and the exact time of Its creation Is

place and function of the sheriff Is i
ensily determined He has been, for all

bailiwick. I'nder all the systems of
government which have recognized the
law as the supreme rule of action, It
has been found absolutely neeessaiy to

power to pieseive the peace, to quell
dlsordei and to suppress riot And this

largely a discretionary one In a time
of gieat emergency or in a cilsls of
unusual dnnger the limits under which

goods of any of the said inhabitants,

of men who are anxious to work, as
well as In laving a violent hand upon
the individual workmen and forcing
them by main strength to nbandon
their employment and unite in a strike.

the hilling of the deceased. The com
monwealth. In the absence of any pi oof
as to who llred the fatnl shot, asks for
the conviction of all the detendnnts on
the ground that the action of the sher
iff and posse was a cilmlnal action
that the original call for the posse
was unnecessaiy, or even Justifiable,
that the subsequent action and espec
ially the shooting on the 10th of Sep
tember, cannot be justified under the
evidence, nnd that therefore the act of
any member of the posse was the net
of all the members of it, for which,
each and every one Is responsible In
the contemplation of the law. This
raises another question of law upon
which we now piocctd to Insttuct you
And we say to you, that the law Is.

the deputies on that day. and which

named In the Indictment The events
of the week preceding the 'Oth uie so

that they cannot be considered nn en
tliely Independent and separate tians
nctlons, but must be regauled as con
stituting together ho history of the
case If the sheriff became satisfied
after a careful examination of thu sit
uation In and about Hazleton, that the
public peace was threatened, that the
people were terrorized, and there was
danger of ilot, If thu demolish atlons of
tho men engaged tn the strike were
allowed to pioceed, ho had the right,
as the chief olllcer of the county, to
summon u posse to assist him In the
preservation of older, and In the pre
vention of riot. For It cannot bo doubt
ed that the duty of a sheriff is to pre
vent the danger, as well as to suppress
a riot, which has become flagrant nnd
destructive. Leaving out of view all
the facts on this branch of the case
which nro controverted, and In refer
ence to which the witnesses differ, It Is
certainly true that both at West Haz
leton and at I,attlmer, the greut body
of tho strikers failed to obey the sher
iff when he ordered them to disperse,
and Insisted In pushing on Nor can It
bo doubted that the sheriff had tho
right, In tho exercise of tho discretion
vested In him by the law, to Issue the
order. And If It wns the right of the
phe riff to command the crowd to dis
perse, then It was the duty of the
crowd to obey his command The right
to give the order Implies the duty of
obedlenco to the oider, and disobedi
ence of It lu evidence of a riotous pur
