cise" consisted in ei ging by the children. The re
port of the school was read by Mr. John NC. Evans,
Which stated that the school was divided into two
departments, principal and primary, numbering 49
teachers sad 432 'cholera. The attendance during the
year averaged 283. A missionary society has re
cently been roimrd in the school, which is now sup
porting a missionary In Sweden. Alluding to the
Vaal Lumber of children who are in the streets
on Sabbath, the report urge. that to reclaim
them opens a wide field of labor for those who
desire the temp-rat as well as the spirituel
prosperity of youth placed beyond contingency.
It is a field in which all can work, and the
question of personal duty assumes a serious Un
yortance, which each teacher may exert upon the
future. A. Christian patriots who are looking anx
iously forward to that national greatness which is
in reserve for our country, are there no fears, no mis
givings, as to the moral influence which will be ex
erted by those who are to control the future desti
nies of our nation? Without regard to any higher
consideration, this of itself should be sufficient to
enlist the energies of every true patriot and Chris
tian.

A3tRI~ AL car SoLDIERS.—The following
squads of soldiers arrived in this city on Saturday :
The guard of aeventytwo men belonging to the 10th
- Kansas Regiment, under the command of Captain
33111, Which conveyed the rebel prisoners to Fort
Delaware on Friday. They were fed and quartered
at the Cooper. Shop Refreshment Saloon, and are
expected to leave for the V7est at nine o'clock this
morning.
Squad of nineteen men of the 16th ohlo Battery,
Lieutenant Dawson, commanding, arrived from Vir
ginia, on their way home. They were fed at the
Cooper-Shop Saloon.
Squad of twenty men belonging to tat Section
Massachusetts Heavy Artillery, Lieutenant Perry
commanding, arrived from Boston, on their way , to
- Washington. Fed at the Cooper• Shop Saloon.
In the eventog, about 342 recruits for, different
Illassaahusetts regiments, under the command of
Captain W. F. Fuddirg, passed through on their
way to the seat of war. They were fed at both
saloons.
WHERE .ARE THE tiPORTEMEN ?—We are
informed by some fishermen that for the past week
the waters near the mouth of the Schaiylkill have
been alive with wild r uck, most of them sprig tails
or steel-heads. There was not even a solitary
sportsman there to disturb them. The amphibious
creatures seem.'d to be ueusually tame. In some in
stances great flocks would part to let boats pass
through. 1014 e number of duck. of several species
unusual in the 'waters of the Delaware, have been
seen in Eagle Cove and in the vicinity of the several
islands between Philidelphia and Chester. The
probability is that the heavy easterly storms of late
have driven the dusk* to the waters of the Dela
ware.
PHILADELPHIA. PRINTE A.—James M.
Johnson, a Philadelphia printer, enlisted in the
service of the Government shortly after the bloody
hand of the rebellion was raised against the flag of
the Union. lie wee then attached to the Bth Penn
sylvania Cavalry as an oraeriy sergeant. Oa many
occasions be gave evidence of bravery and skill, for
which he has received the merited honor of pro.
motion to the rank of captain of Company H, 18th
Pennsylvania Cavalry. Captain Johnson Is well
hem!' and highly reepeeted among the fraternity of
printers and the public generally.
HEAVY Biotic.—Fora couple of hours
before daybreak, yesterday morning, the wind from
the northeast was particularly violent. Ina num
berof instanter chimneys were blown down, because
the adhesive quedirma of the mortar had been de
stroyed by the opetwion of coal gam Betides this,
many of the gas lamps were extingnished because
SA the broken glass of the cases. The lamps, :a a
general thing, are very dirty, and are improperly
attended to.
ritESENTATION.—A very beautiful silver
pitcher Was prerented on Saturday evening to the
_National Union League, by the ladies holding the
fair at the Araenibiy Building for the benefit of
the loyal =there's in Tennessee. The pitcher was
received on beNslf of the membere of the League,
by the Hon. Manes Gilpin, S. District Attor
ney. The °ovation waa a very happy one in every
'expect.
Hion TIDES.— The tides in the Delaware
and Schuylkill have been very high dud g this
spring. HEAVy rains. and a SUCOOI.BIO/1 of easterly
gales. have swelled the streams to a much greater
extent than bas been known in the months of March
And April for many years.

