Police Officer Lona Day and Miss Mar

and groom will start on a wedding tour,
which will include a visit to New York,

ATTRACTIVE PROGRAMME.
It Was Presented at Laurel Hill Park
Yesterday.
The second week of the Laurel Hill
park season was ushered In yesterday
with an attractive programme that
found great favor with, those who
ought that cool place to escape the
oppressive heat.
At 2 p. m. the Morris school of trained
ponies gave an exhibition, and at 3 p.
m. the. concert by the military band
took place, followed by another con
cert at 7 p. m. At both attractive pro
grammes were rendered. In the Pa
vllran Opera House at night Cyrene ex
ecuted her wonderful dances and after
ward gave an exhibition on the swltwr-
did some clever club swinging and hat
pinning, afterward appearing In their
. setwiatlonal balancing ladder feats.
Others who had numbers on the pro
gramme were Maggie Warren, vocalist;
Drawee, the juggler; Carrie Monroe,
vocalist and paper tearer, and Andrew
P. Cooper, battle club manipulator.
On Wednesday Profersor Chirlr-s
Thompson will give a balloon ascen

tribunal had alllrmed tho Judgment and
sentence of the Lackawanna county
courts In the matter of the conviction
of Frank llezek for the murder of his
sweetheart, Marie Kerzlc, at Olyplmnt,
on Oct. 9. 1SII4. Within a few days the
clerk of the courts will send a oertltlod
copy of the remittitur to tlovernor
Hasting, who within sixty days there
after Is required to tlx the day for exe
cution. Accompanying the remittitur were all
the records in the case and a ccrtilled
copy if the opinion of the court, w hich
was written by Justice McColluni,

Frank Herchlne, otherwise known ns
Frank Bezek. Is under sentence of
death of Maria Kcrzec, at Olyplmnt,
Lackawanna county, on Out. 9 last, and
the record of his trial and conviction Is
before us for review. We have care
fully examined and studied the testi
mony and while we do not deem It nec
escary to analyze or discuss It In this
opinion, we unhesitatingly say that his
conviction of murder of the llrst degree
was fully warranted by It. It plainly
ehows that the homicide was a conse
quence of the refusal of the deceased to
becom? his wife. Whether It was thi
result of an attempt hy him to commit
suicide, of a premeditated purpose to
murder her, or of the unconscious net
of a madman, were questions for the
Jury upon the evidence under proper In
structions from the court.
There are sixteen specifications of er
ror tiled in the case, and we will con
sider th?m in their order. It is conced
ed by the learned counsel for the de
fendant that there Is nothing upon the
record on which to base the llrst speci
fication, and tills concession, confirmed
by an Inspection of the record Is. tech
nically speaking, a sultlclent answer to
It. As nothing short of an abuse of the
discretion the trial court has In passing
upon a mntiun of this character would
Justify our Intervention, and as It does
not appear that this discretion was
abused in the case before us, the speci
fication must be overruled.
As to the Second Specification.
There Is nothing In the offer which
forms the subject of the second speci
fication that raises any doubt concern
ing the correctness of the ruling upon
It, except the portion of It which relates
to the alleged conflnment of the de
fendant In an Insane asylum In Aus
tria, and the exclusion of this ap
peared to us on first view as error
which might authorize and perhaps call
for a reversal of the judgment. The
technical ansyer to this view Is that
where an'offer blends Irrelevant and in
admissable matters with a matter rele
vant and admissable, and It is made
and rejected as a whole, the rejection
of it is not error: Sennett v. Johnston,
9 Pa., K3, and Wharton vs. Douglass
76 Pa., 273. But In deciding the ques
tion raised by the specification we
shall not take into consideration the
rule supported by the cases cited.
These were civil cases, and If the rule
stated In them Is applicable to. It ought
not to be summoned to sustain, a rul
ing prejudical to the Interests of a
defendant on trial for murder.
The specification, however, falls to
disclose the ruling Immediately fol
lowing the one In question, and under
which the defendant was allowed to
prove all material and admlssable mat
ters contained In the preceding offer,
together with his acts, declarations and
conduct while In Austria, and In this
country, tending to show that he was
Insane when the homicide was commit
ted. This ruling rendered the ruling
complained of in the second specifica
tion harmless and without effect upon
the defendant's rights, even though it
be conceded there was error In Its ex
clusion of that part of the offer relating
to his conflnment in an asylum. Jo
seph Petroclous, John Karoclous and
Anthony Kramtz, who were his neigh
bors In Austria and whose acquaint
ance with him dates from the period of
his childhood, testified to having seen
him in a hospital at Llebeg, five years
ago, and to his acts and declarations
there. That their testimony did not
fully sustain the offer may be attribut
able to their want of knowledge or
recollection of the matters to which
their attention was called, but It Is not
chargtaible to any ruling of the court.
Could Not Affect Decision of Case.
The rulings complained of In the
third and fourth specifications of error
were not excepted to In the trial court
and are not, under well-settled rules,
reviewable here. Besides there Is
nothing discoverable In either of them
which can be regarded with any show
of reason as prejudical to any right or
Interest of the defendant. The matters
to which they referred could not legiti
mately affect the decision of any ques
tion Involved In the case.

