TEM. SIIBRIFF CONTBSTED- ELECTION
CABL—The argument in. the contested-election case of
Thompson vs }:wing was resumed yesterday morning. ,
Mr. F. O. Drewtter, In continuation of his argument
cotemenced , the day previous; called the attention of the
court to the fact that, in reference to the answer of the
restoudent, no evidence at all had been given under one
hundred and seven specifications. He also adverted to
the equally patent rout, that in Support of c"-rtain speoln
cations' ell#ping the reception of illegal votes €, to the
number of nine and upWards," one witness only had been
called, and in many similar instances the witnesses did
not testify that they voted for Mt. Thompson, and there
wasno proof of their disqualification to vote.
Mr. Brewstit's argument, on the day previous, was
generally confined to a supervision of the evidence offer
ed, or attempted to be offered, in support of the first
thirty-seven sped [buttons contained in the respondent's
answer. lie referred, in ouening, to the decision deliver
ed by Mr Justice Woodward, of-the Supreme Court, in
the case of a contested election for District fittorney of
Lozerne county ' and held that uo distinction could be
drawn from thatordoion bet,seen the votes .cast outside
of the State and there cast at Easton.
He continued : We stand, therefore, upon the face of
our return, thus corrected by n decision of our Supreme
Court, with a rusiority of 146 votes for Mr. Thompson;
and the subject for discussion now Is, bow is that certifi
cate to be met—how is that majority to ho overcome
.?
Our friends on the other side have given us, inclusive of
fractions, 200 specifications. Your honors have stricken
out twenty-nine of them Our friends have seen fit to
offer evidence under sixty-four, but they have actually
omitted to offer any evidence under 107 of those which.
they regarded as material to the proof of their case. 'Un
der the first specification there has been no proof offered
at . all. : Cyder the second, it was charged that Mr.
Thompsokliad received twenty-two votes to which ho
was not entitled, while all the evidence showed that he
was entitled to that number. No paper among those pro
duced gave him 4' tete number. .1 have, therefore, marked
No. 2 disproved."
Frozze's sumo ing up and sifting of the evidence, it was
sipareit'llat 'no proof had been offered to eustain the
third, fourth, ar.d fifth specifications. The sixth charged
that Robert Ewing 4 , 13 &hely returned as having 144
votes, when he was in fact entitled to 145 votes.” The
tally papers gave Mr. Ewing 146, the hourly return 145,
while the Walt as per geuerut return, was 144. This
was the evidence in sup port of that specification. - Under
specification 6g, it we charged that,' In the Fourth pre-'
dud cf. the Ttielth Want, Robert Ewing received three
votes which werestaken and counted in the general.re.
tarn for John Thompeon. Two witeesses — were exam- -
ined; butno proof was adduced fa support of the Charge.

votes in the Second division of the Nineteenth ward,
vbile.only 157 were credited. to him, was not proved.
The hourly paper gave Mr. Thompson 109, Mr. Ewing
157 ; the general return, Thompson 109, Ewing 147.' No
tally papers were produced, and, consequently,. the
specification stood before the court upon paper against
paper.
Of the remaining epecitioatione, np to the thirtree
'Mob, 6 great majority of thorn were not proven, while a
few would be left to the determination of the court.
At halt part two o'clock yesterday the court adjourned.