- Murder of John Neish. First-Mate of the
Bark Garibaldi.
The crew of the bark Garibaldi were arrested on
Thursday Light ty United States laarishals Jeukins
and Sharkey, on suspicion of having been concerned
in the murder of John Neigh, the first mate Of said
vessel, some time since. or at or near Matanzas. The
parties were arraigned on Saturday for a hearing.
Three witnesses were examined, but nothing Was
elicited respecting the events resulting in the death
of the first mate. There was some evioence as to tae
mutinous character of the Crew. The names of the
prisoners atraigned are John Arnett, second mate ;
Rappan Moroni ; Nicholas Drygot, Michael Benuch
Thomas Hocriguee, and Michael Kane. Richard
Wood, colored man, of Philadelphia, and cook of
the vessel. teethed as follows : I heard scuffling and
hollering in the forecastle; I supposed the mate
was there; the hollering was in a foreign tongue;
when I got out to the galley door, I saw the
that mate running towards the cabin door; I then

galley door where I was standing ; he stood there

forward after he fired ; the second mate was stand-

come out; I do not know whether the captain was
in bed or not ; tee captain told me to bring the mate
here; he told tee cook the same; the captain staid
in the cabin ; I then came back to the galley, and
sat down, and awaited daylight, I was so frightened.

lying alongside, with another ship in tow; the
men were drawn up in a line along amidships, to
give up their oath of allegiance; the captain then
asked where the mate was, when some one told him
he was dead; I did not see the little Spaniard when
the men were araten up in line ; one of the men went
forward to look after the mate ; the man came back
and said the mate was dead. Two pilots, the cap
tain, cook, and myself, went Into the forecastle; /
then saw ihe mate lying dead, just in the same con.

the captain took brass knuckle/ and a revolver
from alongside the mate and took them to the cabin ;
the captain did not return ; I next saw the mate
when he was to be thrown overboard; I think it

Frank Flatulent sworn.-4 came aboard the above
vessel on the eath of February, to act as first mate ;
I came from the ship Ellen Southard; I was rc•
quested to Dom. by Captain Howe, the master of
the Ellen Sou hard; I saw the captain of the Gari
baldi on bawd the Ellen Southard; I told Captain
Howe I would not go; the captain of the Garibaldi -
could have heard our conversation if he had been
listening; I Mutt know, alt. that time, there had
been a murder committed on hoard the Garib shdi ;
I went on board the Garibaldi ; about 7 o'clock tie
captain was at the main hatch ; he told me the crew
did not intend to turn to; I then asked him what
was to do; be told me to try and coax them to go to
work; I found that the second mate could talk a
little English ; he always behaved very well; I saw
the supposed dead man ; he was lying in the fore
castle ; Old not know that he was tied there ; I had
to keep my eyes about me at 4 30, through the
captain's order, I burled deceased; there being
nothing on board to make a shroud, we took the
bed clothes, made a beg, and put the body in • as we
were doing ae. I discovered a pool of blood near
where the body was lying. This witness then pro
seeded to detail the scenes of terror on board the
vessel. Michael Kane was so frightened that lie
came very near jumping overboard, and seemed to
be afraid of going among the crew,
The hearing :sojourned Until noon to-day, when
Kane Will be placed OR the witness stand. It is
thought the real murderer escaped at fdataozas.
He is a Spaniard. There does not seem to be any
thing known as to the cause of the murder.

Robbery and Sharp Practice.
A oneilllttled man ogling himself Stephen Clay,
and IWOMen giving the name of Realm' Maeor-
meek, were arraigned at the Central Station on
Saturday on th.e charge of robbery. The evidence
in the case developed a specimen of pretty sharp
practice. It is as follows : The manufactory of Mr.
Edward Cope & Son, on Hermann street, German.
town, was entered nn Monday night or Tuesday
m orn in g last and robbed of seventeen dozen woolen
knit nubtas and balmoral hose. Most of the articles
recovered were spread out on the long desk at the
Central, and were identified by one of the firm.
Solomon L. Friedenberg ewora.—l am a broker,
(pawnbroker) ; these good. were deposited with are
by this woman, Rachel McCormack; I think to the
best of my knowledge she is the woman, but I can't
gay exactly that she is the person, because it was in
the dusk of the evening when she game; Clay cams
the next day and claimed the goods, saying they had
been stolen from him ; I told him he must make an
affidavit that be owned the goods; he went away,
and on the next day he produced the affidavit, as
sworn to before Ald. Plankinton ; this affidavit set
forth that the goods had been deposited by Rachel
lir ever ; on this I delivered the things to him.
Detective Levy sworn.—l went to Mr. Frieden
berg's on Friday afternoon, having thus far fretted
some of the goods stolen from the factory of Mr.
Cope & Son, and there learned that a man had been
there in the morning, who claimed the goods, and
received them ; I went in search of the man, and
told several of the pollee force that if they saw a one
armed man, to arrest him; Officer Frowett took
Clay into custody near Eleventh and Melon streets,
and conducted him to the etation-house ; on search
ing the prisoner, a dark lantern was found, and also
some gunpowder In a piece of newspaper, and also
an augur-bit and a pocket-handkerchief, that he
was motions tokeep ; then went to the house where
the woman Rachel lived, in a little court running
north from Melon street, above Eleventh, and in her
trunk found a hand vice and two pair of pliers.
Upon exhibiting these, Mr. Cook identified them
as his property, but did not know they had been
stolen from the mill.
I asked the woman, continued Mr. Levy, where
she got the vice and pliers, and she replied they
were some of thetools that Clay worked with at his
trade before he Wits cent to prison.
Alderman flaukinton was examined as a witness,
and testified that the affidavit was made before him
by a one.armed man ; think Clay is the name person,
but cannot say positively ; the statement made was
that the goods belonged to him, and that they had
been pawned by a woman calling hevcolt Mn.
Reeder; he said the ticket had been lost, but that
he bad obtained the number from the pawnbroker.
Mr. Levy remarked that the prisoner had some
conversation with Officer Taggert. Mr. Taggart
asked him where he got the goods.
The prisoner replied "in New York."
" Whereabouts in New York?" inquired Mr.
Taggart.
To which the prisoner replied "that's none of
your business."
The defendants were committed in default of
$1 500 each to answer at court.
Rune Crazy.
Peter Gann was arraigned on the charge of com
mitting an Of/Ma and battery upon a colored man
cameo James Randolph, on Sunday evening. Sir.
Randolph testified that as he was walking along
Sixth street, on his return from church, he observed
the defendant and another person insulting a colored
woman. Witness stepped up to them and remon
strated kindly on the impropriety of their conduct,
whereupon he was knocked down and very badly
beaten about the head. The prisoner is one of the
men who made the attack.
"Well, Peter," said the magistrate, "what have
you to say 1"
Peter replied that he did not know anything about
the affair until the next morning—" Lucas crazy."

