The Bark A 1,
order Of inege—barliv-alaFer;depositions in re
gardto the Seizure of the bark A 1 were taken yes
terday before Mr. U. S. Commissioner Smith. The
eVidenee Which we present below will be read with
interest, but there is nothing in it to warrant the
detention of the vessel Chief Franklin, of the city
detective force, will be examined today, and it is
believed that his testimony will throw considerable
light upon the affair, and thus solve the mystery.

In the month of December last the bark A 1,
Captain Crosby, was seized on the Delaware by
Chief Franklin and the military authorities ; the
officers, crew, and pilot were ironed and taken to
Fort Mifflin. The stewardess, known as Harriet
Lane, was also taken to Fort Mifflin. The pd.
siemens were confined here sixteen nay % w h en t hey
were released by an order issued by the Hon. Mr.
Stanton, Secretary of War. The vessel was also
released, and a clearance having been given by the
Collector of the port, the vessel started down the
river. Her cargo consisted of eleven 11-inch guns
and three thousand shell, shipped by the Govern
.ment, and thirty eight tons of powder, shipped by
the Messrs. Dupont, of Wilmington, Delaware. The
balance of the cargo consisted of seven hundred tans
of coal and some other things. The vessel was
owned by a Mr. Hall, of New York, and her desti
nation Was San Francisco, California.
Upon information lodged by Chief Franklin, or
the detective force of the city, with united str.tes
District Attorney (Jolley, the court, upon aePros
tion of its law officer, issued a process for the re
seizing and detention or the vessel. Theattachm nit
was placed in the hands of United States Dsp.ity
Marshal John Jenkins, and this officer, a few days
since, seized the bark A 1 in the Delaware, near
Chester, and detained her.
The subject was brouset to the notice of Judge
Cadwalader in the /idol] all - Court, and his Honor
directed the necessary p.dhlavits to be taken ueon

elicited :
Harriet Lane, the stewardess of the bark
.A 1, was
Called to the /tend. On being sworn, she testified
that she resided at No 56 Pike street, New York;
- N ina, born in England; on Monday the 7th of De
cember last, went to bin. Davis, shipping master in
New York, No. 111. South street, and asked him if
there was any vacancy for her; he said he wanted a
good stewardess to go to San Francisco; I asked
him the terms, and be said that he would telegraph
to Philadelphia and let me know the next day; be said
that Capt. Crosby would be in New York in a day
or two ; Capt. Crosby came on the following Wed
nesday ; I agreed to go with him as etewardess of
the bark A 1; went to the shipping office of IVIr.
Davis on the following Friday morning; Mr. DAVIS
went to the oars with me at noon on that day, bade
me good bye, and tel.: me to write to him when I
reached San Francisco ; he told me where the bark
A 1 was lying at the port of Philadelphia, and gave
me the address ; this address was taken by - Officer
Franklin when the back was seized in the first place,
And letters from my brothers in England, children,
And lady friends were Alm) taken by Officer Frank
lin ; also a letter front .Toseph Castor, the steward
of the steamer Eliza Clyde.
A letter was here shown dated at Wilmington.
This letter was written at Wilmington, Del., and
not North Carolina.
The witness continued : The photograph of myself
and friends, was also taken by Officer Franklin;
when I was coming from New York to Philadelphia
a lady occupied a seat alongside of me ; she C9M
menoed talking about the war; I said it is a bad
business ; I also said that I thought England was
greatly influenced by Mrs. Stowe and her works ;
told this lady that I did not believe the worin of
Mrs. Stowe ,* she disagreed with me, and left the
Peat ; a gentleman sitting behind me said the con
ductor of the cars wanted my ticket ; I gave my
ticket up, and the gentleman remarked that mylsdy
friend had gone ; I replied yes ; he then said teat
she was going through the care in search of rebels.

rebel than she.”
This gentleman asked me if I did not hear Mr.
Davis say I was going to San Francisco. I replied

"Are you going to Philadelphia'!" said he.
" 'gem," I replied.
He then said that he was master of a steamer,
and he did not know of any going from Philadelphia
to San Francisco.
I replied that I was going in a sailing vessel.
He asked me her IMMO, and I replied "d 04e."
He then bunt out laughing at me. I asked him the
reason svhp he laugted, and he said, " That's no
name at all."
He asked me to let him nee the address; I showed
it to him; don't recollect any other conversation
bad at that time.
When I arrived in Philadelphia I went on bo trd
of the bark A I ; this Was the 12th of December ; I
never said in conversation with any one anything
about the Chesapeake ; I never said that I was on
the Chesapeake ; I dal not ask the gentleman in the
ears if he was a Soutnerner ; he did not tell me he

I never said there would be a vessel seized in the
Delaware to any one ; I made my own agreement
with Captain Crosby to go to San Francisco ; I
came to this country in 1851, and went to my brother
in Indiana, then went beck to England; from there
went to Australia and back, with four children, in
1868; went from London to Prussia and Denmark;
.1 there got into the La Porte trade; I shipped in
Bombay then to New York ; I made my home more
in New York than in England ; I shipped in the

boarded at the Sailor's Home, New York; have sailed
in the Mont Blanc to Bermuda; this was in Nevem.

vessel would be captured ; don't know how I fell on
the cats at s2tilentown ; I have never taken passage
on any vessel to run the blockade ; never tied such
&proposition made to tau; 1 shipped with North-wn
men ; I told Capt. Crosby not to call me Mary, hut
to call me Harriet Lane he said that made no dif
ference • when I was seized I was put on boari a
steam•tuv, and detained ono night before going to
Fort Militia.
The witness underwent a long cross examinati
conducted by Mr. Clus'l7r, ramtly in reference to the
treatment the captives received. On this anbj.mt
Mr. Ouyler commented with great severity.
The hearing adjourned, and will be recommen fed
to•day. It is expected that Chief Franklin wilt be
examined.

