After tho common pleas list for this
week had been gone over yesterday
morning after the opening of the sec
ond week of tho term there wns only
n small fraction of It left. When tho
list was called last week a largo num
ber of cases were continued, and yes
terday this number was enlarged con
siderable, ninny having to go over bo
cause tho attorneys were engaged In
the hearings before the strike commis
sion. The cases continued yesterday were:

I. Ij. Myers and tho action in assump

of Scranton were referred to Attorney
J. W. Carpenter. The case of A. B.
Stevens against W. H. Fisher was re
ferred to Attorney J. E. SlclUer.
Before Judge Edwards.
Judge II. M. Edwards is presiding In
court room No. 2 this week, and before
him was called tho case of the Scran
ion Dairy company against M. D.
Hreschel and others. The action was
to collect for milk furnished to Breach -ol.
His defense was that the milk was
furnished to his hrother not to him.
The Jury decided nevertheless to find
for the plaintiff and returned a verdict
of $35.54.
Before Judge E. C. Newcomb In the
jnaln court room, the suit of Edward
Welsh ngalnst Daniel Wayno was
tried. The latter built a house in Old
Forge and the contract was awarded
to Roland Belles. Walsh was a sub
contractor to do tho lathing and plas
tering and he alleges that Mrs. Wayno
told him to proceed with the work and
pho would sec that he was paid. Way
no, it is alleged, also gave the samo as
surance. When the plaintiff rested.
Attorneys M. J. and T. A. Donahoe
asked for a non-suit, but It was refused
and the defense was then put in. It
was a denial of the alleged verbal con
tract which Walsh said ho made with
the Waynos. Attorney John F. Murphy
appeared for the plaintiff. The case
went to tho jury at 4 o'clock and court
adjourned for the day, there being no
other cases ready for trial.

Mary MeCormlck and others, and the
borough of Dunmore against W. S.
Knight, mandamus, were reported set

Wall Street Review.
New York, Nov. 17. The stock markot
presented few. If any, marked character
istics today. Tho opening was decidedly
irregular, but gave away to a better foul
ing botoro tho end of tho fiist hour, when
it became evident that certain vague ru
mors of "Trouble" were unfounded The
leaturo of the early tiadlns as woll 03
of the entire day was Manhattan, which
was exceptionally strong and active, mak
ing a maximum and net galu of over 3
points on transactions that more than ex
ceeded onc-tlfth of the day's total oper
ations. Tho rise In this stock which was
bought openly in big blocks by brokers
who usually lepresent Gould interests,
revived the old story that Manhattan Is to
be taken over by the New York Central
on a guaranteed dividend. No conllrma
tion ot this was obtainable nor did any
great amount of credence attach to it.
Tho other tiactions were fairly strong In
sympathy, Metropolitan on very light
tiansactlons gaining over a point with
a fractional advance In Brooklyn Tran
sit. Considerable attention was drawn to
St. Paul by icason of Its rather irregular
movements and the stock closed with a
slight loss. New York Central which
made an early gain of Hi lost much of
Its advance and Baltimoro and Ohio fell
over a nolnt fiom tho ton in suite of Its
good showing In earnings for tho tlscal
year. Other netivo railway Issues that
displayed heaviness included the Pacific
gioup, tho pressure against Union TacUlc
nt ono time being very marked. In the
special class, Colorado Fuel, United States
Steel, American Smelting, Sugar and a
fe wothers were steady. Sugar making a
material net gain. For tho most part,
however, changes were unimportant, early
session wero narrow, traders showing a.
disposition to await developments In the
local financial situation. The declino of
3! points in Geneial Electric resulted
from reports of labor troubles nt the com
pany's works at Schenectady. Profit tak
ing in tho InRt hour brought recessions to
a number of active Issues and while tho
market rallied tho closing was Irregulat.
The question of increased railway wages
continued to be ti matter of serious dis
cussion ns well as the congestion of
freight traffic on the leading loads and
it is becoming cleat er dally that the ca
pacity of practically every trunk road
will be taxed to tho utmost. Total sales,
701,300 shares. Ronds wero li regular on a
small range. Total sales, par value, $2,
wo.000. United States old -Is declined U
per cent on tho last call.