The prisoner stood mute, his countenance indi
cating a sort of cross between ignorance, brutality,
whisky, and idiocy He was ordered to enter bail
in the sum of $6OO to answer.

Edward Murray, a driver of a car On the Heston.
vine passenger railroad, was convicted on Saturday
on the charge of running hie ear over a small child
named Geo. Stokes, from which death ensued in a
short time.

.Larneoy of AL Watch
Charles Richardson is the name given by a young
man who was arraigned on Saturday on the charge
of stealing a watch from a men in a public house
near Market and Twelfth streets. The accused, it is
said, upon being hard pressed, showed the place
where the watch had been secreted in a stable on the
premises. The timepieen was smeared. The se
emed was committed .
Burglary.
A house at the corner of Broad and Pine streets
was broken Into at an early hour on Saturday morn
ing. A few articles were stolen. The robbers had
forced open a wfndoW.thuttet.

United States Circuit Court—Judge Cad

Mattison 4 CO, TM SI/nyder et al. On Saturday
the jury In this case 'rendered a verdict in favor of
the plaintiffs for $3,258.15.
The United States vs. 6 Boxes. These boxes, con
taining needles, spectacles, buttons. handkerchiefs,
and marked "George Schaffer, Columbia Hotel,
Washington City," Were seized in this city ont the
22d of April, 1663, by some of the detective officers
of the police force, and on Information filed were at
bitched for forfeiture on the ground that the goods
were in transitu to parties in a State in rebellion—
viz : Virginia. The goods are 'claimed by one Peter
Hates, who, in his answer to the information, says
that he is a loyal citizen, and that the goods were
being sent to Schaffer, at Washington, for gale by
him. He further denied that they were intended for
the rebels. After the evidence and charge of the
court the jury rendered a verdict for claimant. Uni
ted States Attorneys Gilpin and Ashton for the Uni
ted States; Geo. H. Earle for claimant.

IMPORTANT DECISION AS TO . LEGAL TENDER NOTES
Mervine vs. Sailor. This was an action to recover
damages for breach of covenant. Defendant had
covenanted to pay a yearly ground rent of $570,
"lawful silver money of the United Staten, each dol
lar weighicg seventeen pennyweights and six griller
at least." When the July rent became due the de
fendant tendered the amount in United States trea
sury notes, which plaintiff' refused to receive, de
manding silver dollars. Suit was brought, and the
defendant pleaded tender as aforesaid. To Stile plea
the plaintiff filed a replication, averring that the
defendant did not tender in silver dollars, &c. ' but in
promissory notes or paper money of - the United
States, of the nominal value of $285, but of 40 per
cent. less exchangeable value. To this the defend
ant filed a special demurrer, averring that the pro
missory notes so tendered were lawful money of the
'Came States, and a legal tender in payment of all
debts. This demurrer was before the court at the
December term, and was reargued at the present
term by G. 111. Wharton for plaintiff, and by Geo.
W. Harkin' for defendant. Saturday, the opinion
of the court was delivered by Judge Rare, rendering
judgment on the demurrer for the defendant, thus
deciding that the treasury notes are a legal tender,
and should have been received in payment of the
rent. Judge Sharawood delivered a dissenting
opinion.
In the case of Koerner vs. Calhoun, which was to
have been heard in the Court or Common Pleas by
Judge Allison, a postponement was had until some
day next week, yet to be fixed. In this case, the
nuestion is raised whether the principal of a ground
rent, the interest of which as well as the principal,
is covenanted to be paid in "lawful money of the
United States of America," may be paid in "legal
tender notes." W. L Hirst is for plaintiff; George
