GAZETTE The .weather we lore having just now is-the most delightful I ever saw in January. The grass in the parks is beginning to show itself, and should there be no change - in the weather within three or four days, it Is thought that the mecs will put fortbssome of their buds. We shall doubtless have to - pay roundly for it before next mouth is out. Some time ago I alluded to a rumor of the establishment of another Opera House,. in this city, on' o scale of magnificence excelling, any thing ever before atteinptal in this country. 1 have now to add that the project is likely to be carried through. The ground has already been purchased of the &neves.' estate, antLthe con tract was signed yesterday. Mr. Tripler, the projector and builder of the mammoth musimil bill, bearing his name, is said to be one of the parties', and be is now In ilavona for the purpose of.engaging Signor Marti, of the Tucon Theatre, to join the enterprise. The house, it is under stood, is to hold nil thmmand people, and by fix ing the prices at a ruodenile rate, and securing the greasest singers of Europe, to give New York an Opera which will vie with the'produci Gone of London and Paris. It is a bold under taking, and if not better patronized than its predecessors, I fear it will 'prove ruinous to the.l projectors. 1 A grind complimentary benefit was given to t Wm. F. Brough, the voranst, at Nihla's Theatre, lrst night, which yielded twa thousand one hun dred dollars, after paying all expenses. The performances were composed of"ona net of an English Opera, a miscellaneous Concert, a scene from an Italian Opera, ,kc . . The best musical talent in the city volunteered its serried, includ ing the pick of Mariyekk company, ' Sega:tide, Burton, and others. British t onset for the State of North Caroline: 'mid South Carolina, and the Governor of the lot-. ter State, is of no email importance. •dace it with the very excellent comments of the New York Coilanereid "Advert: ice,. in which the serious nature of the questions raised, and - their bearings upoil national and staterelations, 'are clearly elated : ' A sew Prtaile or AN otis Stmaim—lt gill amtrcely be forgotten that some months since a Correspondence took place between our SecretaL ry of State and the . British Cabinet respecting the imprisonment of free colored persons, suh, jean of Great Britain, in the ports of South Car , ohs, The then Secretary of State, Mr- Clayton, represented to the British Government the peen-, liar difficulties which surrounded the question„ such as bad indemlbeen pointed out in a previous correspondence upon the same subject between the two governments; and suggested to the English Cabinet whether it was desirable or expedient to push the matter, in view of the great and almost insurmountable- impediments to its satisfactory settlement. It was specifically mentioned to the British Minister that in matters affecting its lo cal police and state gneertunent each state was, sovereign, and that the general go'vernmmu could not rightfully interfere with the legislation of South Carolina, unless such legislation. contra vened the constitutional obligations and . restric, tion.s by which South Carolina, in common, with all her sister states was solemnly bound. The British Government forebore pressing the matter further upon our Cabinet, and from some explanations recently made in the British Peril meat, the opinion generally prevailed that, for some tine at least, the question, as between the two governments, would be allowed to sleep:— Yesterilay, however, the Evening PosCa corre spondence from Culumbin S. C., revealed a new phase of the sithjeck The British Cabinet, acting evidently upon the hint derived from its corres pondence with the 'American Minister, has 'di rected her Brits-sic. Majesty's consul general for the Carolinas, to address South Carolina as a soa r/a:2n rims, and to bring the question directly-be fore its Governor. We regard the correspond ence thusopened with anxiety, and treat it with importance, for two reasons- First, because it shows that the government of Great Britain has found it necessary so speedily to re-open the question. We say found it necessary, becat there is every reason to believe that the Brills Cabinet had no desire, in the present and gniw ing friendly feelingkbetween the two powers, to press this Matter loan issue. Many circumstances combine to strengthen this belief, which etas justified by the language held -by the Ministry, when questioned upon the subject in the House of CoIINUOIM. We infer, therefore, that, in renewing the ap plication, the British Cabinet has acted under the pressure of popular sentiment in England, which every one knows amounts to a strong and universal anti-shivery feeling. It is far from improbable, also, that a wounded national pride is mingled with this feeling, for it is well known that the English people , love. to boastlthat the mantle of British protection is thrown around the humblest subject of the realm, wherever he may be. We make the same boast with respect to our own Government, and it is praiseworthy, and need not be carried out into offensiveness or ar rogance. Ifni a mutual right, to he mutually respected. We think it safe to assume. there fore, that there is a combined feeling at theeback of this renewed application—that the unwilling ness of the people of England to submit to fhe imprisonment of a British sub ject,. without even . accusation of crime and at his own br his the player's expert., has been added to the strong anti-slavery feeling, nut that the instructitins given to Mr. Caosul General Mathew, have been issual under tie steady pressure of this comblu— ed sentiment. It is not difficult to' suppose: that the recent dissuasions and legisAntien of our own Congress upon shivery have excited the attention of the people of Engtmil to this branch of the subject. Believing dint these agencies have been at work to induce the British Government to renew. its protests and its claim, we aro constrained to regard the correspondence which we publish be low with some anxiety. It seems most likely that the correspondence will not: be abandoned without some result-that it - will be pros6cuted. to one issue or another. Whether we hive rightly divined tho true reason.why the applicti tion has been renewed, or whether we have not, it Still seems to us morally certain, history in structing las, that the application will bo pertina ciously pressed, and the exemption from impris onment finally insisted upon. We suppose dolt the injustice of the South Carolinian law in view of treaties existing between the United bitatm and England was virtually conceded in the cor corespondence of the two governments. already referred to. Its violationof the treaty, if we re member rightly, was not • denied—it was. rather apologized for, as in-reality animportantcomps red with the grave results tluitmighttlow from pershitence in remedying the aril.. Ind And thls leads us to a second point of equpl importance and difficulty. By this. correspon dence may be raised, and probably will, theeore.: Plicated question of how far slate - rights can be pleaded as sitar to the fulfillment of internation al treaties.
