HOME MATTERS IXPOZTAN7 A.IIBIPT OP COPOITZETIPITZIAL—SI - Major and police.ofEcer Fox, have been, for some time peat, in tke possession of informs- ALon which induced them to believe that a large quantity of counterfeit money was daily being sold by a gang of counterfeiters, in this city, to dishonest persons. The whole affair was con ducted with great secrecy - , and the greater por tion of the counterfeit money, put in circulation up the Allegheny and Monongahela rivers, and down the Ohio, though a largo amount vas pass ed here. Police officer Fox, with his usual shrewdness, ISOM procured a clue, which induced him to be lieve that be could arrest the ring-leaders of the gang, and after a consultation between him and the Alderman, in order clearly to establish their guilt, it wee determined to send a person who was to pretend to Irish to purchase counterfeit money from them. Thil person was accordingly let into the secret, and had a conversation with - Unman named Salmon Austin, who told him that be had counterfeit notes to sell, at the rate of twenty cents on the dollar. The agent of Abler - man Major, demanded to see a sample, as be had a partner, from whom the capital was to come, and was furnished with a well executed ten dol lar note, on the ?diners' Bank of Pottsville. With this be returned to police officer Fax, after hav ing appointed an hour,. yesterday morning, when he was to call at a hotel, in Allegheny city. and purchase one handredUollars' worth. At the appointed hour, police officers Fox, Thompson, Fitactorris, , and McCoy, crossed the rim, and the agent, going into the rendezvous, found Samuel Gardiner, who was connected with Austin in selling the money, with the notes in his possession. At a given signal, the police rushed in, and both Austin and he werearrested- On being searched, the sum of four hundred and eleven dollars, in counterfeit notes, was found in their possession. Three hundred dollars of this amount were in ten dollar notes on the State Bank of Ohio. The engraving is very fine in deed, though the signatures ore badly executed. The remainder consisted of spurious ten dollar notes on the Miner's Bank of Potirrille; and threes on the State Bank of Ohio, the former being tolerably well executed. Sixty dollars i. counterfeit notes were afte'rwards found in Gar diner's trunk. _ . Both Atistin and Gardiner, after an examina tion berate Alderman Major, were committed for farther hearing. The latter admits his crime, and declared that he bad sold one thousand dal -'.tars, in spurious money, on the previous day, to raft:men going down the river, and other per- Alderman Mayor, teed officer Fox, deserve the thanks of the community for their vigilance in , thus breaking up a dangerous gang of counter. , falters. Csur readers will recollect that it is only s short time sure they obtained three steel en griviogs, for printing bank notes, from counter feiters. The banks and brokers should, we think, gin the police in this case, some testimonial of the estimation in which they hold their activity. ,It is not more than once in ten years that arrests so important as these are made, and all concern ed in them are entitled to much credit. The right and even duty of the magistrates to take private examinations, and to prevent the prisoner from communicating with other persons while undergoing his preliminary examination, if they think it necessary for purposes of justice, are here distinctly recognised and asserted. The ante principle Is laid down in Collier, vs Hicks, and others,- a similar and More recent case found in 22.'E. Corn, Law. Rep. pg. 16 1. And in the the case of Rex, vs. Borrow, S. E. Com. Law. Rep. RM. These cases, which were decided without dile Ant, and after full argument, have settled the law: that It is in the discretion of the Magistrate to determine when and how far he will permit Attorneys or others to attend or take part in such examinations held before him.
