A n Interesting Libel Suit—The
DEPENDANT PLEADS Die OWN CASE.— Yester
day morning, the bearing in the case of E. W. 0. Greene,
chargtd with having published a libel npon Benjamin M«

Frederick C. Brightly, Ksq., and Mr. Edgar C. Chipman,
appeared as counsel for Mr. Dnsenberry. Mr. Greene,
the defendant, arred as his own counsel.

Mr. Chipman testified to having been introduced to Mr.
Greene, about a year ago, as editor and proprietor of the
Sunday Transcript.

Mr. B. thi n read the Alleged libellous article, and asked
further, that Mr. Gjeeue be placed under bonds for his
good behavior. Be remarked that the paper hail been
grossly libelling for years past, and if the libel was re
peated against Mr. Dusenberry while this prosecution IS
ptiiding, ho intoudod to suo out thu repoguiuabed.
Mr. Greene then asked if Mr. Busenberry was not to
he placed upon the stand, and received a negative ie
aponse. lie then said he had ft few remarks to make.
He considered this mutter entirely too small for a man of
any ordinary sense to deal with, and contended that to
hold a man justifiable for libel or any crime, it um&t be
unequivocally proven that he was a party to its oooi
rnitfsion. This had not been done iu this case. Oue wit
ness had testified to having been introduced to him as
editor and proprietor about a year ago, and tbo em
ployees had seen him about the place. None of these
statements, however, proved his connection with the
paper. The speaker then referred to the caso of Alexan
der <St Scott, cf the Daily CAro«id<, several years since,
iu which Mr. Scott, wag convicted, under a direct charge
of Judge Doran, and Mr. Alexander was acquitted,
because it was not shown that he was connected
with the paper, although his name did appear at
tbe head c-f It as one of the proprietors, lie had
hoped that Mr Dnsenberry would have been called as a
witness, to stand up iu his own defence, and say whether
or bot tuc churls nmilu iu tbe article were true. Air.
Grceno then proceeded at length with tho a unarm in
which he would have propounded to Mr.. Dnsenberry, to
show the tiutb or falsity of the article, aud denounced
Mr. Dnsenberry, the Board of Control, Committee on
SuppMts, ai d Committee on Text- Books in severe terms.
He said that the object of tliis prosecution was to defeat
the bill now before tlie Legislature to abolish the Board
cf Control, but it would not succeed. Ho did not admit
that he had any connection with the article in question,
but he considered it justifiable, and under tho Constitu
tion of rennsylvania tho acts of public men were legiti
mate subjects of coutueut.
Mr. Brightly concluded for the prosecution- He
ihpnglit that iHhtn twi Wen any doubts atioat Mn
linene being the author of tho article in question, these
doubts were dispelled by the speech of Mr. Greene. The
reason that Mr Dusculierry was not placed on the wit
ness-stand was, that he was ignorant of.auy circumstan
ces which would have been of any benefit to the prose
cution.
Mr. Greene was thou held in 53,000 hail to answer at
court.
Another Postponement.— The con
teeted* election case of Stevenson vs. Lawrence was ex
pected to come up yesterday iu tlio Court of Common
Pleas, but upon the gening of the court, Mr. Conarroo
niggeetod that as the qut&lton of the cobfeliluttonftlitj' of
the ormy vote had been lair before the Supreme Court
lest week, and had been fully argued there, and that
court might be expected to give ft decision on the subject
nt an early day, it would be iwinently proper to postpone
further action until that decision.
If they decided the law unconstitutional this case would
-irtwlly le H« tnmTorf promised that Use case
should be adjourned until such time a» the Supremo
Court's decision Should be given, provided that be within
three or lour weeks. If necessary, after that decision is
made, couneel ohu come into court and Agree upon an
early day for the hearing of the case. The case was
accordiDgly to postpone.!, ail parties assenting.
Jodgc Thompson now announced that tbo court would
lie compelled to adjourn the heading of tho Orphans 1
Colin list to some future time, owing to the foul atmos
phere of thu court room. During the session of the court
last week, the judges were seriously affected in health by
the stench from the cellar of tho bui'diug, aud complaint
had been made to tlie proper authorities. The evil had
teen remedied in part, and tho judges wero not inclined
to sit iu tho court-room until the nuisance was entirely
abated.
The court then adjourned.
The Condition, op the Streets.—
The filthy condition of our streets is a subject which de
rounds ft?' piwipt attsHtton of the authorities, Merer
before, in our city, was there such ft vast collect! ju of
garbage and filth of all kinds. Already is the effect be
coming evident in the rapid increase o! sickness iu many
cf tho districts; and now, that warm weather is so ra
piely approaching, it behooves us to take measures to
secure the health of cur citizens; but Couucil* seem to
think there is no necetsDy for haste. When the ordi
nance making Ike annual appropriation to the Highway
Department was passed, tho item of 850,000, for cleansing
the streets, was stricken out. to the money will uoi go
iuto the hands of contractors for unperformed work, as it
lias in former years. When the it» m was stricken out, it
was proposed that a department should be formed for the
exclusive purpose of cleansing tbe streets 5 but this plan

