It waa witnessed by i number of the guests at the Scranton house, and from their story of the af fair It was quite a serious conflict. The forces were about evenly divided and '.very man In the crowd was an active participant In the melee. It lasted for fifteen or twenty minutes, and there wus fast and furious lighting all the time. Tor the ratal Acoident of Mrs. Kaehel Griffiths, but the Verdict Does Not Warrant Hamilton's Arrest. Evidence upon the death of Mrs. Rachel Grlfllths, the West Side aged woman, who last Tuesday died from injuries sustained three duys earlier In being run down by a mall wagon on Lackawanna avenue, was heard by Coroner Longetreet and a jury Satur day night. The following verdict cen suring tho driver, James Hamilton, was found: "We find that the said Rachel Grif fiths came to her death from Injuries received by being knocked down by u mall wagon driven by James Hamilton. "We believe that the mall wagon was being driven at a careless and un necessary rate of speed and deprecate th fast driving prevalent In the city." The following witnesses were ex amined: Dr. Hlanclmrd, of the Lacka wanna, hospital: Edward Saxon, a mot- orrnun; W. H. Sunday, Fred Hawley, a conductor, Charles Hotzel. Dr. L. M. dates, Jumes Hamilton, the driver of tin- nui 11 wagon, anil F. A. Peters, grandson of the deceased. The evi dence as to the mail wagon speed and the; tinging of the bell was conflicting. Driver Hamilton Insisted that he was driving at a slow trot. On cross-examination by the coroner he admit ted having once run down's pedestrian in front of Callahan's saloon. Coroner Longstreet notified Chief of Police Simpson of the verdict, but did not request that Hamilton be placed under arrest. The coroner does not believe the verdict warrants such an extreme action, and Chief Simpson will not mako the arrest unless the cor oner requests it To a Tribune report er Coroner Longstreet said he would not make the request. Gunster and Ed wards came upon the bench and the closing season of license court was held. The only applications which passed safely the gauntlet of remon strance were those already licensed In the Thirteenth ward and one new ap plication, that of the Lackawanna Lag er Beer Brewing company, the plant of which Is In process of construction at the corner of Monsey avenue and Pop lar street In the same ward. Eighty-one licenses were refused. Of tnis number there were nineteen against which remonstrances were tiled; the other sixty-two were new houses for which tho court waa of opin ion there is no necessity. The appli cation of Mrs. Lena Deckelnlck was re fused, so was that of James Ferguson, of Franklin avenue. Attorney John F. Scragg withdrew Ferguson's applica tion, but an effort was made to have a license grunted fur another tenant. The court decided that the house was not entitled to a license on account of its unsavory character. A license was granted to Emll Welehel for the house at 111 Wyoming avenue. Exceptions setting forth thut his application was not filed before the time for filing applications had ex pired, were filed against his petition by Attorney John F. Scragg, represent ing Thoiuus L. Holthain and Arthur L. Martin, the present lessees, whose lease expires on April 1. Messrs. Holthain and Martin propose to seek the best legal advice In the city with a view to having the case uppealed to a high er court. When Judge Gunster opened the mall box at the door of his chambers In the court house Saturday morning he found a le'.ter addressed to him that had not come through the nostolhVe. but was dropped In by the person who Inscribed It or by some one at his Inr.tance. The Judge opened it and read It. The con tents were of a nature not calculated to engender feelings of serenity of tem per, for bold charges were contained in the missive against the Judge. The sender of it was Attorney Cornelius Smith. Judge Gunster placed the letter In his pocket and went out with the other judges to hand down the list of liquor licenses. After this function had been performed, Messenger B. Newton was sent to Mr. Smith's ofTlce with In structions to make known to him that his presence was Immediately desired In open court. In due season Mr. Smith inude his appearance and he walked down the center aisle of the court room In a dignified way with his silk hat tipped against his bosom in a defer ential manner..' The three Judges were on the bench and he stood up to tho bar with a quizzical look on his fuce. The court room was crowded with men attructod to license court and the bar enclosure was stocked with attor neys. The silence was lutcinse and the scene wus druinHtic when Judj?e Gun ster faced Mr. Smith and addressed him thus: "I received a communica tion from you which purports to be written and signed by yourself. Did you write it?" HE WROTE THE LETTER. Mr. Smith knitted his shaggy eye brows, hesitated u moment uml then in u clear and resolute voice responded atlliinalively. Judge Gunster told Mr. Smith then thut personally he felt disposed to over look the Insult, because that Is what It Is-, he said, but In view of the posi tion hf holds It would be unworthy of him t let the matter go tuilliitlced, for the communication contain serious charces. Six weeks ago Mr. Smith had a conversation with the Judge, uml that was the first the latter knew that the attorney entertained such Ideas. A few days after that Mr. Smith addressed a communication to Judge Gunster con tulning substantially the same charges but the last one had the charges In an aggravated form. HIS AUTHORITY ASKED FOR. The judge asked Mr. Smith to state his authority for the allegations made In the letter. The answer wus that the story was told to him by a person In open court. The Judge said that who ever conveyed the information Imposed on Mr. Smith and he gave him until today to make known who furnished it to him. Mr. Smith said he would be called out of town on Important bust ness for a few days and he plead for an extension of time until Monday, the 23d, in wnlcn to prepare his replication This was granted. Judge Gunster said he was disposed to be fair with Mr. Smith, and was ready to continue the matter until then. Mr. Smith says that his Informant Is an attorney practicing In this court. but he has refused to say anything fur titer until the matter Is aired, a week from today. He is going to the 8u prerne court this week, interested In a case from Susquehanna county. A short time ago he applied to Attor ney General McCormack for a writ of quo warranto to Issue from the state department to Judge Archbald, order ing him to show cause w hy he should not be removed from the bench. The attorney general refused to entertain the application and Mr. Smith threat ened to go to the Supreme court for a writ of mandamus to compel him to do so. He may spring that when he is down this week. DICKSON MINK STRIKE. Superintendent Vandllng Says It Was Caused by a Misunderstanding Which lias Been Adjustedand Thst Ho Expects the .Men tb Return to Work. It was stated by Superintendent Vandllng, of the Delaware and Hud son, to a Tribune reporter yesterday af ternoon that the grievance which caused seventy-five men to stop work In the China vein of the Dickson mine Satur day had been adjusted and that he ex pected the men would return to work today. He said the trouble related to dockage, but he would not discuss the matter In detail. It is reported the the men remonstrat ed against being credited with but four Inches of coal above the car top, while the law provides for an allowance of two inches more. They claimed an ex tra topping of from six to thirteen Inches. Before stopping work a depu tation conferred with Outside Foreman McDonald, but without securing a defi nite adjustment of their grievances. A telegram received in this city Bat turday announced the marrtag.ln New York of Martin Clark, a well-known North End hotelkeefier and horse fan cier to Miss Cella Ruddy, of West Mar ket street.