Challenge to Fight—Assault and Battery
A. ease of more than ordinary interest came up bra
fore the police magistrate of the Fifth ward yester
day afternoon. Captain Cushing, of the military,
and E. M. Sheppard, were arraigned on the charg, of
challenging B. C. Alejor, the proprietor of a drug
store at the Continen , al, to fight. It seems that :dr.
Major was attacked by severel parties, some of them
in military uniform. able was a night or two since,
while he was walking aioeg the street. It is alleged
that Capt. Cushing sent a challenge to Mr. Maier,
and that Mr. ieheppard conveyed it to the
challenged party. iiir. Major took no par
ticular notice or it. On Wednesday night, as
he had just entered the Continental, he was sudden
ly assaultedby Captain Cushing, who called hie), a
coward for not accepting the challenge. There were
some other epithe , s, that we decline publishing,
used at the same time. In a moment four or five
persons made an attack upon Mr. Major with 100 lea
canes, but he escaped without serious injury. Cap
tide Cushing was required to enter bail in the sera
of $2,000 to answer. Mr. Sheppard in the sum of
$l,OOO, to answer. There was another party ar
rested, who was held to ball for a further hearing.
What gave rise to the quarrel was not publicly
stated. The law in reference to challenging parties
to fight is as follows :
Section 25 revised penal code: If any person with
in this Commonwealth shall challenge another, by
word or writing, to tight at sword, rapier, pistol, or
other deadly weapon, or if any person so challenged
shall accept said challenge, in either case such per
son giving or sending or accenting any such chal
lenge shall be guilty of misdemeanor, and being Con-
Visited thereof shall be sentenced to pay a fine not
exceeding five hundred dollars and to undergo an
imprisonment by separate or solitary confinement;
at labor, not exceeding three years.
Section 26 provides that if any person shall carry
or deliver such challenge, or vernally deliver a mes
sage purporting to be a challenge, or shall consent
to become a second in any such intended duel, he
shall, upon conviction, be fined not exceeding $6OO,
and imprisoned not exceeding two years.
Section e'r provides that if any person shall know
of any such challenge, and keep the same secret,
and dote not inform the authorities, he shall, upon
conviction, be sentenced to a fine not exceeding $5O,
and imprisonment not exceeding twelve calendar
Months.
Section '213 provides that if any person shall send
a challenge, and proclaim or puolish the challenged
party as a coward for not accepting the challenge,
he shall, upon conviction, be sentenced to pay a fine
not exceeding $5OO, and undergo imprisonment not
exceeding one year.

Mr. E. Lippincott, a respectable citizen, was ar

ternoon, on the charge of disorderly conduct. It
seems that, at Filth and Chestnut streets, the de•

ger cars into the street. Considerable excitement
prevailed, and Officer Crooks interfered, and ar
rested the conductor first, but let him go and took
Dlr. Lippincott into custody. The defendant was
held to bail in the sum of $5OO to await a further
hearing. Mr. John Smith, with other citizens,
being present, told the officer that he ought to ar
rest the conductor, cud not Dlr. Lippincott. For
this offence Mr. Smith was arrested on the charge
of interfering with the officer in the discharge of
his duty. The defendant was held to bail in the sum
Of $4OO to keep the peace.
A man of citizens were present, and, from their
talk, it seems that the conductor of the car was not

tent of indignation, served the conductor in the

ous wards, for the purpose of adopting measures to
procure a uniformity in the amount of bounty to
be paid by each ward, Daniel Steinmetz was called
to the chair, and John K. Valentine appointed Beare.

Resolved, That this meeting recommend that a Ilai
fona bounty be paid by the various wards of this
city, and that each ward shall pay the sum of $5O to
every recruit who shall be mustered into the United
States service, and duly accredited to the ward.
Each ward that has agreed to pay over $5O bou ity
was requested to-call a meeting before next Tuesday
evening, to take action on the above resolution, ex
cept such wards as bad already given their execu
tive committee power to act in the premises. And
those wards not represented were requested to send
delegates to the next meeting, which will be held
on Tuesday evening next, February 2d, at 8 o'clo
in the Board of Trade Rooms.

Mr. Coverly has lonabeen one of our leading citizens,
and up to the time of his death held a prominent posit Eton
in Harrisburg. Up to three or tour years previous to hia
death he had been proprietor of ono of its leading hotel&
ana durum this time had a largo interest in other hotels
of Harrisburg. Mr. Coverly was a son.in.law of Wil
liam Colder, Sr.. who for fifty years before his death
was the wealthiest resident of Harrisburg. The funeral,
which ok - place on. Tuesday. at 2 o'clock P. M was
well attended by the friends and relatives of the de
ceased. The services were coedact.d by the Rev. Wil
liam De Witt, Sr., and Rev. Thoinae Robinson, both of
that chy.

The Honorable 'Secretary of War has authorized

ignip a special force for Garrison. Provost Guard, and
other duty.
Men of good character and unexceptionable habits,
who can bring good recommendations from reliable citi•
zone in the portion of the State where they may reside,
have now an opportunity rarely offered in the military
service.
A number of competent Clerks, Musicians, and Pri ut
eri, as well as Carpenters and other mechanics, will be
required for special duties.
