Metzgar against Actor HIehard Alans ll Id have been compromised, Metzgar Mill not prosecute In the criminal court nr.d the suit In common pleas will be withdrawn. Aletzgar was Mansfield's dresser and sued for alleged assault and battery. The overtures for set tlement came from Lawyer John O. Johnson on behalf of Mr. Mansfield. On Saturday he and Lawyer James II. Shakespeare had a conference and terms were agreed on. Mr. Johnson drew up a cheek for tho amount Metz gar thought would heal his wounds on the spot. Lawyer Shakespeare admit ted tonight that the case had been dropped. He said: "The matter is settled In a manner satisfactory to my client. The offer for a ftettlement came from tho other side." C. that they arc Il legal. ULTIMATUM TO POWERS. Must Find a Purchaser for Scranlon Franchise by Jan I or Local Mcu Will Gel II. The owners of the Scranton base balj club have formally and definitely noti fied P. T. Powers, president of the Eastern league, that unless ho finds a purchaser for the club before Jan. 1, the franchise will be retained In this city. At the recent meeting of the league In New York city the owners author ized President Powers to find a pur chaser, hut did not designate any time limit. Now that tho Scranton stock company promoters seem assured of success and although their purchase price would be only $2.r,00, consider ably Ie.s than the figure named to President Powers, the owners prefer selling out at home and selling quickly. According to The Tribune'' Informa tion, which may be relied upon as cor rect, the leaders of the stock company plan are ready to secure subscribers beginning Jan. 1, provided that the franchise Is not sold through President Powers at that time. Following Is the stock company arrangement: A hundred shares of stock arc to be sold at $50 each to secure a capital of $5,000. Of this sum $2.S00 Is to be paid for the franchise, players, etc., and this will leave an equal sum for a work ing capital with which to start tho season. Subscriptions will bo duo as follows: L'j per cent., Jan. 3; 23 per cent., Feb. 1: no per cent., Mnieh 1. There will be an executive committee of three who will assume nil the active and detailed work of management. This committee will bo the president and treasurer, vice-president and sec retary of the association. The president will have full control from the beginning to the end of the season. No passes will be Issued ex cept to each member of tho commit tee and to the newspapers. The ofll cers will be elected by ballot. It will be seen from the foregoing that the president, who is to be treas urer nlso, will be the responsible head of the association. On account of tho technical base ball knowledge required of one in that position, considerable thought has been given to who shall be chosen for that position. There is a common sentiment In favor of Thom as R. Flrooks of the present associa tion. He has not promised to ncoept tho office, Vut II Is Intimated that he will do so provided only his controlling hand Is needed. He will have little or no time to devoto to the active man ngement of the club, but C. S. Fowler, who would probably be elected secre tary, would bo wllllne;, with the vice president, to assume tho minor duties under Mr. Brooks' direction.
