The opin ion follows: The plaintiff ccmplnlus of the opeintlou bv the defciidntit of of a musical Instiu ment nttached to the devise commonly known lis a "lucrry-so-iound," On the allegations of the 1)111 and the nflldnxlts, we wanted a piellmlnaiy In junction, we gi anted a picllmlnary ntle to lontluuc the Injunction voluminous tes timony has been taken, thhty-sevon wit nesses having been swniu on both hides. CAFSK OK COMPLAINT. After a full (ousldointlon of all the tctimony we h.te no hesitation in de ciding that the plaintiff has n just and sulirtnntlnl caij.-.p of lompl.ilnt and that the pi ellmlnniy Injunction awarded should be made peimanent. As the case whs fully lieniil on tlie uile to continue tbo Inliinetlon we shall make tome speciltc findings of fact: 1. The "m"ri.-gn-iound" in question is located near the ontianee to Nay Aug ptiK. It Is not on the pal It giounds. The Immediate nelghboihood is of a purely residential charaetei. While their aie no residences in the name block as tho "nieri.-go-iniiml ' neither aie theio any tiiisliiess places as was suggested bv tho .iiue-rtlons of tile defendant's counsel. 'J'lie husine.ss consists of a soda fountain (.land, a photograph gallery and Ice. cietm establishment, it is safe to state that the nelghboihood in the -iclnity ot the pai It, for seicuil blocks, is, and will be ery laigel.x, If not altogether, iel dentlal 2. The "oigan" or musical instiument nttached to the "nioii-go-iound," Is con structed on the plan of n pipo oigan. Steam is the mothe power which moves tho "mcro-go-iound." tho revolving of vliich in Its tin n furnishing the power for the oigan H cannot be successfully maintained that this oigan Is not a mu sical instiument in the ptopor meaning of the woid; but, it is py appaicnt that II Is so consti acted or arranged, or else it is of such a quality, that Its tones are loud and sharp, and of a metallic char acter. The stiongest pioof of the dis till hlng effect of this instnunent Is to lie found In the fact that It can be henid a long distance awav. Neuily all the wit nesses agiee on this those for tho de fense as well as those for the plaintiff. DISTANCES GIVEN. The distances given vaiy fiom 300 to S"0 feel and fiom two to si cltv blocks. This one fact along condemns the instiu ment as a dlstuihina agencv nnd a nuis ance in the leslclentlal nelghboihood. The moment a witness testifies that he can bear the oigan distinctly at a distance of fiijo or -IdO oi .",00 feet, that moment be de claies It to be a nuisance. The wilter of this opinion, since the hearing in this case, had occasion to lslt a place where the "meiiy-go-Vound" i.voled nenily all day, and with eiy little Intel mission In the evening. lie flrt heard the music when about 73 feet fiom the building, but could not distinguish any paitlcular tune or belee tlon until he appionihed the building closely, and then tones came soft and low, The neaiest lesidenco was about 130 feet away and .standing thcie the i Iter could not heal anv sound nom be dltectioii of the "meiiy-go-iound." J'hls lnutaiice Is given ar an lllustiation jf the pioposltion that it Is possible to opeuito a "inui r -go-i ouiirt" with Its iiccompanvlng oigan without distuibiug the uelghbois in its Immediate vicinity. Hut in tho fiiho at bar, tho oieau com plained of vsab undoubtedly a nuisance and seems to have been toned so as to nttiact the attention of porsons a long distance away. .1. The onncls of dwelling holmes have n right to protection against all Un lawful noise nnd distill banco of domestic quiet, In Harrison vs, St. Mark's Church, 3 V. N C. 3M, tho couit says that as the atmosphcio cannot tlghtfully be infected with noNlous cxhnlatlon, so It should not bo caused lo vibrato In a way that will wound the sense of heating. It was do clded In that case that noise envtsed by iho ringing of church bells, tf stifllclcnt to annoy nnd disturb residents of the nelgh boihood In their homes and occupations, was a nulsnnco and would be enjoined. In another case, Wallace vs. Aucr, 10 riilln. 