If you were to call at 27 Front avenue,
you would find a pleasant elderly lady,
Mrs. Captain Henesy by name. Her kind
ly wmlle and Joyous manner are to no
small extent due to the escape she has
had. Her own words can better describe
her rescue and one can easily understand
her present happy condition when they
realize what she has gone through. She
says: "About five months ago I had an
attack of sickness which lasted for a week
and since that time 1 have beon subject
'it Intervals to similar attacks, some of
which were longer In duration. It Is hard
for me to describe how I suffered. The
pain would commence In my head, after
which It would seem to pass down my

lence of the attack passed over. The last
attack I had was the worst, and was so
bad I would not have been able to tell this

sides left me and the dizziness went with
It; the bloating In my face and body disap
peared and all distress In my bowels was

ninth and tenth specifications da not
require elaborate discussion. It la suf
ficient to say of the fifth and sixth that
the offer made for the purpose of con
tradicting Mrs. Kramer related to Im
material matter and was based on nn
assumption not warranted by her testi
mony. The Instructions in regard to
the effect of the defendant's flight from
the scene of the murder, was consid
ered on the whole unobjectionable, and
so were the Instructions concerning the
evidence of his allcKed Insanity. It Is
not claimed that the murder of Maria
Kerzec was committed by means of
pols-on, or by lying In wait, or In the
perpetration of or attempt to perpe
trate any arson, rape, robbery or burg
lary. The Jury were not required to
consider n murder so perpetrated, nnd
they were substantially so Instructed
In the language of Justice Agncw In
Commonwealth v. Drum, 58 I'a., 10. We
do not assent to the claim that the In
struction wus misleading.
The defendant has no cause to com
plain of the nntuvcr to his eighth point.
The point was misleading and not a
fair or correct statement of the law
applicable to the defense of Insanity.
It Ignored the presumption of sanity
and cast on the commonwealth the bur
den of showing by nfllrmatlve evidence,
which excluded doubt, that the defend
ant was not Insane when the homicide
was committed. Insanity U nn Inde

must show the existence of it by fairly
preponderating evidence; Ortweln v.

Commonwealth, S3 I'a., 131; nnd l'nn
nell v. Commonwealth, 86 I'a., 100.
There Was Direct l: ldcnco.
We see no error In the rulings or no
tion complained of In the eleventh and
twelfth specification. There was di
rect ns well as circumstantial evi
dence that the murder was "wilful, de
liberate und premeditated," and there
was nothing said or done In relation to
the Jury's request In respect to the
reading of the testimony which fur
nishes any ground for reversul or ad
verse criticism. .
We are unable to lind In the excerpt
from the charge, which Is the sub
ject of the thirteenth specification, any
thing that could possibly prejudice the
defendant's cause or mislead the Jury.
There was no exception to the ad
mission of Berger's testimony, but
there was nn exception to the denial of
the motion to strike It out. The reason
assigned for the motion did not accord
qjth the facts as shown by the evi
eitee. Cummings testified distinctly
that he warned the defendant that nny
statement he might make concerning
the murder would be used against him,
and that he need not say anything
about It unless he desired to do so.
The statements made by the defend
ant appear to have been voluntary, and
we cannot say they were misunder
stood or misinterpreted by the wit
nesses who testified to them. We there
fore see no valid reason for rejecting
the evidence of them. Upon this re
view of the case we conclude that it
was fairly tried and that all the spe
cifications of error must be overruled.
The Judgment Is affirmed, and It is
ordered that the record be remitted for
the purpose of carrying the sentence
Into execution.

In the case of C. L. Bice against the
Fidelity nnd Casualty company, In
which binding Instructions were given
to the Jury by Judge F. W. Gunster last
week, a rule to show cause why a new
trial should not be granted was yester
day allowed.
An opinion was filed yesterday In the
case of N. A. Hulhurt against W. K.
Heck, which ordered that the defendant
within ten days, by paper filed, agree to
release the amount certified In his favor
so that the verdict shall stand simply
as a verdict for the defendant and that
thereupon the rule for a new trial shall
he discharged or otherwise that the rule
be made absolute and a new trial
awarded.
POLICE COURT JOTTINGS.
John Gallagher, who was arrested for
font driving and abusing the horse and
wrecking the surrey of Liveryman B.j
J. Neville, was yesterday discharged.
The damage will be paid. .
Joseph Llverwlrtz and George Ben
son are the two men who were nrrest-
ed Sunday for being concerned In the
drunken fight In the rear of Wolf
Johnson's hotel. Alderman Millar
gave them a hearing and held each
under $300 ball, which they furnished
and were liberated.
Pntrlck Lynn, of Hnmm court, South
Side, was arrested Sunday afternoon
by Patrolman Neuls for being drunk
and abusing his parents. Jle had a
stone as large ns a pineapple and was
threatening to bntter his father with
It. A fine of J: was Imposed, and If It Is
not soon paid the young man will spend
ten days at tho county Jail.

