Peter C. Hccrs, who owns 150 ncrcR of land In Jefferson township, yesterday, through Attorney C. Gomcgys, filed papers In un equity suit against C. E. Woodruff, Edwurd Foster and Emory Woodruff. Beers has owned the land for forty years. In 1849 the Pennsyl vania Coal company obtained a right or way over the- land for Its gravity road and subsequently built the road, using coal and culm for the roadbed. When the gravity road .was aban doned, Beers had several claims against the company and to satisfy them, and avoid litigation Heels stales that the Pennsylvania Coal company granted to him all of the coal and culm on their right of wny across hi.i land. Ho has since continued to avail him self of, this convenient supply of fuel, but on June 20, he alleges, the defend ants tore down his fences, entered upon Ills land and began to cairy away the coal and culm. Judge Kelly, to whom the papers In Hie case were presented, granted a rule to show cause why an Injunction should not be granted and made It returnable next Saturday. ' Land Sold for Taxes. In the grand juiy room yesterday morning1 the trcasmcr's sale of seated and1 unseated lands, on which taxes have not been paid, ,was conducted by Deputy Treasuiers David Jones and George Long. Clerk Fred Francis rep resented the commissioners. Tlieic wetc about 800 pieces of prop erty sold and most of them weie pur chased by the county commissions s to secure the taxes. Orphans' Court Matters. Judge A. A. Vosburg yesterday hand ed down an opinion In the estate of Matilda Swingle, deceased. In whicU application was made for. the removal of the executors. It Is stated In the opinion that as the matters set forth by the executors as a defence against this proceeding have already been passed upon adversely to their conten tions, they are now res adjudicate, and cannot be 'again considered. It Is held that under the decision already made, as well as the status of the record, the executors are subject to removal under the provisions of the acts of 1832 and 1861. It is ordered and decreed that the letters testament.uy be vacated, and that the register issue new letters to a suitable person, who Is requiied to give a bond In the sum of live thousand dol lars. Judge Vosburg also handed down a report as auditing judge in the estate of Frances A. French, deceased. The fund of about $2,800 is awarded to Samuel E. Pennsylvania c? to be sent out early this morning, Col lector Penman had his office open at midnight. The first man to receive the new beer stamps was an agent of the Honesdale brewery. Just at the stroke of twelve, Collector Penman handed him a $600, roll of the different denominations, and without delay he was out of the office and into a waiting carriage to drive over the hills to Honesdale. The new stamps reduce the tax on beer from $1.60 to $1 a barrel, and tho tax on tobacco from 9 6-10 cents to 6 cents a pound, The war tax on brokers and pawn brokers ceased yesterday. CONTRACT FOR FIRE HOSE Orders Placed with the Fabric Hose Company and the Eureka Hose Company. Director of Public Safety F. L. Wormser yesterday afternoon awarded the contracts for $4,000 worth of hose for the city's fire department. Recently $5,000 was appropriated by councils for this purpoosc. Two thousand feet of hose at $1 per foot was ordered from the Eureka Hose company, of New York, and the same amount at tho same price from the Fabric Hose company. The contract for the remaining $1,000 worth of heso will bo awarded this morning, and Director Wormser last night remarked to a. Tribune man that a portion of this will go to one of the companies represented by C. M. Florey, of this city. The bids of the Eureka and Fabric companies were as follows: Eureka company "Best" brand, $1 per foot; "Paragon" brand, 00 cents per foot. Fabric File Hose company "Unique" brand, $1 per foot; "Keystone" brand, 90 cents per foot. Five hundred feet of hose were pur chased from each of these companies last year. Bids were opened during the after noon at the municipal building for hose. Representatives of several local and out of city companies were present, and were in conference the greater part of the ufternoon with the city author ities. The bids were opened in Recorder William Conuell's office, lnthe presence of the latter, Director of Public Safety F. ti, Wormser, Superintendent H. F. Ferber of the bureau of Are, City Solic itor George M. Watson, recorder's sec retary, M. K. Edgar, and the represen tatives of the rubber companies. The latter were all abundantly supplied with samples of their wares, and their ex planations of the relative merits of their hose consumed the greater pait of the afternoon.
