The grand Jury, which made its nnal
return to court yesterday afternoon,
took occasion, anions other things, to
roundly denounce tho practice of mag
istrates in transmitting trivial casses
for tho purpose of getting costs. Tho
uncomfortable furnishings of tho grand
Jury loom and the necessity of a tele
phone In tho district attorney's olllco
lire once' more touched upon. Tho lu

uniform courtesy and his faithful at
tention to nil matters that rami! before
us. llo has disposed of nil the cases In
his olllco carefully and faithfully, giv
ing every prosecutor who appeared a
fair nnd Impartial hearing.
That we liavo visited the county jiill
and found this Institution to bo well
kept. Tho building and surroundings aro
neat and clean. Tho food furnished to
tho prlf-oners Is of good quality. Wo
make the following recommendations:
First Tlint a sewing machine, closet
and shelves bo provided for tho sewing
room In county Jail.
Second That a washing machine bo
placed In tho laundry.
Third That an Iron gate bo substituted
In placo of the wooden gate at tho main
entrance to tho Jail.
Fourth That waste baskets be placed
on tho third lloor of the court house.
Fifth That coat hooks bo placed in
water-closets In court house.
Wo endorse tho recommendation of tho
last grand Jury In regard to matting or
pome suitable covering being placed upon
tho lloor of tho grand Jury room. Cov
ering for lloor nnd new chairs In grand
Jury room aro imperative. The chairs
now In tho grand Jury room aro a great
torture to tho grand Jurors.
Wo denounce tho practice of many al
dermen and Justices of tho peaco
throughout tho county In sending many
trivial cases to court without any evl
denco to sustain them nnd done, ns wo
believe, merely to recover tho costs that
follow.
Wo wish especially to call tho atten
tion of tho county commissioners to tho
necessity of a telcphono being placed in
tho district attorney's ofllce. Several
grand Juries havo recommended the
same, but tho telephone has not been
provided. It often becomes necessary to
send out for witnesses a long dlstnnco
from tho co' t house, to telcphono to
pollco headquarters for officers to tes
tify In certain cases nnd sent out for
business men who cannot wait long for
their eases to bo heard by the grand
Jury. Wo recommend that a telcphono
bo placed In tho district attorney's of
Ilco without delay,

FIGHTING FOR HORSES.
Dr. W. A. McDowell and Merchant
William P. Joyce Parties to an
Interesting Suit.
Tho possession of two horses was
tho bono of contention In nn unusually
Interesting case tried before Judge
Archbald yesterday. Dr. W. A. Mc
Dowell, as plaintiff, and William P.
Joyce, defendant, were the parties.
Joyce Is a merchant on West Lacka
wanna avenue and the lessee of tho
two-story, double frame building in
whinh his store Is located. Last vcar
he sub-let one of his stores to F. C.
Holmes, v. ho conducted therein n com
mission business. On January 28 last
Joyce learned that Holmes vas about
to fall and thinking to fortify his bill
for rent had n;i execution Issued, with
Instructions to tho sheriff to proceed
with Its service the next morning.
In tho meantime .Tovco went to
Holmes and made a pressing demand
for the rent, lleltnes gave him no sat
isfaction and thereupon Joyce told him
of the execution. Holmes then ngrecd
to meet him at the Valley house nt 9
o'clock In tho morning and make a set
tlement. Tho settlement did not even
tuate so Deputy Sheriff J. D. Ferber
proceeded to attach Holmes' effects,
among them a team of horses, which
were kept in Swnrtz' livery, near his
store.
Arriving there he found that tho
horses had Wen removed durlnsr the
morning and was told that they had
ben purchased by Dr. McDowell nnd
delivered to him. Tho sheriff did not
succeed In getting the horses although
he sought out Dr. McDowell and tried
to secure possession of them. The
horses nro now on a farm somewhere
and Holmes is In New York Mate,
.loyce In the eyes of tho law Is the
owner of the team. Dr. McDowell Is
combatting this on an Interpleader, ar
guing that he bought tho team before
the execution wan Issued against them.
Tho whole case, Judge Archbald rul
ed, hinged on whether or not Dr. Mc
Dowell took actual possession of tho
team before fi.25 o'clock p. m. January

In the sheriff's office. Dr. McDowell
siys th'ftt ho went to Swartz' barn nfler
striking the bargain with Holmes nnd
taking tho horses by tho halters start
ed to lead them out. He chnnged his
mind however, and left them In tho
stable to be called for the next day.
This occurred before G.23 o'clock on the
afternoon In question, ho alleges, nnd
nrguej that it was in every way a
full and complete transfer of the prop
erty. Th'e case was given to tho jury nt ad
journing time. Ex-Judge Ward nnd J.
O. Lnusjo appeared for the plaintiff, and
Cawley & Shoan for the defendants.
Simon Hlncrfelt, the Penn avenue
merchant, sued before Judge Archbald
to recover $20.43 on a noto given by one
of his customers, John Black. The note
wns given for a grocery bill. It wns
agreed that $u should 1)0 paid each
month until the noto was liquidated.
Black paid nil but $3.43 and then sought
to rosutri" trading on credit. Itlnerfelt
agreed to this on condlton that he
might keep the note ns security for
future debt. Hlnerfelt claims that
Black has run up another bill to tho
amount of the note. Black denies this.
The Jury agreed with Black. C. II.

Attorney James H. Burnett made his
first nppearanco In th'e trial of a case

nought to recover wages from Livery
man James J. Neall3. Ho recovered
the full amount of his claim, $30.
In the case of Owen McDonough
against William J. McDoncugh, the
Jury yesterday morning brought In a
verdict of $27.43 for the plaintiff.
The Hartley-Hull ejectmf.nt case is
still on before Judge Searle.

ing Register of Wills Hopkins to make

of his ofllce. Tho order was brought
about by petition of members of tho bar,
who complained that tho present rystem
of Indexing Is incompleto and Inconven
ient. The county Is to pay tho cost of
tho work. It will requlro several months
to complete tho work.
Judge Archbald yesterday handed down
an opinion In tho case of tho Common
wealth against Martin Woyshner, dis
missing tho exceptions to tho report of
the nudltor, C. B. Gardner, and continu
ing tho report finally. Tho exceptions
