It was alledged "an behalf of the Plaintiff
owing to the injuries remised by the °swum of
one of the stage coaches belonging to Defend
ants, while going from Cumberland, - Md., to
Brolmasille, Pm, he had lost the use of one eye.
• The Plaintiff did not make his appearance in
the Court Room at all diving the progress of the ,
trial. which occupied offersl days, and Sher*
dance on the embjett of hie kebig the:aye, was
very contradictory_ It was contended by the
Defendants that the loss of vision, if any there
Were. was owing to en °corder disease of long
standing. Staler and Stamatonappearedfor the
Plaintiff—liessrs:Loomis end Frew far the De-
Judge Grier maid that the duty dais Court in
the present ease was light, since there ores no
dispute a to the law, which had been well stated
by the learned Counsel =both sides. The pro. .
endings had been conducted with great ability,
and no tittle eloquence by them, but it was for
the jury to judge dispassiamillgy, the 'facto as
they appeared in evidence. Tlio learned Judge
proceeded to lay down the lair, osregarded Com
mon Carriers who were looked upon in the eye
of the law, almost as insurers of the property
they carried, It we net do for them, for in
stance, when they tied the place of their dea.

oration, to say that e goods entrusted to their
charge were stolen, fo that they were bound to
guard against. The were responsible for all
accidents, except - sno b as were unavoidable. If
the goods were destro ed by lightning, or, if, in
times of war, they w captured by, ',public
enemy, that would co • te a valid defence,
but if fifty robbers too them by force from their
possessiou, that fact. : not: a etracint ex
r.,
The leerned Judge entered into quite ani emo
ting disquisition on the forced honesty of Com.
men Carriers. In nowt countries they were al
most the only trustworthy persons - lathe commu
nity, u in Bpsdn, where the muleteers were the.
only class of men in the nation, on whom hon.
arty reliance could be Plated, and.well wouldit
be for the citizens if thegovernment were com
posed of them. The law as to carriers ;if . per.
Ems., was not. so shictrif, hosteler. a stage
. coach company, for the sake of a miserable
economy, tied oriiniout or vicious hones—im

drunken drivers, even in cases where the 'utmost
care had otherwise beer. exercised, they wen
responsible, in damages, for accidents happen
ing from any one of th ole causes. But Suppose
that good drivers were employed, and that the
bones, harness, and coaches were good, end yet
, an accident should hs ea, owing to some per.
son near the road firing gun, and frightening
the hones, thle, would of be the fault of the
company, and if the !engem were injecredby
an overturn in anche they must bear their
own losses. The jury c old recall many parallel
Gaya to mind, far obey ad all, probably, seen
horses repeatedly fright by droves of cattle
blotting up the'tend, 4by other causes. In
the ease which then o pied their atteation, it
l a
could not be contendedttho stage company

had failed in furnishingthe ir coaches with every
thing essential to them ty of their passengers.
The coaches; and ho were both very good,
and the former were furnished with candles, in
order to light the road when it eltouldbecome
necessary. The accident from which the Plain
tiff Was olledged to have suffered, soon owing,
Mthiny, to a heap ofUlnas in' the road. Ile
already given hie opinion with regusi to the
state of the National road, and he presumed it
• would never be bettered until ,130M0 of three
connected with .it, were convicted of homicide
for some of the accidents happeeing on it, in
which some ono would be killed; if, however,
• tlds accidinit happened from any want of can in
the driver, it wester the jury, to say so.
Another question for them to determine, jrsig
- ing from.the oeidence; was, whether as the night
was a dark one. had the candles of the ;coach
teen lighted 2 If so, and they were extinguish
ed, as was contended, by the jolting when the
coach was descending the bill. when the accident
took place, should the driver he been mudded
with matches, and stopped to udight them, or as
was contended by the counsel for thedefenduits,
would he not have been to blame for stopping at
that particular place, anthems it the safest eOO2llO
for him to pass on, downhill, without attempting
to'etop 1 Again, if the accident occurred wing ,
to any negligence on the part of th e driver, the I
jury were to decide the amount of damages
which the plaintiff should recover: A case ran

uses where d runk en drivers were employed, or
where the horses or washes were bad. •, They
would be respnorible In case" of grass neelpones,
but in this case every care and caution bad been i
used, audit any damages were to be awarded,
they should only be compensatory'.
The stage had been overturned, end two per
sons thrown en the plaintiff. He might , have
got some cutest the time width would look ter
rible enough with the blood streaming from
them, and yet these cute might be
cite of of but trifting . incoarenienoe and no lasting
injury. A false issue was generally, in trials'f
this nature, presented to juries. The coon
, eel said to them. would you receive such and
such injuries for a thousand dollars? No, Joni
of them, would not take that sum, casaba:at to
an injury, which would result in tot a trifling
pain for a abort time. Some of the jury might
not choose to teluirabundred dollars to atir fru:
the tooth echo for two hours, but these questions
bad nothing to do with the case. It was contend
ed that, owmg to thin accident, the plaintiff had
lost as eye. Where negligence had occurred, and
horses had,inconsequence ran away, upsetting
the coach, and breaking the legs of some of the
