Our aim has been to mod crate the manifestations of popular feeling; tin tit; (as these evidences of sympathy and good feeling were soon to assume a national forms and importance,) there wail clear and distinct proof that ill. Kossuth deserved all honor which a free people were.about to heap upon, for his person• al merit's alike, as well ce for the aake of the cause . he represents. We did fear that there might be some truth in the unfavorable reports that have reached this country, and even atilt marvel that they have been entirely and only fabrications—TlM thing would be incredible, did not the'proof rest on testimony of the moat unexceptionable character. They will remove the last -vestige of any unfavorable impression which thole slanderous reports may hare made. ' Very pleasant, indeed, appears to have been the in tercourse between Kossuth and his companions and the officers of the Mississippi from the first to the last, and so tar from- there having been estrangement, or dispute, or disrespectful con duct on the, part of either, Kossuth appears very soon to have discovered thst he was among his friends,• and to have consulted Captain Long on points respecting which a lees noble and con fiding spirit would probably heve acted on his own reepomibility. It would be a great thing to establish such aconstitutional monarchy as that of Great Britain in the heart of Europe For liberty Koecuth has struggled, and is strag gled nobly, and we trust he will have such a welcome as should convince him and the world that a free people can appreciate such men. To his Honor, A. C. ifingstand, -Boyce of the CiN of Neer York The United Staten ordered the steam frigate Mieviseippl to conduct me out of my pris on to freedom, and by freedom to life, became to activity. . I bailed this generous resolutionas the greatest honor which a wan ran meet I hoiledit as a ray of hope and consolation to my down trodden. to my bleeding bat still not broken native land. [,hailed it as a bigly encouraging manifestation of your glorious people's sympathy tolhat princi ple which was and will over be the aim of all the endeavors of all my life.' And when, with the noble-minded consent ment of the Suiten, I stepped on hoard the Mi., missippi frigate, and once more free, because under your glorious fiag—heard the warm, gen erous, welcoming cheers of the officers and crow —theso frank, loyal, gallant men, the true rep resentatives of American freedom, American greatness, American generosity, I could not for bear to have the impression that the spirit of America's young giant has shouted over the waits to Old Europe's oppressed nations, "don't despair, here is a brother's powerful hand to your aid!" These being my sentiments, you can judge by them, how fervently I must have wished to have the honor to be Conducted, by this very frigate, to the United States. But I know that the sympathy of the United States it not given to any man in the world for his own sake, but for the principle's sake that he represents. : AWd e. I felt convinced that I would prove unworthy to this sympathy, (the highest treasure of my ) should I neglect for a single moment the duties which Divine Provi dence hoe assigned to me: should I neglet to provide according to the exigenciee of circum stances for the interests of yonder cause which the glorious Republic of the United States lion• oreff with its approbation and its sympathy. Ft became, therefore, an imperious duty of honor and conscience to me not to leave Europe without arranging my public and private affairs, and carefully providing against any harm to the sacred aim of my life, for that time which T Abell have to enjoy the honor of the hospitality of year glorious land. So the most imperious duties of a patriot, a father, and a man, impose upon me the neeeall ty to stop for a few days in England, before I continua my passage to the United States. Com. Morgan, at Spends, and • afterward Capt. Long, of the Mississippi, here, did, with the noble kindness or a true American heart, appreciate the motive of this necessity, and generously consented to wait with the Mississip- ! pi in the Bay of Gibraltar for my return from England with the packet boat which leaves Southampton un the Uth mat But the Government of the French "Repub lic," (not the French nation, but its present Government.) refused to grant me permission to pass rapidly through France, by which pass age I might have spared time and suffering to my wife and children. And now the first means of conveyance to England I can avail myself of is only a packet boat, expected to-morrow to ar. rive from the Orient, and this, too, making 11 days to England from here. On the other hand, Capt Long Worms me that any longer delaybere would render not only my associates, but 4150 the Of and crew of the Misslasippi, liable in approaching the coast, of the United States at a late re.. to ma ny sufferings, by- having to endure excessively severe cold and stormy weather.. Bo considerin,g, on the one side, that the most sacred duties force me not to leave Europe for some -time, before providing for my affairs in England, and considering. on the other side, that only staying eight or tea days in England, it were entirely Impossible to join again the Mil eisslppl here before the 18th of November, no that, of - course-we could only arrive in the sec ond half of Decemberon Toni hospitable shores, it banal:tie absolutely duty Of honor to me not to cause arty augmentation in the hardships and sufferings to the officers and crew of this ship, and not to embarrass them in their public sea. vice, as also to "alleviate ;my own asocciates on their passage to the United States These are the motives, sir. which deprive me .f the honor to be conducted to -your glorious shores on board the Mississippi frigate, hut I feel consoled ►t the idea that in adopting such a course I not only bare relieved those who are on board the Mississippi from some sufferings, but myself also will have the high satisfaction an entirti month sooner to enjorthe happiness of landing at New York,as lam decided to le►te England on board of that steamer which leaves Liverpool on the ith (probably the Bth) Novem ber for New York. Before Judges Nelson and Bette : EL IL lisecom , and others vs. George Lane and others. The opinion of the Court in this care nee delivered this morning by ' Judge Nelson, and we may now expect that the contro versy between the Blethodst Episcopal Church. South, in relation to the , division of property, will be dellnitely.settled. :The case was argued several months ago by George Wood and Rufus Choate far the defendants; and Daniel Lord and ileverdy Johnson for the complainants. We re ported the facts at considerable length at the time, and it is therefore unnecessary to recapit ulate them. The opinion of the Court is vol. ' =lnoue, and occupied an hour and a half inks delivery. Judge Nelson requested that its pub lication might be deferred`rintil to-morrow, as he desired in the mein time to revise the proof sheets. but there will.be such a general anxiety to know the result, that we give the substance .. of the decision today The greaser part f the document consists of a summitry of th complaint and answer. The. first point cone dered Is the power., of of the general contest es to authorize a separa tion, and this the Co hold to have been clear ly shown. “Indepen ant of property," they say, 'the power of s Terence is written upon every page of their proc (dings." Thiry then ad• tart to the plan of Reputation in 1845, by which the only condition upon which a permanent sep arate organization vise made to depend wee the voluntary action of the annual conference, in the eleveholding States. These conferences de termined upon the separation ' and ipso facto it became complete. It Wee stipulated ui the plan of severance that mitre might attach them eelvee without blame either, branch of the Charth, and the local property wain the limits of each branch was not to be claimed by the other. The general property, such as notes, ) 6 thellook Concern, tux, was reserved for disposal upon equitable primly , es after farther consid eration, it being consi dered essential before this part of the division could be accompliehed, that two-thirds of all the annual conferences, North and South, should coward to the repeal of the sixth restrictive article .of, the Church. This article not having Deena() repealed, the Court held that if there wait no other consideration in the cue, the IL IL Church, South. might not perhaps be entitled to & share of the property. But the rights of the Church, South, rest upon established principles of law and equity, which make It the dirty of a wart of Channery to, in-. and see that tIF find Is properly distrib uted, espestielly es it by no means certain thit the distribution claim d would be even In contra- , "entice of the 81: h. reetriadie a rticle.
