The second week of the December
term of criminal court opened yester
day morning and the 'Interest of the
public which was aroused In the Bezek
murder case was fully as expectant, as
the first and second cases on the docket
were those of murder. The first case
to be tried was against Joseph Rumln
isky, who killed August Gouse at the
"Ridge," near Archbald. The murder
er was captured and landed In ithe
counlty jail the next day.
The second case was against John
Roatosky, who beat Joseph Clletic to
death with abase ball bat In a bar room
brawl on the morning of Sept. 23. An
other man, Joseph Bldds, was plugged
full of holes with a shot gun In ithe
name cae by Rostosky's brother, who
Is held a prisoner in the Cllotic murder
as an accessory. Bldds recovered and
Is now well. Both cases were contin
ued until the January term of court to
fflve District Attorney Kelly a chance
to clear the list of minor cases, as the
Irlail of theitwo murder cases would in
vllve as much .time as the Bezek case,
Just -nded.
Judge Edwards was presiding In the
main court room and the first ease
culled before him was on all day and
not finished at adjournment. Frank
Bruner, an Italian special constable of
Throop, Is the defendant in three cases,
two of felonious wounding and one of
carrying concealed weapons. In the
first case George Polochlck is the prose
cutor, and ' in the other two Joseph
Truthoe Is. Dlstrlot Attorney Kelly
and Attorney K. C. Newcomb are rep
resenting the commonwealth and At
torneys H. L. Taylor, W. J. Lewis and
Thomas J. Duggan are for the de
fendant. They Assailed Him.
Substantially the case la that the de
fendant claims to be a special officer
of the borough of Wlnton and was only
acting as the law permits him to do
under suchl circumstances. He ial
leges that the prosecutors and a nunv
ber of others, In fact a mob, of which
they were a part, assailed him with
stones on the night of Oct. 21 on one of
the streets of the borough, and he shot
at them,
Judge Albright, of Lehigh, held court
In No. 2, und the first case called before
him was that of Jacob Boes, of the
South Side, who was charged by his
wife, Lena, with thumping her in the
face. 1 Attorney John F. Scragg assist
ed Mr. O'Neill, the assistant district at
torney, in the prosecution, and Attor
ney George .S. Horn conducted the de-
fense. The charge is that on May 28
last Boes assaulted his wife so violent
ly that she fell on the floor from the
force of his blows. The defense main
talned that she publicly addressed peo
pie on the atreet and Insulted the
memory of his farther, and the prosecu-
tion held that no words can Justify an
assault. The Jury returned a verdict
of not guilty and equally divided the
costs.
The next case before Judge Albright
was that of Robert Linn against J.
Reed, charge of larceny by bailee. The
facts appear to be that the prosecutor
last April loaned a bed to the defend
ant, who had Just then entered upon
the matrimonial sea. The understand
ing was that Reed should return the
bed, which was valued at $4, after using
it a month. Up to this day he retains
possession of it. Judge Albright In
structed the Jury to find a verdict in
favor of the defendant, as no evidence
was brought out to show a fraudulent
Intent on the part of the defendant
Any action, therefore, which the prose
cutor could enter against the defendant
should be In common pleas court in a
question of damages..
A South Side Case.
Richard Helbring, of the South Side,
charged with assault and battery by
Peter Allbach, was tried. On July 24
the prosecutor caught Helbring steal
lug mortar from the new Nineteenth
ward school house. He ordered him
away and Helbring struck him. All
bach is a special officer and attempted
to handcuff the defendant, who broke
away. It was a trivial case that should
not have got Into court. The Jury found
the defendant not guilty and placed the
costs on the prosecutor.
A Jury was called In No. 2 and Clark
D. Lawson, the noted bicycle thief, was
called for trial. Fred C. Hand was
prosecutor. The defendant was led
from the prisoner's dock by Keeper
Flanaghan and brought Into No 2 cour
room. He is now serving a nine month's
sentence in the county Jail, having been
convicted at the last term of court on
the Bame charge as the one for which
he was yesterday called to answer that
of larceny by bailee. The defendant
had no counsel and Judge Edwards as
signed B. F. Ackerly to defend him,
After a short consultation between
Lawson and Attorney Ackerly, they
walked before the bar and entered a
plea of guilty. The prosecutor, through
Assistant District Attorney O'Neill
stated to the court that the defendant
had not stolen the bicycle, simply de-
talned it and did not sell it, and he
had no desire to prosecute. Attorney
Ackerly made a plea for mercy, urging
tho respectable position of the defend'
ant's parents, and" that he was a young
man who got away from home and fell
Into evil ways. Judge Albright sen
tenced Lawson to pay a fine of 35 and
spend fifteen days In the county Jail
the Bentence to begin at the expiration
of the sentence he Is now serving.

decided success at the Davis theater
yesterday and last night in "The Ranch

POLICE COURT SENTENCES.

arrested by Officer Sloat at 2 a. m. In a
drunken condition. He was sent to the

He paid $4 yesterday morning at police

James Trainer, a cigar maker, en
deavored to pass a counterfeit "quar

Arthur E. Sparks, an incorrigible
