duly proceeding on a Libel filed in the name of the
United States of America, hath decreed all persons in
general who have, or pretend to have any right, title, or
mterestin the schooner Brilliant, whereof D- D. Sim
mond was master, her tackle, apparel, and furniture,
captured off the coast .of North Carolina by the United
States steamer Daylight, and brought into the port
of Philadelphia, to he monished, cited, and called
to judgment at the : time and place underwritten,,
and to the efiect hereafter, expressed, (justice - so
requiring.) You are therefore charged, and strictly en
joined and commanded, that you omit not, hut that by
publishing these presents in at least two of the daily
newspapers printed and published in the city of Phila
delphia, and in the Xepai Intellige.nceri you do monish
and .cite, or cause to he monished and cited, perempto
rily, all persons in general, who have,ovpretend to have,
•any right, title, or interest- in the said schooner Bril
liant, her tackle, apparel, and furniture, to ap

GREETING:
WHEREAS, the District Court of the United States in
and for the Eastern I'istrict of Pennsylvania, right'y and
duly proceedingou a libel, tiled in the name of the United
States of America, hath decreed all persons in general
■who have, or pretend to have, any right, title, or inte
rest in the schooner Time, whereof William. Poland
was master, her tackle, apparel, and furniture, and the
foods, wares, and merchandise laden thereon, captured
y the United States steamer Cambridge, under com
mand of : off New Inlet, one of eke channels
leading into Wilmington, North Carotin v and brought
into this port, to be monished, cited, and called to judg
ment, at the time and place underwritten, and to the ef
iect hereafter exprjssed, (justice so requiring.) You are
therefore charged, and strictly enjoined and commanded,
that you omit not, but that by publisuing these presents
in at least two ot the daily newspapers printed and pub
lished in the city of Philadelphia, and in the Legal In
, tellioenctr, you do monish and cite, or cause to be mo-i,
nislied and cited, peremptorily, alt persons in general
who have, or, pretend to have any right, title, or inte
rest in the said schooner Time*'her tackle, apparel,
and furnituie, and the said goods, wares, and merchan
dize laden on board thereof, to appear before the Hono 'a
ble JOBN CADWaLADER; the Judge of the said Court,
at the District Courtßoom, in the city of Philadelphia,
ou the twentieth day after publication of these presents,
if it be a court day, or else on the next court day following,
between the usual hours of hearing causes, then and
there to show; or allege, in dne form of taw, a reasona
bleand lawful excuse, if any they have, why the said
schooner Time, her tackle, apparel, ; and furniture,
and the goods, wares, and merchandise laden on
board thereof should not be pronounced to belong, at
the time of the captnre of the same, to the enemies of the
United States; and, as goods of their enemies, or other
wise, liable andd subject to condemnation, to be
adjudged and condemned as good and lawful prizes;
and further to. do and receive in th s behalf as. to
justice shall appertain. And that you duly inti
mate, or cause to he intimated, unto all persons
aforesaid, generally, (to whom by the tenor of these
presents it is aso intimated,) that if they shall
not appear at the time and place above mentioned,
or appear and shall not show a reasonable and, lawful

may pronounce that the said schooner Time, her
tackle, apparel, aDd furniture, aud the said goods, wares,
and merchandise Ihden on board thereof, did belong, at

or otherwise, liable and subject to confiscation and con
demnation, to be adjudged aud condemned as law
ful prize, the absence,' or rather contumacy, of the
persons so cited and mtimsted in any wisA-notwithstand
ing, and that you duly certify to the said District Coart
whntyou shall do in the premises, together with these