TERRIBLE ACCIDENT ON THE BALTI
MORE RAILROAD LOSS OF LlFE.—Yesterday
morning, about one o'clock, a collision occurred on the
Philadelphia, Wilmington, and Baltimore Railroad,
about bai l fast three o'cloc k, which was the canoe of a
terrible -accident • whereby( a number of soldiers were
killed and some very dangorousty wounded. •A short
time before one o'clock, yesterday morning, a through
freight train for Baltimore left the depot at Broad
and Washington streets, and when a short distance below
Gray's retry Bridge the train became disconnected, and
the road was, as a matter of course, temporarily ob
ettncted by the Cara. A special tr ain with troops was
fcllowing close behind, and, when the accident occurred
a man wee sent back, with a lantern, to warn the special
train ;.bnt in consequence of the heavy fog which then
existed, the engineer of the train containing the troops
did not tee the signal until too late to prevent the until
elfin. Ile immediately reversed the engine, but the trains
:collided. Eminent ly, noi,persou was eieriouslythart by
the collision.
l'Tte troop train had on board the 37th Massachu
setts Regiment, which came , through on Monday night;
a squad of recruits for the 13th New York Regiment,
tinder Lieut. Minch ; one hundred and four men of the
Philatiel.yhia Provost Guard, under Lieut. Leobler, and
one hundred men of the 131 h Pennsylvania Cavalry,
under Copt McOmen. The commando of-Capt. McCann
and Lieut. Lechler had been ordered, according to a de
spatch received from General Wool, ou Monday evening,
to 'guard the railroad and bridges between. Perrysville
and Staunton, on the line of the Baltimore Reelroad.
They were under the command of Adjutant General
Freese, and were proceeding upon their errand at the
' time of .the accideat. • •
The wreck of the two trains desoribed completely ob.
etr ucted the track, and Information of the accident was
_ telegraphed be the depot.
At bait past three o'clock yesterday morning If special
train, having - upon it a equa4 of one hundred cavalry
men;started South trom the depot, at Broad and Wash
ington streets, and the engineer was imurncted to take
another track, eo as to avoid the obstruction. By some
unaccountable carelessness, or misunderstonding, the
engineer went upon the obstructed track, sod he ran
into.the•Avro trains which were already wrecked. The
easineer'of the third grate saw the lights about the wreck,
and clieblerd the speed of the locomotive, but the collision
was, nevertheleeri, 4 very severe, and the consequences
. rook disastrouri. The cars were broken to pieces, three
meti were killed outright: and a number were'more or lees
wounded.' . .The dead were a r entangled with the wreoklof
the cars that a considerable time 'elapsed before their
bodies could be extricated. • •
Lieutenant Lechler immediately returned to the city,
and Ciptain Hera, the rtectitst marshal, having been
notified, he and 'Dr. Neill at once proceeded to the'seetie
of the accident. The bodies of the dead.and the wounded
were Immediately conveyed to the • Summit Hospital,
where an' iLdneet xi 1 be held in" the-case by Coroner
oenreid.
About eight o'clock, yesterday morning, a member of a
New Yotk regiment, who was at the scene of the die
eater,' deliberately drew , his knife and inflicted- injuries

or delirium se - the time. He was conveyed to the
Hospital.

The consideration of the report gave rise to a lengthy
discusetim.' - •
Idr. Leech said,that the' report vraa one of the most
undigrofted ever preeented to this Board: 'Efe spoke with
a knowledge of the facts, when he said that the contracts
were given out regularly to the lowest bidder. Ile also
said that warrants en the Oity , Treasnrer bad been sign•
ed by the presideittof the Board before the contracts bad
beer, carried out. '
Mr. IlAlingeworth thought there ware too many
charges in the report to ack upon it immediately: The
community nill require an explanation of themanner in
which these contracts have been so recklessly given out.
Mr Potter eaid that there was no design t' do injury
to any person, and the truth was only to be ferreted out,
add if any man suffers thereby, the community will be
the gainer. It was unfair, then, that there eliould be an
attempt to throw disrepute upon the report, and draw the
attention of the Board to extraneous matter, such as the
signing of certain warrants by the Pregident, &c. •

spirit to do, injury to somebody, and that efforts wbro
made to prejudice the minds of the Board. There was
no fairness in it, even to a disinterested parson. He did

There appears to be a dieposition among some members
to continue dispptee, and bring the Board into contempt.
If-tbe' "Reform Party" 'proceed in this manner much
longer, the public will have good reason to demand that
this Board be &belief:ed.

nation and recrimination. Parties should not bring for
ward their schemes, but work harmoniously and cor—
dially for the public good.
The discussion partook of a partisan character between
the friends of the old Committee on Property anti the
new Committee on Property.
Finally, the.report. after an unsuccessful attempt to.
have it postponed, vas adopted.
Mr. Hines offered a resolution that a committee o
Lino be appointed to prepare an estimate of the probable
expenditures of the public schools of the First district
for the next school year. Agreed to.
Mr. Moilit introduced a resolution to grant permission
to open a primary school in the southwestern part of
the Nineteenth section. Adopted.

learn by a despatch from Washington. Col. Lewis is a
Philadelphian. At Winchester, Port Republic, and on
several other racially memorable fields, whore his regi
ment fought gallantly and suffered severely, he so;con
ducted himself as to win the confidence alike of superior
cflicere and men. We bre not aware of the precise bri
gade to the command of which tie has boon' summoned,
;but presume it will be that of the late 001: ()stroll, re
cently wounded by a rebel picket. In common with a
'host of friends, we hold the conviction that 001. Lewis
will establish for himself a proud reputation before' the
war is endtd.

Recorder Emu, in the prosecution instituted against uc

you can get a bearing before a judicial tribunal,. we feel

the new levies of volunteers and militia of the United

Dyspepsia bail the following symptoms :

severe and obstinate.
