Judgc Archhald handed down a decis
ion yesterday in the councllinanlc con
test of the Third ward of Olyphant
boroufrh, which gives the office? to Kd
wurd J. Hurke. the one who was de
feated on the fnce of the returns and
dispossesses James J. Flynn, who bus
served for two years. The election
was held on FVbruury -0, ISSM.
The court orders that the borough of
Olyphant pay the costs of the pro
ceedings. Hurke was returned us hav
ing received alxty-three votes, unci
Flynn. sixty-five; but on n recount nf
the balluls each wus found to huve re
ceived slxty-slx.
The evidence brought out nt the con
test showed thut twenty-nine ballots
were cast by ersons who were not
qualified to vote by reason of the non
payment of taxes, non-reRistry, alien
age, or some other disqualifying: cause.
Of these Illegal votes, eleven were
found to have been cust for Hurke und
thirteen for Flynn: live votes were
blank or defective. This left the total
number of leiral votes cast for Burke
to be llfty-flve and for James J. Flynn
fifty-three.
lie Wan Not Naturalised..
One of those who were found to have
voted Illegally wus Anthony McIIale.
He was; disqualified on account of being
an alien, who votfd thirty-seventh on
the list. When the ballots turned up.
no No. ,1" could be discovered. There
were two No. Hb; it was evident thut
one of these was the missing 117.
Under the circumstances the two
voters, Thomas Sheridan, who voted
36. and Anthony Millale, whose bal
lot was the missing 37 evidently, were
called into court to testify how they
voted. I 'pun their examination In open
court, Sherldun said he voted for Hurke
and McHale said' he cast hb( ballot for
Flynn. This latter vote being cast by
an illegal voter it wan rejected.
Hurke will take his seat at the next
meeting of the Olyphant council and
will serve one yeur, when the term ex
pires. Judge Arch bald In passing upon
the ballots found four marked for Hurke
by a single stroke instead of a cross;
he held that these votes should not be
thrown out becuuse the purpose of the
voter was shown and Indicated for
whom the votes were Intended.

direction. Other steps will be taken,
he says, If the baggagemen make It
