SENTENC13I) TO DEATH.
Most Ufttiinrkabln Address by n Judgo
Known in Criinlnnl Annuls.
1m om the American Bar.
Judge Benedict, who was associate
Justlc.0 of the Supreme couri of New
Mexico for thirteen years, from 1853,
waB an original character In many
wayfl. One Joso Maria Martin had been
convicted In his court of murder under
a state of facts showing great brutal
ity and with no mitigating circum
stances, whereupon Judgo Benedict
sentenced him to death In tho follow
ing language;
"Jose Maria Martin, stand up. Jose
Maria Martin, you have been indicted,
tried and convicted by a Jury of your
countrymen of the crime of murder,
and the court Is now about to pass
upon you the dread sentence of the law.
As a usual thing, Jose Maria Mar
tin, It Is a painful duty for tho Judge
of a court of justice to pronounce upon
a human being tho sentence of death.
There Is something horrible about It,
and tho mind of the court naturally
ictolts from the performance of ouch
u duty. Happily, however, your case
Is relieved of all such unpleasant fea
tures, nnd the court takes positive de
light in flontencing you to death.
"You nre a young man, Jose Maria
Martin, apparently of good physical
ccnstttutlon and robust health. Or
dinarily you might have looked for
ward to many years of life, and the
court has no doubt you have, and have
expected to die at a green old ago: but
you nre about to bo cut off In conse
quence of your own act. Jose Maria
Martin, It Is now tho springtime; In a
ll'tle while tho gross will bo springing
up green In those beautiful valleys,
and upon those broad mesas and moun
tain sides flowers w il be blooming;
birds will be singing tholr sweet car
ols, and Nature will be putting on her
most gorgeous and most attractive
robes, and life will be pleasant, and
men will want to stay, but none of this
for you, Jose Maria .Martin; tho flow
ers will not bloom for you, Jose Maria
Martin: the birds will not carol for
you, Jose Maria Mnrtln. When these
things come to gladden the senses of
men you will bo occupying a space
about bIx by two beneath the sod, and
the 'green grass and those beautiful
flowers will bo growing above your
lowly head.
"The sentence of the court la that
you bo taken from this place to the
county Jail; that you be there kept
safely and securely confined In tho cus
tody of the sheriff until tho day ap
pointed" for your execution. Be very
careful, Mr. Sheriff, that he have no
cpportunlty to escape and that you
have hlra at tha appointed place and
ft the appointed time. That you be so
kept, Joso Maria Martin, until Mr.
Clerk, on what day of the month does
Friday about two weeks from this
tlmo come?' ('March 22, your honor')
very well, until Friday, the 22d day
ot March, when you will be taken by
the sheriff from your place of confine
ment to some safe and convenient spot
within tho county: this Is In your dis
cretion, Mr. Sheriff you are only con
fned to the limits of the county: and
thnt you be there hanged by the neck
until you are dead, and the court was
about to add, Joso Maria Martin, May
God have mercy on your soul, but the
court will not nssume the responsibil
ity of asking an All-Wise Providence
tn do that which a Jury of your peers
has refused to do. The Lord couldn't
have mercy on your soul. However, If
you belong to any religious organiza
tion, It might be well enough for you
to send for your priest, or your min
ister, and get from him well such
consolation as you can, but tho court
advises you to place no reliance upon
anything of that kind. Mr. Sheriff, re
move the prisoner."
It Is a pleasant sequel to this dread
ful sentence that Joso Maria Martin
escaped from jail and died peacefully
several years ago by falling out of a
wagon and breaking his neck.
