
subject. to the payment of • collateral inheri
tance tax, if BSA ttax . has, not yet boon paid, in
terest from the death of the said decedent ahall
be charged at the rate of twelve per cent per
anonm, on said tax, unless the mite shall be paid
within nine months from the passage of this Art,

The will under which the bensficitiries claim,
was probated on the 18th of Match, 1848, and
more than nine months have elapsed Blocs the

and features alone, and the Court intimates no
opinion of the great and general qaestion whe
ther the things 'pacified in the exemption law of
1888, are exempt from a collateral inheritance
tax. That broad cumin does not arise in this

I use this caution and disolaimer, because the
learned counsel have argued this case on the
broad basic of the exemption Act of 1838, hot

TIM WWltiß.—The weather although it was
very warm yesterday, was net nearly so math
eo u last week, the thermometer standing
1 degrees below the extreme point reached
on Thursday and Friday (ninety eight in the
shade.) On Saturday we had a slight (Mower,
as likewise on Sunday, but they were not heavy
enough to lay the dust, end as we write the her
are cloudless with every prospect of a very
warm day to morrow. Rain fell on all sides of
us, down at Cincinnati, out at Salem. and Alli•
semi, and a thunder storm is now (five P. M ,
Monday,] raging on the Alleghenies by which
the working of the telegraph is very mush im
peded.
Towards the close of lest week, the bands in
many factories were oompelled to suspend oper
ations owing to the heat, and from the Fame
canoe masons could only work in the morning
and evening. Though cooler in the country the
farmers were obliged in most hastances to take
siesta for two or three hours at noon, so that
harvesting is not so far advanced as might have
been supposed from the dry weather we have
had.
Dnownso —Coroner Arthur, was called upon
yesterday to hold an inquest on the body of
Michael Bookman, a yonug lad twelve years of
age, who was drowned about one o'clock, by fall
ing between twa Oats while engaged in catching
drift wood on the Monongahela river, a short dis
tance above Jones' ferry. Ile was the son of
Jacob Bookman,a pudclor in Linens & Co's iron
works, and has resided in Lower St. Clair tp.
for the past twenty years.
The jury returned F, verdict of :accidentally
drowned, and the Coroner handed over the fees
in the case to the mother of the deceased.
FATAL Arressa - r —Jacob lied a workman in
Lippincott 'S. Weeks' shovel and axe faotory
Melville, was inetsetly killed yesterday by the
aeoidenta breaking of a largo grindstone. It
was in rapid motion at tho time, anti he was
eharpeniog sc., when it broke in half: ono half
flew op to the rieliag. in its upward piogress
etrikeng poor Iled, and fracturing hie scull and
then it fell upon him crushing his body to a jel
ly. Ile was, we learn, a sober, indentione
workman and leaves a wife and three children
to mourn his untimely lona.
BALLODN.-A fine large balloon made of tis
ane paper, and inflated with gas from the spirits
of wine, was rent up from the corner of Pitt al
ley and the North Common on Saturday evening.
A crowd composed of at least a thousand boys
and children, besides et fair sprinkling of "obit.
demi of a larger growth," witnessed it. ascent.
The air Wog very still, it went stealght up and
hovered near the tame spot for half an hour,
when it alighted on the South Common, and the
little urchins, desirous of obtaining a relic, tare
it to piecee.
Fns.—A fire broke out in a !table, On the lot
attached to the St. Poole Orphan Asylum, and
belonging to that institution, about half past
two o'clock en Sunday afternoon. The flames

consideration of the bill to amend the pottage
law. The first section containirig the proiisions
as forwarded a few days - since, wee amended,
with the proviso that newspapers and periodi
cals not weighing over two condos, when sent to
actual atibearibers within the State where they
are published, shall be entitled to the reduction
as provided fur in said seetion; the other etc

Section 24 provide. that books, booed or un
bound, not weighing over four pouads'shall be
deemed mailable, and all printed matter charge
able by weight, shall be weighed when dry. It
permits pnbliohera to exchange, free of poetege,
and to vend to subscribers, enclosed In their
publications, bills and receipts free of postage.
Weekly newspapers to be sent to subscribers
within the county where published free. Sec
tion 3,1 provides certain rules hew papers and
periodicals aro to Fe prepared for mailing. The
other provieiene of the bill aiwueimportant.
A motion was made to lay the bill on the table
which was not agreed to. Pending the amend
meat to this bill the Hoses went into Committee
on the Deficiency Bill, when the Senate amend
ments were agreed to, giving additional com
pensation to the Collin's Steamers—ayes 84,

Senate amendments to the Ilene. when,
without acting upon them the House adjonrn•
ed.
