Preparations are being made to erect a ventilating fan on the ton of East Mahanoy tunnel, east of Mnhanoy City, and the plans are being rn.ide In the local p. & R, C. & I. Co.'s engineer office. H men have come within nn ace of losing their lives there by icason of the noxious gases that ac cumulate fiom the exhaust of the en gines. The ventilating itpnnintus will be of the most modern constitution and will entltely remove the cause of complaint. New Station for Lebanon. The Philadelphia and Heading rail way Intends to make a number of ex tensive Impiovements along its lino. Plans are no'w being made for a laigo and beautiful station to be erected at Lebanon on the Lebanon Valley blanch. The business at this point has Inci eased so greatly that the pies ent station, which Is not only Inade quate, but ancient, does not meet with the lequlicments, nnd the company Is hampeied by not having enough faclll to handle the business there. There were no payments made yes terday by the Delaware, Lackawanna and Western or Delaware and Hudson companies. The sanitary conditions mound tho Delaware, Lackswannn nnd Western station are being Impioved with tho latest devices, Master Car Builder Canfleld of tho Lackawanna Railroad, will start to work soon to fit up 100 cars for con struction purposes. Of this number fifty will be fixed at the Scranton shops and tho other fifty at Dover, N. A Unique Statement Filed by At torney I. H. Burns. Thomas C. Melvln, proprietor of the St. Charles hotel of Penn avenue, se lect councilman of the Eighth ward, and father of the water rnte ordin ance now before councils, was yester day made the defendant by the Scran ton Gas nnd Water company in nn action In assumpsit brought bef no Al dermnn Howe to recover certain water rents. Tho statement In tho case prepared by I. H. Burns, attorney for the compnny, Is nn unique document. It sets forth the plaintiff's cauo of action In the following language: Plaintiff Is a corporation engnged In furnishing water to the citizens of the city of Scranton, and among others to one Thomas C. Melvln, proprietor of the St Charles hotel. On tho service pipes leading from the street mains to the hotel Is p. meter designed to show the quantity of water used each month by the defendant. On the first of No vember, 1S99, the meter showed a regis ter of 15,800 cubic feet. Indicating 7 gallons per foot. On tho first of De cember, 1891, In the usual course of events, the llgures on the meter should have shown a larger number according to the amount of water used by the hotel. A PECULIAR METER. Such, however, was not the cuse. The figures on the meter registered Decem ber 1. 1S99, were 8,787, showing that not only had the plaintiff company not fur nished any water to the hotel, but that It had actually received from the hotel 7,013 cubic feet of water, being equal to fi.G97 gallons. This can only be ex plained In one of two ways: cither there has been pumped Into the com pany's mains from tho hotel f.2,597 gal lons of water or the defendant or his agents or employes beve during the month of November unscrewed the meter and reveised It so that the water going through the pipes would register backward Instead of forward on the meter. The result ns shown by the meter Is that for the month of November, the comoanv owes Mr Melvln the sum of $10 52 Plaintiff Is aware that there Is pending in councils an ordinance to re duce water ratio, but did not suppose that It went so far as to reverse them nnd compel the company to pay cash to consumers for tho privilege of fur nishing them with water, even though they might be city officials. On tho other hand, If it be a fact that C2.597 gallons of water have been pumped fiom the St Charles hotel Into tho company's mains the plaintiff de slies to be Infoimed of the quality of tho water, source of supply and charges for the same. At present the plaintiff Is unable to say whether she owes Mr. Melvln or Mr. Melvln owes the com pany. Wheiefore she brings this suit to ascertain whether nlalntlff Is fur nishing water to the defendant or de fendant to plaintiff. HEARING FRIDAY. The hearing In the case has been set down for Fiiday of this week be tween 9 and 10 o'clock In the morn ing. Mr. Melvln when seen yesterday re garding the mntter said he knew ab solutely nothing about the vneter's al leged pranks and that he had only seen it cue e. He stated that tho Idea of holding him lesponslble for It was absurd nnd that he would be on hand Friday morning with his tttoineys, O'Brien and Kelly, to defend himself.
