The opinion handed down by Judge Edwards, refusing to strike ofC tho non suit In tho case of Mury Ann Kyon against tho Delaware, Lackawanna and Western Mutual Aid association, is as follows: Tho only Important question to be con nldarcrt In tho disposition of this rule re lates to tho construction of sections two Mid throo of Artlclo XIV of defendants by-laws. Tho regularity of tho assessment nnd tho fact that tho deceased. Edward Byan, was In arrears mora than forty-Ilvo days, woro established by evidence that could not bo reasonably disputed. Nor was tho alleged tender supported by any ouch testimony as would justify us In submitting the question of tender to tho Jury. Therefore, tho whole caso rests on tho view taken of the by-law referred to. A part of section two of Artlclo XIV, of tho by-laws, Is as follows: "A printed notice of each and every as sessment shall bo posted on tho several bulletin boards of tho Delaware, Iicka winna nnd "Western Railroad company. Buch' notlco shall bear dato and notify mombers Interested within rorty-nvo days from the dato of such notlco. Should payment not bo made by any member on or before tho forty-fifth day from tho dato of such notice, cither to a collector or to the secretary at Scranton, such fail ure to pay suspends the member from the association and docs not require a notlco of .suspension from tho secretary. Forty-five days Is hereby declared the limit within which such payments may bo made In order to retain membership Jn tho association." Section three reads thus: "At each reg ular meeting' of tho association the finan cial secretary shall report the names ot nil delinquents as set forth In this ar ticle, .whereupon tho association, by dec laration of tho president, shall declare puch delinquents suspended and debarred from any benetlts whatsoever from tho association. A proper record of such declaration shall bu made upon tho rec ords of the association." It is Impossible to misunderstand or mlsconstruo the language of the part of section thrco above quoted. It Is clear nnd unequivocal. Of the many by-laws of beneficial associations that have been' under consideration, wo have not seen nny containing less ambiguous language than that of section three In this case. A failure to pay the assessment within forty-fivo days "suspends tho member from tho association, nnd does not re quire a notlco of suspension from the sec retary." So far as tho delinquent mem ber is concerned, ho Is suspended from tho association by the express language of tlio by-law, without further notice. Tho by-law is therefore self-executing in tho fullest meaning of tho term. It is claimed on tho part of tho plain tiff that section two ot this by-law Is modified by section three nnd Is not op erative until tho president declares the suspension at a meeting of tho associa tion. Wc think this contention is un tenable. Wo look upon section thrco as a provision adopted by tho association to keep a. record of delinquent members. Tho financial secretary "reports the names of all delinquents" and the presi dent "declares such delinquents" tho de linquents reported by tho secretary, sus pended. Tho delinquency already exists by tho terms of section two, and tho as sociation for its own convenience and for the purpose of keeping a correct record makes the declaration provided in sec tion three. There is nothing In this sec tion which would lead in any way to tho conclusion that tho positive, self execut ing provision of section two is suspended or postponed until any meeting or nny declaration of the association. Tho rela tion of tho delinquent member as n bene ficiary of tho association Is governed en tirely by tho terms ot section two. Any other construction of tho by-law would lead to confusion nnd uncertainty. Our attention has been culled to the case of Wheeler vs. Lackawanna Acci dental fund, 5 Lack. I,. News, 7, nnd niiulc vs. tho Diamond Accidental fund, Ibid, 101. both cases decided in our own court. Tho first case Is cited as author ity for tho defendant. The two cases nro easily distinguished. Today's dealings in stocks were lurger than those of yester day und there were more of the usual market leaders that were conspicuous In tho dealings. But tho market re mained uneven and tho special features of strength did not have news to explain them beyond the reported activity of speculative poolH.
