George Clnik, foreman In the steam heating nnd fitting department ot Hunt & Connell, was Indicted by the grand Jury at tho Instance of the Steam Fitters union, of tho city, under an act of assembly passed last June. His case was down for trial Thursday, but could not be 1 cached until yester dny. When It was culled by District Attorney Jones, Attorney John F. Scragg, representing Mr. Clark, made a motion to quash the Indictment and Hied icasons na follows: First-Because the net of assembly un der which tho Indictment is diavxn is un constitutional. Second -Because the Indictment charges six scparato and distinct ertenses. Third Because each count ot tho 'n dlctmcnt charges two scparato and dis tinct offenses. Fourth Because the Indictment Is bad for duplicity; and tho act ot assembly is meaningless, vuguo und charges no of fense. Fifth Because of general exceptions District Attorney Jones wanted the case tried nnd In tho event of a ver dict of conviction to have ludgment at rested pending Mr. Scrngg's motion, but Judge Archbald would not petmlt thnt nor would Mr. Scragg agree to It and the cout t granted a tulo to show cause vxhy tho Indictment should not be quashed and made It retut liable for ar gument on Friday, May C, before the three Judges. It has been widely discussed in labor Journals and trades union circles. Tho Pennsylvania legislature last June passed an act ot assembly In de ference to the wishes and arguments of tho trades unions, making It a mis demeanor punishable by fine or Im prisonment, either or both, for any foreman, agent, manager, or any oth er pet son In nuthority. of any corpqra tion chartered, to discharge, or Uneat en to discharge, or to coeice, any em ploye of such corporation for being a member of, or applying for member Mi.p in, any labor organization. It was alleged by the Steam Fitters union of Scranton that Mr. Clark dis charged Lewis A. Mack. Edwin M. Longyear. Fred Guest, Edward Wat son, E. J. Il.1dlK.1n nnd Charles F. Cleary, because they helonged to the union. I'pon this allegation and Infor mation tho prosecution was founded. Attorney John J. Muiphy represented the union. FIRST ACTION OF THE KIND. Tills was the first action of Its kind In this state and probably In the Uni ted States. On that account the local union was anxious to make a test case. Mr. Scragg is confident that ho will he victorious In proving the unconstitu tionality of the act. He said It was special legislation nnd included only charteied corporations.
