upon tin: scene with an assignment of
the claim against the Taylor people.
Do Lourent & Company alleges that
Do Vllleneuve and Hoelchl are silent
partners and that the assignment was
not llxed up until they heard of the
writ of uttachmeiit uf De Lourunt it
Company. The case will be given to
the Jury this morning. The plaintiff
was represented by Attorneys H. A.
Kunpp and U. P. O'Malley and the de
fendants by Attorneys O. T. Kirby, of
New Yorlc, and J. 13. Burr and T. P.
AVells.
Utifns J. Foster, one of the jurors In
the case, received a telegram from
llurrihurg, summoning him to that
place at once. The attorneys agreed
to hae the case go on before eleven
jurors and Judge Kelly excused Mr.
Foster.

a verdict in favor of the defendant was
directed In the case of Annie L. Newell
against John f. Roc. No appearance
being made for the plaintiff in the case
of 1 Fruchan, manager, against Sta
ples & Klcth, a non suit was allowed
by the court,
Repp Takes an Appeal.
"William Repp, as a. citizen and tax
payer of Old Forge borough, took an
appeal yesterday from the action of
the borough auditors In settling the ac
count of John Surber, treasurer of the
borough.
Mr. llepp says that the auditors had
no right to allow the following claims,
and that the treasurer should bo sur
chaiged with them:

Hearing in Divorce Case.
There was a hearing befoie Judge J.
"W. Carpenter In chambers yesterday
in the divorce case of Mi. Olive S.
Knickerbocker against Peter II.
Knickerbocker. Mis, Knickerbocker
was a native of Benton, but after her
marriage in 1873 went with her hus
band to reside at Mill Heft, Pike coun
ty. Her testimony yesterday was to the
effect thai her husband was In the
habit of drinking to excess at times
and on these occasions he treated her
lu a most bitual manner and called
her vile names. Ills treatment be
came so intoleiable that she was
compelled to leave him last December
and she is again a resident of Benton.
The Knickerbockers have four daugh
ters, three of whom are married. The
llbellanl was represented at the hear
ing yesterday by Attorney IS, C. New
comb. Carbondale Water Case.

Secretary Schauta Gives Notice of
Two That Are Approaching.
There will be n competitive examin
ation conducted by the civil service
board, at the Federal building, Novem
ber 20, of applicants for clerk and car
rier positions.

STEVENS UNDER ARREST.
He Is Charged with Fraud by Mrs,
Lucy T. Keller.
Slatiloy J, Htevens, special agent for
the state dairy food commission, was
arraigned before Alderman Myron
Kasson yesterday on the charge of
fraud, preferred by Mis. Lucy T. Kel
ler, of 701 Quliicy avenue, lie waived
u hearing and entered ball for court.
Stevens Is charged with supplying a
bogus tenant so that ho might vacate
a house at 701 Qulncy avenue. He
wanted to move out, but Mrs. Keller
refused to release him, lies having
signed a leno for a year. However,
alio agreed to lot him go, providing he
supplied another tenant. Straightway
Stevens went forth and relumed with
a man whom ho Introduced as C. P.
Davison, of Reading, Pa.
Davison made a cursory examination
and decided at once to take the house.
The landlady Insisted that he sign the
same lease Stevens had. Slovens ob
jected strenuously to this as did also
the alleged Davison. Finally Mrs.
Keller gave ln and Davison bound the
bargain by handing Mrs. Keller $5.
This happened Friday afternoon,
August 50. Saturday morning, Au
gust 31, Stevens had moved away to
a house ln Green Ridge. That after
noon the alleged Davison telephones
Mrs. Keller that his goods were at
tached nt Reading for three months
nrrcars In the rent, and that he could
not take the house. Subsequent Inves
tigation revealed that no man by the
name of C. P. Davison has lived in
Reading for years,
After a three daye' chase Constable
Max Flrestlno succeeded In arresting
Stevens on a warrant issued by Al
derman Kasson. He gavn ball last
Saturday for a hearing at half-past
four Tuesday afternoon.
Stevens is a native of Clark's Green
and beside his work for the dairy and
food commission he conducts a horse
buying and selling: business.
WANTED TO GO HOME.
Pathetic Plea of a Hazleton Girl Who
Fell Into the Hands of the
Police Monday Night.
A scene was presented In the Centre
street police station Monday night that
so moved the big policemen that they
got out In the street with their heads
bowed to hide the tears that dimmed
their eyes. Even big "Captain Dick"
Edwards, who has seen sorrow in all
Its guises, was noticed wiping the cor
ners of his eyes.
Agglo Cannon, a 17-year-old girl,
had been arrested in company with a
couple of drunken men for raising a
disturbance in a Providence street car.
As she was brought into the station
house by Patrolmen Quitman and Hag
gerly everyone noticed that she was
not one of tlue ordinary kind of women
who find their way to tho station house.
"Drunk and disorderly, raising a rac
ket in a Providence car," said Patrol
man Haggorty perfunctorily as he
placed her in a cell and clanged the
iron door.
As the iron door closed on her she
burst forth into an uncontrollable and
wild Hood of tears. She sat on the edge
of the wooden bunk, her black hair
falling over her face and her body
.shaking convulsively.
"What's the matter, little girl'."' ask
ed Captain Dick gently.
"I'm thinking of my poor mother In
Hasileton, and of my brothers and sis
ters," replied the sobbing prisoner as
she made an effort to control hersf-lf.
"Why didn't f take mother's advice.
Oh, my God, why didn't 1? She said
she'd forgive mo if 1 tried to reform,
but I went down, down. "Why didn't I
stay tit homo?
"I've only been out of jail since
morning. I was charged with larceny
but the grand jury ignored the bill and
they let me out today. I had no place
to go. Nothing to do and the wife of
one of these men promised to get ine
money. I met her in the jail. I went
with her and her husband and they
got mo to drink beer. .
"For God's sake don't let them s-eiul
mo to the jail again. I've been there
for three months and if I ever go again
I'll go to the bad forever. I want to
go home, homo to my mother in Huxlc
ton. Mother is good. She'll forgive
mo -1 know she will, and I'll promise
to do as she says. Oh, if you knew
how patient she's been, and father, too.
His heart is broken by my actions.
He's written me to coino home and
says he'll not say anything and I'll go
home If they'll let me and give up this
life," and Aggie sank back on the rough
boards and sobbed bitterly. "I'll come
home to you, mother, if they'll let me,"
she kept repeating between her sobs.
"I'll come home your girl will come
back."'

terday morning, she stated her case
