The iules of the House of Representatives were
adopted lor the government ot the Convention.
A motion was made that Wm. £L Witte be elected
pennanent president. Tne names of Wm. L Hirst,
of Philadelphia, ana Gen. Sanderson, of Lancaster,
were also mentioned.
Several amendments were offered and gave rise to
a lengthy discussion. Considerable disorder pre
vailed, and frequently a hall - dozen delegates were
addressing the chair at one time* The motions
came so rapidly that it was almost impossible to
know what question was really before the Conven
tion. A delegate described the disorder as disgrace*
ful to the Democratic party.
The Chairman finally stated that the vote would
he taken upon a proposition to appoint a committee
ol thins-three to select permanent officers for the
Convection. The jess and nays were called, and
resulted in 48 yeas to 76 nays.
A motion to nominate candidates for permanent
president prevailed.
Messrs. W. H- Witte, W. L, Hirst, Geo. Sandeiv
ton, ¥, P. Schell, and James K. Kerr, were then
placed in nomination. Messrs. Hirst, Schell, and
Kerr declined, leaving as the combatants, W. H,
Witte and George Sanderson.
The vote stood—Witte, 94 j Sanderson, 31,
Wm. H. Witte was then declared elected, and, on
motion, the election was made unanimous.
Mr. Witte having delivered a speech of thanks
to the members, and of abuse against the national
authorities, the Convention adjourned till 4 o’clock.
On reassembling, a long and noisy debate arose
respecting the duties of the Committee on Resolu
tion!. Each member of the Convention appeared to
have some instruction to that committee, which
having been listened for A long time, the chairman
of the committee said that he was obliged for the
dictation from the members, but that the committee
would do just as they pleased. The question of ad
journment then occupied much of the valuable time
of the Convention. Mr. S. G. King, of this city,
desired that the Convention should adjourn over
till Satuiday, m it would be outraging the feelings
of a very large portion ol the community to hold a
Democratic Convention on Good Friday. A delegate
arose and said that he did not know wnat better
thing he could do than to meet on a good day to do
a good thing—namely, to sit and act in a Democratic
Convention. This latter argument satisfied the Con
vention, and business was proceeded with.

gressional district be authorized to appoint and re
port to this Convention one candidate for each dis
trict on the electoral ticket, and two delegates for
each district to the National Convention, and three
members for each district to serve on the State Cen
tral Committee.

minate and elect by viva voce vote:
1. The Chairman of the State Central Committee.
2. Two Senatorial candidates on the electoral
ticket.

vention.
In accordance with this programme of business,
the Convention took a recess of twenty minutes, and,
on reassembling, the delegates from each <Jongres

The Board of Trade have kindly offered
the use of their spacious rooms, No. 60S Chestnut
street, for the meetings of the committee, of the
greet centra) fair of the Sanitary Oommliiion. The
offer was accepted by the executive committee at
their lact meeting, and the ehairmanof thevarious
committee, will meet there on next Wednesday eve
ning.
Leg Broken.— About 1 o’clock yesterday
afternoon, Owen Mcllwain was kicked by a horse,
in Jones street, above Seventeenth, which broke
one of his legs. He was taken to the Pennsylvania
Hospital,

The Alleged Libel Suit,
The word not having been accidentally omitted In
our report yesterday of the libel suit W. W. Hard
ing vs. Messrs. Diehl, Leidy, Greene, and Fianlgen.
requires a correction. Xu reference to the question
as to baviog received any correspondence from or
through a lady who had been granted a pass to go
South, Mr. Harding replied that he never received
any. The report made him say that he did receive
some correspondence; henoe the necessity of this
correction, because the mistake altered a negative
into an affirmative. The report otherwise Is pro*
corniced by disinterested gentlemen as correct.
Tbe case came up for a decision yesterday. As
tbe Recorder was about to pronounoe it, Mr. E. W,
G. Greene, one of tbe defendants, acting as his own
counsel, desired te make a few remarks. He regret
ted exceedingly that Mr. Harding, the proseontor,
was not present, as he (Mr. G.) would ask that he
be bound over to prosecute this case. It is one of
deep interest to this community—to every lover of
his country, that the line of distinction should be
drawn between loyalty and disloyalty, and that the
latter should be sifted from the former, and driven
*w*y. It is well, sir, that an opportunity will be
afforded to test this matter, should the case be pro*
secuted, for it will enable us to chow our love of
country, and also show how, and by what Insidious
means, stabs are secretly inflicted Into the very
body of one of the best forms of government,
ever devised for the benefit of mankind. It is for
tills result that be devoutly wished that Mr. Hard
ing should be put under bonds to prosecute the case*
For yean past, Mr. Green continued, be bad been
annoyed eveiy now and then by prosecutions for
libel; dragged from his business and taken before
this or that magistrate, and this has generally been
the laat heard of the oases. Now, In this instance,
he was serious; be entertained a fixed determina
tion to bold tbe prosecutor to bis work, and not
simply permit him, upon the simple pretext of libel,
to build an apocryphal character for loyalty. It is
for reasons such as these that he desired Mr. Hard
ing to be held to prosecute.
The Recorder replied that if he did not prosecute
then » suit for malicious prosecution could be
entered against bUu« In regard to the decision in
tbe ease before him, be remarked that, in reference
to the question of law raised by the counsel for the
defence, as to whether the publication complained
of was or was not libellous, was a matter for tbe
judges to decide and not himself. The defendants
will enter bail in the sum of $l,OOO each to answer.
An Affidavit'
The report of the llbsl suit yesterday Incidentally al
luded tour. R 8. Davis is a manner chat, without ex
planation, might cause the impression to be made that
ne was a South Carolinian. As tte hearing before the
Recorder was necessarily e&parte, it is fair that Mr
Davis should be heard. The. following affidavit made
by him will place him properly before the community :

