Judge Archbnld yestoiday rendered a
lengthy opinion discharging the rule
to take off tho compulsory non-suit
giantod at the fall term of common
pleas.
The plaintiff wag awlgnec of his
brother, who In 1S9B opened a store In
the Kennedy & Carter building, tinder
a five years lease. After a ftw months
ho nrslgncd and when tho assignee
had closed out the business the stora
was vacated. The landlords enteied
n claim for the full live years' rent
tinder the terms of the leaso and tho
auditor who was appointed to dis
tribute the funds arising out of tho
sale of tho estate allowed the claim.
Tho building was shortly aflct wards
leased by the landlords to Hill & Con
nell. Then Hull citno l:i with a claim
for the rental which Hill ft Connell
was paying, and upon being refused
attempted to enforce Its collation by
a suit in ejectment. When the case
came to trial Judge Atchbild granted
a motion for a rompulsoiy non-suit
and now, after having heatd argu
ments at length on tin law in the cas?,
