Annie AVuiro, aged 10 j ears, was tried
on a chat rp of aggravated assault and
battery, prefened by Mary Konier,
aged 3 years. Both child en live in Oly
phant, and the prosecution sought to
phow that the AVargo child had tinned
the other Kirl uround suddenly, caus
ing her to tall and bleak her arm. The
defense was that tin' child had bioken
her arm by falling liom a pile of tiea
on which she was playing. Judge lid
wards diiected that a verdict of not
guilty be taken, and said that the par
puts should be ashamed of themselves
for bringing such little ehlldien 'into
court.

A verdict of not guilty was taken in
the ease of Fiank Degnall, charged
with the larceny of tools by Charles
3. each, the latter not desiiins to push
the ease.
Arerdicts of not guilty were taken In
the eases of Frank Zesuta and Valeck
Zesuta, charged with laicenv and to
rching by S. J. Feldman. The latter
failed to appear, and the costs were
placed on him.
A verdict of not guilty was taken in
the case of Nasta Soblt, charged with
being a common scold bv Annie Iie
jnis, the two women having come to an
agreement.
A verdict of not guilty was taken in
the case of George D. Kdder, charged
vlth embezzlement bv ,T. II, Uloomer,
the prosecutor not desiring to press the
charge,
A verdict of not guilty was nlso taken
In the case of Vencel Marvel, charged
with assault nnd battery by his wife,
Jane Marvel, The couplu have patched
up their diflleulties and ate now living
together,
Mrs. Margaret Jenkins was tried on
the charge of assaulting her mother-in-law,
Mrs. Sarah Jenkins. Ilotli par
ties live in Ulakely in two houses on
the same lot, and the alleged assault
grew out of a quarrel caused by Jen
kins leaving his wife and going to live
with Ills mother, MrH. Sarah Jenkins
claimed that she went to see her
duughter-in-Iaw and that the latter
knocked her down stalls with a broom,
Mrs, Margaret Jenkins claims thut her
mother-in-law slipped and foil down
stalls. The Jury was out when court
adjourned.

Mr. nnd Mrs. Joseph Dickson, charged
with assault nnd battery by Mrs, Mar
garet McMnhon, and Mr. nnd Mrs. liur
ney McMnhon, charged with assault
nnd battery by Mr. and Mis. Joseph
Dickson, were all tried together before
Judge Kelly. The evidence adduced
would tend to show that all the parties
concerned weio Intoxicated, and that
the nffalr was a sort of general tight,

journed, Charles Pllger, charged with assault
nnd battery, Adolph Doodafsky, prose
cutor; John AVarlner, pointing pistol,
Adolph Doodafsky, prosecutor; Annie
Btamner, assault una battery, Adolph
Doodafsky, prosecutor, were all tiled
together yesterday before Judge, lid
wards. The events that occasioned nil
of these suits occurred in I'etershuig
last summer nnd was an outgiowth of
the ear builders' strike. The Jury was
out at adjourning hour.
Ejectment Suit
Attorneys O'Brien nnd Martin yes
terday began an action In ejectment
for John Gallagher et ul,, against Pat
rick Boland ot al., to recover a piece
of land on Railroad avenue, 37 2-10 feet
Wide by 280 feet deep.
The plaintiffs allego that the prop
erty held by the defendants belongs to
the plaintiff.
Mrs, Pethrick Seeks Divorce.
Mrs. Nina Pethrick yesteidny Insti
tuted proceedings in divorce against
her husband William Pethrick, allege
lug cruelty and intolerable treatment.
They live In "West Scranton. nnd who
married on March 23, 1001, and lived
together until May 10, 1901.
Mrs. rothrlck some time ago tiled n
petition asking for a divorce, but later
withdrew It and loturncd to her hus
band, but had to leave him again on
account of his ciuelty. She Is repie
sentcd by Attorney V. iZ. Boyle.
Widenor Divorce Case.
Testimony was taken befoie Judge
Edwards yestciday in the divoice case
of Mrs. Hose AVidenor against her hus
band, Albert AVidenor, whom she sep
arated from in August, 1301. They
reside in Gieeu Uidge and weio nmi
lied in lS9tt.
Mrs. AVidenor alleges cruelty, and Is
corroborated by her inother.Mri. Buck
ingham. AVidenor has offeied mi tip
position to the petition.
