Weinss was there ut thn appointed
hour to face liis accuser. The hearing
developed the fact that McAndrew left
a pair of shoes to be repaired nt
W einss' shop and upon calling for
them yesterday morning found that
one of theni had been lost. Some kind
of n disagreement arose and both men
became very angry. When McAn
drew left the shop a boy who had been
listening to the dispute, told the cob
bler that he had seen .McAndrew take a
Half dollar out of the pocket of a coat
which u ii s banging in the shop,
Weinss hasleued after McAndrew.
overtook him. and according to the
weight of the evidence adduced, as
saulted him.
The .alderman held Weinss in $300
ball to answer ut court.
REAP TRESPASS SUIT.

The trespass suit of Michael Reap,
of West .Market street, against the city
of Scranton and Contractor Anthony
Kulghl for alleged dumages done to his
pioperty by the construction of a re
taining wall on his land when the cul
vert over Leggetts creek wan built in
lssS. was on trial all day before Judge
Ari'libald. The case was not finished at
adjournment and It will be resumed
this morning.
Mr. Reap went on 'the stand yester
day and testilleil that his property was
worth al.out $l.r.(io before the retaining
wall was put up, and since then -it has
not been worth more than $a00. Three
or four witnesses estimated that his
property was damaged from 700 to
ll.OoO by the retaining wall.
On the part of the city testimony was
given representing that Mr. Heap's
property, Instead of being damaged,
appreciated In value nbout StflO or $200.
Select Councilman Finley Ross, of the
First ward, was acquainted with the
premises before the wall was built. At
that time the fair market value of it.'
he thinks, was not more than $700, nnd
the construction of the culvert and the
retaining wall has enhanced its value
to about $;Vjo. How this is possible Mr.
Ross accounted for from the fact thut
the property is several foot below the.
level of the street, and before the wall
was built there was nothing' to gtop
surface water from flowing down cn
the premises.
Edward F. Rletviit, who was city en
gineer when the culvert was construct
ed, gave the measurerripnts of the wall
and estimated that It was built nbout
five feet in on Mr. Reap's lot.

was H. H. Kscotf, an ex-collector for

tary. When Special Officer Thomas Jor
dan, representing Alderman Millar's of
lice, arrived with a warrant charging
Kseott with fraudulently collecting
money In the company's name, '.vent to

hitn in the custody of a Dunmore of
ficer, who had urrest"d him on n war
rant sworn out by some putron of th
company in Throop, who. It seems, paid
some money to Kseott and afterwards
learned that he was no longer em
ployed by the company.
Kseott was taken to the county jail
and Alderman Millar caused notice to
be served on the sheriff that 'the pris
oner was wanted in the Kighth ward
when the Munmore parties had got
through with him.

senting that she was employed by the
Jersey Central Railroad company, had

I he the black sheep of a very excellent

Her brother, when notified of her ar
rest and incarceration, decided to al
low her to remain in the county Jail
for a time in the hope that she will
consent to go to the House of the Oood
Shepherd.