week, the trespass case of Thomas
Davidson against Thomas Sanders und
James Jenkins was called for trial.
All of the parties to the suit live nt
Parker street, In the North Knd of the
city. The plaintiff Is represented by
Attorneys C. H". Soper and Joseph
O'Brien, and the defendant by Attor
neys Hulslnnder and Vosburg.
Cause of the Action.
Mr. Davidson alleges that In
he bought a lot fronting on Parker
street und erected a house on It. The
lot Is on a sloping hillside, und some
time later the defendants purchased
a lot directly above him and erected
on It a double house. He charges that
they so arranged the surface water
that It was thrown on his lot, cutting
deep gullies, uprooting trees, destroy
ing his grape arbors and filling his cel
lar with water. For all of which he
wanted the Jury to grant him proper
redress.
After the plaintiff rested the attor
neys for the defendants asked for a no.i
sult on the ground that the natural flow
of surface water from higher to lower
ground does not give a cause for action,
and that no action cn be maintained
for changing or obstructing the llow of
mere surface water by erections on ad
Joining lands or by grading or tilling to
a higher grade, such wnsuquenccs be
ing the necessary result of the lawful
occupation and use of the land. The
motion for a nonsuit was refused, and
after the case for the defense had been
opened to the Jury by Mr. Vosburg, Mr.
Sanders, one of the defendants, -was
sworn. He denied that they had turned
the water on Mr. Davidson's land.
They had leveled oft their property,
which had a tendency, If anything, to
keep water from flowing on Mr. David
son's land. After 'Mr. Sanders left the
stand court adjourned for the day.
llcfore Judge .Mcpherson.
Judge McPherson, of the Dauphin
Lebanon district, arrived In the city
about noon and In the afternoon went
on the bench In court room No. 2, and
three trespass cases against the Cnr
bondule Traction compnny were called
for trial before him. The plulntlffs are
Henry Collins, W. L. Hunter and Mary
K. Purdy, owners of properties on
Brooklyn street, Carbondnle, which
they allege were damaged and their
value depreciated In consequence of the
construction of the electric road of the
defendant company on the street In
front of their premises.
The grade of the street was changed,
which made It necessary to raise the
houses and fill In the lots. The fact
that the road Is laid close to the side
walk Is claimed 'to be another element
of damage. The Buit of Henry Collins
against the Traction company was
tried on Oct. 1, 1894, before Judge Searle,
of Susquehanna county, speclnlly pre
siding, and a verdict of $500 returned In
favor of the plaintiff. This verdict was
set aside and a new trial granted by
Judge Searle on Oct. 20, 1X!)4. When the
case was called yesterday It was decid
ed to try the Purdy and Hunter BUlts
In conjunction with It, as the facts In
all are the same.
Jury Went to Cnrbondnlo.
It was decided to hear the testimony
In the Collins case first, and after lis
tening to the story of the plaintiff and
that of Contractor John Nolan, who de
clared that Collins" propenty hud been
damaged to the extent of $1,000 by the
construction of the electric road, the
Jury, at 3.30, started for Cnrbondule to
view the properties that are alleged to
have been damaged. The attorneys In
tho case are S. H. Price nnd J. K.
Burr for the company, and I. II. Hurna
and J. F. Reynolds for the defense.
Down In court room No. 2, before
Judge Archbnld the case of Harry A.
LVpuy against J. A. llrndy came to an
Abrupt' termination during the after
noon. Mr. Depuy was represented by
Attorney E. C. Newcomb end Major

In payment for a horse. Payment of
the note was topied and Mr. Brady
refused to accept the animal, when It
was brought to him, whereupon It
was sedd for Its keep to a man named
Costellu, whose bid was $00.
After the defense opened, Judge
Archbald decided that the case had not
been properly begun and suggested
that a Juror be drawn. The cuse was
then continued until tho next term. No
other case was called In that court
room during the remainder of the day.
The Depuy-Itrady case was tried
June 14, 1804, before Judge? Kdwards,
and a verdict of $852.80 returned In fa
vor of tho plaintiff. On Aug. 13 a new
trial was granted.

nny Scranton Institution, and Miss Mc
Donald, honored by the distinction, Is
putting .forth her host endeavor to
make the event a memorable one. On
