Vosbttrg ask for the selection of ( '. W. Dawson, esq,, as referee. ! In the several cases, the court had approved the bills and subsequent- ly Hie auditing committee of councils did likewise, as a matter of form, because the com t had already ordered tho city to pay the bills. That, however, did not give a Judgment, and the city had no money to pay the appi oved bills. In order, therefore, to secure the money, the plaintiffs had to negotiate their claims.- But an Involuntary judgment had to be ilrst secured. The banks and individuals would not negotiate or purchase a judgment if a. voluntary confession by the city solicitor, or of a judg- inent by default. The reason for that is one of law. Hence to avoid tho trial of suits agains't the cltv. with the resultant costs. Mr. Vosburg J agioed to the appointment of a referee. There was absolutely no de fense to the claims, and Mr. Vosburg so specified as a reason for agree ing to the references. The referring of the cases saved money for both the city and the county. Involuntary judgment, the only kind we could accept, was ob tained without the costs of arbitration or trial, which otherwise would have been placed upon the city, for the judgments would have carried the costs and made them chargeable to the city. Mr. Vosburg, as city solicitor, therefore, did what was proper and right In the matter. The county was benefitted as the costs of a trial are greater than the bills of the referee hi these cases. The charges were moderate and reasonable; Ilrst approved by us as counsel, ana then by the court. The plaintiff's obtained Involuntary judgments that could be sold or assigned, and no one was injured in any way, shape or manner.
