The Soldier Man Caves When He

The bluff which "Corporal" William
Clark, the pseudo-soldier, hungr out
when arrested on Thursday, was swept
aside yesterday, when A. AV. Bowman,

Chief MeAndrew, to whom alone
Clark's apprehension and arrest are

A Splendid Christmas Tree.
J. S. Hughes, manager of the Carbon
dale Telephone company, has a splen
did Christmas tree display at his homo
on Belmont street that is the delight
of the children of his own family anil
those of tho neighborhood, while even
the older folks who have seen Its boiuf
tles become childishly enthusiastic.
There 'Is a big Christmas tree, laden
with gifts and brilliantly Illuminated
with myriads of incandescent globes.
On the floor beside the tree, and a nni-t
of the display, Is a busy landscape, a
vuiage, with its row or Houses, a beau
tiful castle along the highway, speed
ing trolley cars and a lake with a
steamboat, a yacht and a naptha
launch plying over the surface. All of
tho houses, tho castle and a busy
blacksmith shop at the foot of tho vil
lage hill are Illuminated, giving a most
realistic appearance to tho scene. Tho
trolley cars are operated by electric
power and speed through tho village,
meeting and passing-each other at two
switches. Hovering over the scene Is
the angel of peace. In one lmnd n dm-
Incandescent lamp, in the other ii
iriiiupsi. tho display is ingenious and
artistic, and is highly creditable to
Mr. Hughes, who conceived and com
pleted It.

JEnVlYN AND MAYFIELD.
The regular meeting ot the borough
ot Jermyn council was held last even
ing and was attended by a large num
ber of citizens, tho Interest being cen
tered In the electric light contract,
which It was expected would be award
ed. It will he remembered that at tho
lust meeting bids were received from
several coinnanks, the lowest being
from the Jermyn Electric- Light com
pany, which offered to light tho bor
ough on a five-year contract for $70 per
light per year. A private Individual,
Frank Hemelrlght, a citizen of tho
borough, also had n bid In, which wns
lower than any, offering to supply
lights for $Gn.3G per light per year. A
question arose as to the legality ot the
council entering Into u contract with u
private Individual, and tho matter was
laid over to obtain legal advice on tho
matter. Following Is the reply of Bor
ough Solicitor Mulhollnnd, which Sec
retary Jones rend:
"In regard to tho right of tho bor
ough to cease taking light from tho
Jermyn Electric Light, Heat and Power
company, or an Individual, to furnish
tho borough with light, I have given
tho matter a very thorough investiga
tion, and I believe I .have seen all the
authorities In the state on tho ques
tion. "The question of the right of the
borough to cease taking light ot the
old company at the discretion of tho
borough officers is an unsettled ques
tion. There .are two decisions of the
Supremo court, and one of the com
monwealth, which hold In a general
way that electric light companies have
no exclusive right to furnish light to a
borough or a city the same as water
companies have to furnish water.
These three cases lean strongly In
favor of the right of tho borough to
let Its contract to any company it
chooses.
"These Is another case, a case in
which ono of the judges of the west
ern counties of the slate, which holds
that the borough or city cannot cease
at its pleasure taking light from airold
company which has been furnishing a.
borough or city with light, and enter
Into a, contract with a new company.
This last decision puts the right of
electric light companies on the same
level as water cntnuaules. It Is, how
ever, a decision of a lower court and,
of course, may be appealed from and
revised by the Supreme court.
"As far as giving the contract to an
individual Is concerned, tho trouble
with that would be that the individual
would not have the right to use tho
streets for tho purpose of erecting
poles and stringing wires without get
ting u franchise front tho state to do
so. To get a right to use tho streets,
authority from the state, as well as
from the borough, is necessary.
"The weight of authority so far ren
dered in the state would seem to be In
favor of the right of tho borough to let
Its light contract to any company it
chooses, provided the company has a
franchise to light the borough."
As the letter did not properly solve
the matter according to Councilman T,
K. Moon's Idea, he moved the matter
be laid over again until such time as
council obtain fuller Information on
thu question.
A number of bills were read and or
dered paid, among them one for the
payment of the Jeansvllle pump at the

pany's attorney agreed to throw oft the
Interest, reducing tho bill to $ISt.8S.
