At last night's adjourned meeting of
common council the new 1S98 appro
priation ordinance passed third and
final lending lu that binnch. On
Thursday evening the measure will go
to select council for concurrence.
The old tax levy ordlnnnce, a mens
uie companion to tho appropriations
and providing a revenue of $291,000,
was presented and referred for print
ing. It Is the select council's 1S9" levy
with a now tecoid number nnd It desig
nated as a common instead of u select
council ordinance. Its passage will fol
low eloiely that of the appropriations.
Mr. Keller Introduced two plumbing
measures. One was n supplement to
the ordinance now In force creating the
olllce of plumbing Inspector, the other
provides for the payment of his salary.
Knell was tcferred to committee for
printing. The cieutive ordinance makes
tin-xillice splf-suppoitlng. It provides
for the pajnient of the following
lets for tests and examinations of
plumbing plans: f 1 for a water und
smoke test on a Job under $100;
2.". cents for each additional $100
up to $1,000; for contract price of
$l.ouo oi ovi'i, a fee of HO cents addi
tional per $100 shall be charged; for all
rtpalr Jobs over $23 tho fee shall lie 25
cents.

n sldeut plumbers at $10 each annually,

after passing an examination, the fee

The building Inspector, plumbing In
spector und one member of the board
of health shall constitute the board for
examining the Journeymen plumbeis
and shall hold such examinations twice
a year. The oidlnance providing for
the payment of the plumbing Inspec
tor's salary is for "the balance of the
liscal year lbS."
A resolution providing for the elec
tion of a new board of tux revision anil
appeal was Introduced by Mr. Jncltson.
It directs the city clerk to call a spec
ial meeting for that purpose on Mon
day evening, Ma 2, at 7.30 o'clock.
Now ordinances and resolutions were

the purchase of a combination chemical
and hose wagon for Hellef Hose company
and appropriating funds therefor.
Mr. Grllllths Directing the city clerk
to advertise for proposals to do the city's
printing of advertisements and ordi
nances dining the fiscal year of 1S9S.
Mr. Sheridan Directing the city engi
neer to establish a grade for gutters on
Meridian street lu the Fifth ward.
Mr. Oliver Providing for the Introduc
tion of ordinances and resolutions in the
Sixth order of business according to tho
secpiunee of the wards.
All the resolutions were ndopted.

Unusual Allegation fn the Reasons (or a
New Trial Filed In (lie Case
Against 0. L. Wallz.
Herauo they believe and stand ready
to prove that theie was a "ringer" on
the jury, the defeated plaintiffs In the
case of Megai-gcl & Council against O.
h. Wultz, petitioned court yesterday,
through their attorneys, Watson. Diehl
. Kemmerer, for a rule to show cause
why n new trinl should not be granted.
The case was tried at tho March term
of common pleas. The plaintiffs sued
to recover for $230 woi Hi of groceries.
Tli defendant put in nn offset of $210
for a 1.500 pound shipment of butler, for
which, it was claimed, ctedit waa never
given. The plaintiffs said that they
certnii.ly gave credit for goods they re
ceived, nnd that It was Impossible un
der their svtom of conducting their
store for a large shipment like that to
be overlooked.

Among: those who were surprised nt
the verdict were the plaintiffs. They

This Juror served under the name of
Thomas D. Trubodj. car-sealer, Scran
ton When the Jury was debating the
butter question, it Is alleged, Trubody
voluntecied the Information that he
worked for Megargel & Connell at one
time and that he could assure his fel
lows of the Jury, from his own experi
ence that It was quite possible for a
shi;.ment of butter to be received at the
Hi,;c room without being duly credited
at the ofllce, Just as Waltz contended
had ncen done in his case
Upon learning this the paj' roll of the
til in was closelj- scrutinized, 'but no
Thon.as D. Trubody could be found.
Fu'-ther Investigation however revealed
the f ict that Trubody had worked for
th" firm fcome years ago under the
name of Thomas D. Jones and had
been "discharged for cause."
The Jurj', It is averred, was Influ
enced In arriving at its verdict more
by the prejudiced testimony of Juror
Ttubodj' than by the evidence at tho
tilnl and on the stiength of this, it is
contended, the cas-e should be retiled

by the plaintiffs as their former em

SCHOOL BOARD FINANCES.

The second meeting of tho finance
committee of the board of control was
held last night, when an elfort was
made to complete tho cutting of the
1893 estimated expenditures so they
would fall within the revenue. A total
of $l'J,Sli wan lopped off, a reduction of
$70,000, Including the paring done at last
Frldaj night's meeting of tho com
mittee. Tho following reductions wero made
last night: Fiom the High and Train
ing school estimate of $32,422, $1,815;
from the teachers' committee estimato
of $150,000, $15,000; from the supply
committee's estimate of $13,000. $3,000.
From the latter estimate $2,000 was
taken at the last meeting, a total re
duction of $5,000 on that item.
The committee is now within $3,919
of the estimated revenue of $381, 10G
which will clevelope from the H-mlll
levj-. On Friday evening the commit
tee will probably hold Its final meeting,
to make the required reduction of $3,919
and prepare its repoit for next Mon
day night's regular meeting of the
board.

Seven-year-old Johnnie Keennn.son of
Thomns Keenan, of Avoca, was struck
by a Jersey Central trnin yesterday
morning nnd probnbly fatally Injured.
He and another young brother were
playing about the Avoca station. A
Delaware and Hudson train, going
south, had Just pulled out as a north
bound Jersej- Central train was com
ing In on the farther track. The boy
ran across the track behind the Dela
ware and Hudson tinln and dashed
against the engine of the Jersey Cen
tral train.
The piston rod struck him on tho
head and fractured his skull. He was
taken to the Pittston hospital and wns
alive last night, but the physicians
have smnll hope3 of his recovery. A
sad feature of the case Is that the lad's
mother Is undergoing treatment at the
Danville asylum for nervous prostra