3.1G, tho business of n gold or sil ver benter, set up In a quiet dwelling nelghboihood and unreasonably Interfer ing with the quiet enjoyment of neigh boring property, wan eniolncd ns a nuis ance. It Is of course conceded, because It Is tho law, that In business localities, de vices and mnchlnciy nro permitted which If erected In a irsldontlal community would bo nuisances. New York, July 10 There was an ac tive and aiicBntcd speculation in stocks today, the market lctlcctlng the play of l.ugcr foiccs than at any time during the lcccnt advancing tendency. No specific new developments wcio evident to ac count for the movement, which v. as ap p.nently due to the substantial ba-ib ot confidence In the generally prosperous condition of the countiy and the ritm foundation of ci edits. Published ab stiaets of the allidalls of ofliclals of the I'nlted States Steel eoipor.itlon as to the Intrinsic aluo of the propel ties and the earning power of the company, which weie filed In connection with the leply to the suit against the coipoiatlon, were expected to have a stimulating effect upon pi Ices". The fact that the advance in tho I'nlted States Steel stocks came to a standstill under tho flood of long stock which come out when they iveie bid up, nnd the fiuther fact that Chi cago lenowed its demand upon New York for cuiicnry, causing a shipment of ?100, 00u througth the sub-tieasury, were with out effect in checking the bullish ten dency of the market. Ttadeis laid much stress on their belief that they detected tho Quotations of Jlorcran and Standard (.Oil inteiests in tho large btnlng oiders executed by various hrokcis. It was very obvious that the bilnging forwaid of new stocks into the upward movement was taken advantage of on a very largo hcnlo to take pioflts in stocks which, have risen hitheito. But this piollt-taklng was achieved successfully without making se ilous inioads upon ptices of the stocks affected which weie, generally speaking, the high pi iced established dividend pay eis, especially among the Ginngers. Stocks of the second giade, lower in price and wltb no established dividend pajing lecoid, took the leadeishlp of tho market. The heay absorption of Chi cago and Alton hud the stiengthening effect on other low pi Iced railioad stocks In the west and southwest, while tho ug gressivo Use In Chesapeake and Ohio af fected the low priced coal cairvlng roads, both In tho antluucite and bituminous Held. The belief that toinoriow'b miners' convention at lhdianapolls will decide against a geneial stiiko and thus lead up to an early settlement of the anthra cite .stiike was the piedomlnating featuie In this gioup of stocks. Much was made also of a oiirient rumor that tho contiol of Reading had passed over to the Penn sylvania, thus centiallzlng the contiol of that company of .the antluucite coal There woie other points of stiength fiom Individual causes. Amalgamated Copper was bought In the belief that the piesent dividend rato is to be maintained, Ten nosseo Coal lellccted a favoiablo lepoit of earnings. The settlement or the fielght handleis' stiike In Chicago was u favorable influence, especially upon the Chicago teiminul tiansfer stocks. We aie expecting 11 still fur ther reduction and aie prepared for it. The pioperties of the George A, Treadwell Mining Co, arc situated on the Verde Copper Dolt, In Yavapai County, Aiizonn, just south of and on the same belt with the piop erties of the United Yerde Copper Company. It has been proven recently by sworn testimony in open court that copper was actually produced on the Verde Copper Belt at thiee and a half cents a pound. The GEORGE A. TREADWELL COMPANY has the largest and best holdings of any company operating on the Belt. In fact, it has pretty much all there is of value on the Belt except the property of the United Verde Com pany. It will produce copper as cheap as if not cheaper than any other com pany operating in that distiict, and much cheaper than it can bo pioduced anywhere else. The gold and silver values In the ore aie ALWAYS sufficient to materially 1 educe the cost of the copper, nnd SOMETIMES enough to bilng the cost of the copper dovv n to nothing. We are entirely satisfied with ten cent copper, and at that price can pio duce it at a handsome profit and pay generous dividends. Can any other company In the field except the United Verde do as much? Our capitalization is three mil lions and the par value of the stock $10 a share. A limited amount of the stock is for sale at $11 a share up to July 20th, and on and after that date nt $12.50 a share. Make checks payable to tho order of the GEO. A.
