Wondnridge Is chat god with having
violated the five-year-old daughter ot
Sir. and Mis. John Sheildan, of Six
teenth street, on IVbruary 20 last. Mrs
Sheridan and Mrs. Woodbridge are sis
ters and the two families lived a shoit
distance ftom one another In West
Pcj anion. The little girl went on the
stand yesterday, but her testimony
with reference to the assault was not
veiy elear and when the commonwealth
rebted the defense asked the court to
take from the consideration of the Jury
all of the counts with the exception of
simple assault. This the court refused
to do.
NO EVIDENCE FOU DEFENSE.
The defence decided not to offer any
evidence and asked the court for per
mission to address the jury last which
was granted. Dlstilct Attorney Jones
closed his aigument just before the ad
journing hour. Woodbridge is defended
by Attorneys fieoige 13eale and L. P.
Wedeman. The latter will make the
closing address for the defendant this
morning. The accused has been in jail
since tlie cilme was committed.
Thomas O'Mall.i, Putiick Padden,
Patiick .Mahon and William Kelly were
called for tiial before Judge Weand In
No. '1 on . charge of breaking into
.UeAndreu's hotel in North Scranton.
Padden. who appears to have been the
ringleader of the gang, has left the
city and his ball was forfeited after the
care was called yesteiday. The ac
cused were defended by Attorney Jos
eph O'Brien. They denied participating
In the buiglary. Padden Invited them
to go to the hotel with him, telling
them he had a "cinch." When they
found that Padden meant to bieak Into
the place they left him and went to
their hemes The jury retained the
boys, with the exception of Padden, not
guilty.
Thomas Coyne pleaded guilty to
breaking a window in the hotel of Jobn
J. Coyne at Mlnooka and wn sentenced
to pay a fine of $1 and spnd thirty
da5s In the county jail.
BROTHER AGAINST BROTHER,
A erdict ot not guilty was taken in
the case of Andrew Horwarth, who
was charged with assault and battery
by his brother, Stephen Horwaith. The
latter did not desire to prosecute.
When court adjourned Edward Kll
l.iii. a sixteen-year-old boy, was on
trial, charged with the larceny of $77
fiom J. C. Ludland. Ho is defended by
Attorney John J. Murphy and Assistant

Company About to Shut Off Water.
Mrs. Maigaiet Smith, through her
husband and Attorney Cornelius Smith,
jveterday began an equity suit against
the Scianton Gas and Water company
to restrain It from cutting off the water
supply and removing the pipes which
supply the buildings at 421, 001 and 703
Adams, 7J7 Jefferson and 430 Monroe?
avenues which nre owned by Mrs.
Smith.
The petition which she flies sets foith
tint the company is about to shut the
water off from these buildings although
she lias not leceivert a bill from the
company and has no knowledge that
she is indebted to it. Judge Gunster
gi anted a preliminary injunction to
restiain the company from taking tlie
action complained of and made the
rule to show cause why it should not

day. In the case of Michael Ruddy and
John J. Ruddy against the city of
Scranton, exceptions to report of

J. M. Walker, M. S. Knight and E.
B. Jermyn were yesterday appointed
viewers of two proposed roads in Scott
township.
The teport of the viewers in the
matter of a road In Ransom township
was confirmed nisi yesterday. Tho
width of the road Is fixed at fifty feet.
In tho case of tho commonwealth
against Joseph Kllpatrlck, which is on
the trial list for this week, court yes
terday refused to quash the Indict
ment. Abe Seidman, who served during the
lato unpleasantness as a member of
Company C, Thirteenth regiment, was
granted a veterans' peddlers' license
jesterday.
The will of Norman Wheeler, of thin
city, was probated yesterday and let
ters granted to Eleanor and Adam
Wheeler. Tho estate is left to his wife
and tluee children.
The bond of John J. McAndrew,
treasurer ot Wlnton borough, was flled
with Prothonotary Copeland yesterday.
His bondsmen are Thomas E. Redding
ton, John J, Sweeney, James J. Eawler
and Michael McAndrew, all of Wlnton.
The trespass case of D. F. Mott, of
Nicholson, against Michael and Sarah
McGlnley, of Dunmore, was heard be
fore Arbitrators C. B. Gardner, F. F.
GIbbs and R. J. Bourko In tho arbitra
tion room yesterday. Molt occupied
a house at Dunmore owned by the de
fendants anJ one day while ho was
away from home It Is alleged that they
removed his furnlturo from the house.
A considerable portion of the furniture
was carried away by persons unknown
to Mott and other articles were broken
and destioyed. Ho wants compensa
tion for his loss. There will be another
hearing in tho case on July S.
Mayor Will Appoint Him Street Com
missioner. At the regular meeting ot select coun
cil one week from Thursday night tho
name of Richard Thomas, of tho
Fourth ward, will bo sent In bv Mayor
Molr as successor to P, J. O'Boyle as
street commissioner.
Should Mr. Thomas fail to 1)3 con
firmed, Select Councilman Richard Wil
liams will ask the mayor to nominate
him. H. T. Fellows, of the Fifteenth
ward, Is also an applicant for the posi

Under an order Issued June 22, all ad
jutants and quartermasters of tlie Na
tional Guard arc raised to the rank of
captain. Adjutant D. B. Atherton and
Quartermaster Frank M. Vnndllng are
now entitled to tho cognomen ot "Cap."
Captain Fremont Stoken, of Com
pany D, who has been dangerously ill
for several weeks, underwent an oper
ation that was In every way success
ful and which the attending physicians
say will save his life.
Major W. S. Millar, Inspector of the
Third brigade, accompanied by Captain
D. B. Atherton, adjutant of tho Elev
enth regiment, Inspected the recently
reorganized Company G, ot the Thir
teenth regiment, N. G. P., at Montrose
last night.