being duly sworn before me. deposes and says that he
is not a native of South Carolina, as has been recently
alleged : that he was born in the city of Philadelphia,
and reared and educated in New England ; that he was
on it e coast of 6outh Carolina during the present siege
of Charleston, for the sole purpose of fnr&isMsg the
Philadelphia Inquirer with the details of the siege ;
th&t he was never in Son’ll Carolina before the Ume
aforesaid, and never wishes to be again ; that the lec
ture delivered in this city by him, on the "Siege of
Charleston, ” was for the sole benefit of the Union
Volunteer Refreshment Saloon ; that to this lectnre he
devoted his time, talents, and money ; that William
W. Harding, Esq , Me employer, gave to him (Davie)
every opportunity to prepare this lectnre for the public,
and paid him his salary as an employee on the Phila
delphia Inquirer while thus engaged ; that the
lectnre to him (D&viO was a pecuniary lose ; that he
has no pecuniary interest in the Inquirer—* matter of
much regret : and that his loyalty consists in support
ing the Constitution and the laws. in having voted for
Abraham Lincoln in 1660, and tbe sincere hope that his
vote may swell the maioritv of the latter in th* next

A Surrender.
a mac, named James Haggerty, was committed
yesterday in default of £l,OOO to answer the charge
of having committed an assault and battery upon
Police Officer Cunningham, with intent to fciii-
Some time since Officers Kilpatrick and Cunning
barn, in tbe discharge of their official duty in the
southwestern part of tbe city,were violently resisted
by a party of disorderly men. Tne m ace of Officer c.
waa taken from him, and be waa beaten in a severe
manner, so much so that bxs life was greatly
jeopardized. The defendant is alleged to be tbe man
who inflicted tbe blows, He fled tbe city. On Wed
nesday be returned and surrendered to the authori
ties.

Alleged. Nuisance.
Four men, giving the names of John Tobin, Mi
chael Keefer, John Guincine, and Patrick Gannon,
were arraigned at the Central Station, yesterday
afternoon, on the charge of maintaining a nuisance
in tbe vicinity of Seventh and st, Mary streets.
According to the evidence, it seems that a number
olladies and gentlemen go to a church in that vi
cinity on every Sunday, for the purpose of teaching
tbe colored children. The pavement is narrow* A
coal-box is located on the sidewalk. Every Sunday
this box is filled with loafers, who seem to be lost
to all sense of morality. Their language is often
obscene and blasphemous, and freely used when
the teachers and other piously-ditposed people pass
that way. There being no room for free passage
between tbe bouse and the bos, beosuse of the nar
row space of the sidewalk, and the loafers stationed
there, the religious persons are compelled to walk
into tbe street to get around tbe obstruction. The
nuisance, therefore, has become so intolerable that
proceedings have been commenced. The four de
fendants were charged with maintaining the nui
sance. They were required to enter bail in the sum
of $2,600 each to await a further hearing.
Pardoned.
Jacob EeDaire, who waa convicted ia the G'emdea
county court of Oyer and Terminer, of New Jersey,
in the year 1856, on the charge of the murder of w.
J. Hatch, and sentenced to an imprisonment for the
term of twenty years, was pardoned on Wednesday.
Denaire was a poor Frenchman, and had gone from
Philadelphia to New Jersey on a gunning excursion.
He was a harmless man, could not understand the
English language, and was entirely ignorant of the
law and customs of New Jersey. He entered on the
farm of Mr. Hatch, near Cooper’s creek, a short dis
tance above the city of Camden, Mr. Hatch being
an excitable man, urove Eenaire away. Hatch fol
lowed for the purpose of taking the gun away from
him. Eenaire finally was driven to the edge of the
lee on Cooper’s creek, when he turned. He was
thus in danger or being drowned. Hatch pressed
op, caught hold of the gun, it went off, and Mr.
Hatch fell dead. Even if he had shot Mr. Hatch in
tentionally, it was art act of self-defence. Mr. Le
naire came to Philadelphia* A reward of $5OO was
offered for hi* apprehension. He was arrested by
Officer Samuel Johnson, of the marshal’s police, but
the reward was never paid . The verdict and the se
vere sentence surprised everybody. Many efforts
were made to get him pardoned, but in vain, for
eight years. *

John Carr, otherwise known as Soapy,was committed
yesterday to answer .the charge of stealing ten dollars
from a nan in the neighborhood of Fourth and Shlppen
streets.

the charge of having entered a bakery down town, and

The case of the Commonwealth vs. Canfield, who was
charged with obtaining goods under false pretences, was
concluded yesterday. The jury rendered a verdict of
acquittal.

general who have, or pretend to have, any right,

and the cargo laden on board thereof, captured by the

the usual hours of hearing causes, then and there to
show, or allege, la due form of law. a reasonable
and lawfal excuse, if any they have, why the
said vessels, their tackle, apparel, ana furniture,

not be pronounced to belong, at the time of the
capture ok the same, to the enemies of the United

liable and subject to condemnation, to be adjudged and
