the HarnionylSociety •J Bill in Equity. '
- The complaluistit Joshua Nacbtaieb has filed
'ihis bill in this lease against the Trustees and
Elders of the Harmony Aseociation. This ea
diety was originally founded by George. Rapp
I'6 hs assoeiates. - .
• •
The bill sets forth, that the complainant be
cmo a mecilier'of this assochdlon at Harmony,
'lndiana, in 1819, being thou of the age of (wen
! Iy-one years—that he labored faithfully end_
diligently in the affair, and business ofthe
elation, devoting hie time, skill and care thereto,:
and increasing the wealth and promoting the'
autereste of the society, receiving nothing for
'hie labor and services but a bare maintenance.
•
"That in June 1898 being then'4B years of age
and worn out with yeara and labor, he was
wrongfully and ' illsjVal4 . eriluded from said so
ciety, turned out °fits possessions, and deprived
of-all share and'participistion in- the property
and effects, its beuefits and advantages, by the
I fraud, combination and eosin of the said George
Rapp and his aasociatee.", • The bill :pray. an
account "of the sums doe CatopWitillia, for. his
labor sod cervices Iq erg association and of the
share he was .ittetly entitledito, in the property
end eptates of said association and she profits
accrued daring his 'membership, sod that. the
same may be decreed to him.
The respondents, in their answer, admit that
the coMplainatit was a .member of the associa
tion, an stated in hie bill; and that up to PAB
he had labored diligently in the aValra ogid by
siness of the aseociation, ilacTinging its wealth ,
and promotin; Foe iitAt‘ TQ Clireeably to the trrms

the owner - of Rinds mid other property to a non
eidership amount i•••
It avers that the complainant during the * re-
Mod of his member hip enjoyed all tho benefits,
advantages, and comforts; indiridoat, socielmnd
religious, which - were enjoyed by the lettere
members, and all ,that were contemplated to
forming the association and to whibh he was en
titled by the terms and spirit at their agree
ments; and woo entitled to be maintained, cher
ished, ac., by the , esociation, ale of the objects
'of the society being thatof imaging old age cam-,
fortable and 'free from coroner the tyktierlity of

sociation; and consequently, according to the
terms of their articles of assoblatioa, was not
entitled to any compensatiog for' his labor and
Services, Mbar thin the: Which he received in
his support, meiolenance, instruction ; while
be remained a member.
Themnawerthenproceedsda give q history of
the;. organization, purposes sad policy of the
Harmony Society. • I
It was Sent tamed trod•organixed by George
Rapp, and his followere, (tieing emigrants from
Germany) in 1805, in Boller county, Ps. '

In 1814-15 the. 4 vion left Butler Co ,
Pa., and tmnorM to the , State of Indiana.. On
the 2C)th of damuiry lei, an agreement was •
signed by all the membeisrbt the 'Association,
including the-complabosatfi, of Harmony in In
diana, Afterwards at Economy, in Beaver Co.,
Pa ; in March 1827, the, members, including GM,
complainant, executed another agreement, Mat
ing more fey the pnrpoies, obligatlonajdnlies,
and privileges of the membern. li.Cfetaber,

late article, the ti section - La the agreement
of 182 T is announced, whisk, permitted persona
who rotbdreto from the Association to hero re
funded to them any property broight lain it by
them. The necessity of this provision froetas
to hare been suggested by. the difficulties ripe
!kneed in the.'withdrawal of a portlon'of the
Members in 1832 with Count Leon.
' It is unnecessary for the purposeirof this case
to eeTforth'nt length these serious articles•of
agreement under which the property , of the Har

The leading pripciple; of them all, are—lst.

from the association will never claim or demand,
either {directly or indirectly, compensation,
wages or reward for services rendered; or claim
,anything from the society as =attar of right.
BnE it shall be left altogether to the discretion
of the superintendent, to decide whether any
, or what allowance shall be made to such mem
bers or hie representatives as a &lotion.'
The complainant id this case lath the associa
tion in 1846, In 1E47 George Rapp died. The
society then7ade a new article of agreement,
confirming th principles of that of 1827 (ex , '
cent the 6th section) and establishing a beard
of nine elders, defining their powers; the par
ticular provisions of which it le not necessary
farther. to state, except that these elders.and
!trustees as representatives - ofthe anociatien
are the parties to this snit. -
Daring the lifetime of Gebrge Beep, although l
the niembetiall covenanted to give implicit ohe,'
;Renee to 'Lie laws and regidatione of the com
munity," it doss not appear they ever had any
' code of regulations or by-laws. The will and
word of George Rapp was in fact the only law.
The government was pairiarrAal, that is, obso"
tote—Rapp' 'exercising all power, civil, religioun'
temporal:and spiritual. Hewes prophet, priest,
and king, having absolute control over the, fate
and fortunes of his followers, not only in tai
world, bat (as they were told and probably be:
lieved,) in the World to come. If they obeyed
his precepts, their tames wets to be writtenitif
the "Lamb's Book of Life," otherwise, they
were to adffer Purgatory some millions of
yearr, if not forever.
Although by the contract and agree:l:m[4.AL
the atieral members of this 'association,' 'ilachf
had on equal right to and interest in their °ow ,
mon 'property 'and had estopped himself fell
even setting op any claim for property or labor

tained no enumeration of offences by which a
member should forfeit hie rights and interest In
their common property, itpointed out na.tribu
nil which Lade power to Inflict thepanLehment of

property gained by their common contributions
and labor. In dealing with the right* of per;
