The case was opened on the part of the Com monwealth by Mr. Brady, who stated that they would prove the defendant to n 1 published the li bel complained of in the Courier, o German pa per, .wherein Mr. Seth was accusal, (though Dot by name), of having left Boston without pay ing his tailor's bills. Mr. Serb is connected with the Freedom Friend, another German pa per. Mr. Brady then proceeded to detne the law of libel. . A copy of the Pittsburgh Courier was offered in etidenca by Samuel Wilmer, a young lad who ha& purchased it from Mr. Backofen at his office and Written ids name upon it, by Neeb's direc tions. Victor Scribe sworn-31r. S. read the article complained of in Germon. Messrs. William and Lotus Seib were at the time of the publication of the libel the responsible editors of the Free dom's Friend. Mr. Ilackefen is editor and pro prietors of the German Courier. Upon reading the article bathe Courier, I understood it to re fer to Wm. Neel), though no name was mention- Cross examlned—Lmsy have written some rd 'thrill articles for the Freedom's F riend at that time. The . witness knew that the article refer red to Wm. Neeb, because he was the only editor who had ever been In Boston, and the libel ac cused him of running off from that place without paying his tailor's bills. There was at the time • controversy going on between the Courier and Freedom's Friend. I don't know that the arti cle !tithe Courier was an answer to one which I bad written in the Freedom's Friend. Mr Reinemaa from reading the article under stood it to refer to Mr. Neeb. Cross examined--Mr. ficriba wrote for the paper sometimes. I knew of no others. A number of other witnesses were called to prise that from reading the article in question they understood it to refer to Wm. Neeb. The case was opened to the jury on behalf of the Defence, by Mr, Uumberstaeller, who stated that they would be enabled to prose that Mr. Backofen bad nothing to do with the composition of the article in question, which was signed by its author, a Mr. Sabin', who had been grossly attacked and libelled in the Freedom's Friend, Mr. B. was at the time absent ha - Philadelphia, whore he bad gone as a delegate to s conven tion held there, and on his return, finding how he had been maligned, he wrote an article in re ply, which he published orer his own signature n the Courier. It was for a portion of that as ide, published under the circumstances which he bad stated, that his client was . called into the Court.