It Li&s been proposed to form a company lor removing the
dirt, at a less amount per annum than charged by con
tractors, and, at the end of ten years, to do i'. without cost
to the city. This was also laid aside by (Jouucil3. Seve
ral applications were made to the authorities lait week,
by certain of our citizens, t<j know if they could haye the
dirt in Iront of their premiaeMf 1 amoved at their expense.
No permission, however, could be givcu by the officers
applied to. Thus, amid the various delays, oar citizens
ere beginning to sutler. '* he increase of sickness, in tho
upper pait cf the city, has been laid to the use of tho
Delawaie water: but intelligent physicians say it is
11 ainlj due to the poisonous arising from the de
couipotitfun of antrual and vegetable fmtt.er thrown in the

Iu most parts of tho city, the scavengers have not
made their appearance for many mouths, and the accu
mulations of tbe winter lay iu unsightly heaps, offending
sight and tiueii. aud sending off unwholesome miasmatic
exhalatic i:s. 'While the streets continue lhs
nsb barrels and boxes of citizens remain un emptied for
weeks 11 a time, encumbering tho side-walk?. and causing
every bmze to be laden with Hying clouds of ashes, to
the great damage of tbo eye-sight and clothing of
pasters by.
Miscarbied Letters —A eorrespon

boxes, is attributable to tne want of ii,formation on the
port of t) o public in relation to post office stamps. Only
one- penny stamp is required for a letter, either dropped
i>i the boxes on tin- comers, (ft left at the post OlficVitJ
wnC it to au>* port of the city. If the letter is rtiro*ted
out of the city, as a matter of course, a throe-cent stamp
and a oue-cer.t stamp is necessary if dropped into a cor
ner box. If left at the post-office, a three-ceut stamp is
sufficient. When a letter is miscarried it is generally the
fault of tbo writer or sender, as we see by the last annual
Tryorlof the Po&tma&ter General, that the result of suc
cessful investigation in 7,560 cases confirms the past ex
perience of the department, that the failure of a letter to
reach its destination is, in the vast maj -rit> of instances,
the fault alone of the writer or seuder. Out of tbo above
7,660 dead letters. 3,005 were directed to the wrong oflico;
467 wore imperfectly ador*3sed; 612 were directed td
transient peistms*, 257 to persons who had cJiaugad their
residences; 82L were addressrd to fictitious persons or
firms; 83 were uncalled for; 10 without any directions;
2,136 were not mailed lor want of postage stamps; 79
were nu&sent: and for the failure of postmasters to de
liveries no s:,ti&facti>ry reason was assigned. .The de
partment, Uitrtforci tun justly be held rosponsiblefor the
nou-delivtry of but 212 of those letters. The now system
nt c.ty delivery works well uuder the admirable manage
ment of Postmaster ’VValborn.
Open ik g op the Canals.—The
eastern division of the Peunsj Ivama Gnunl wiU probably
tie reedy to-day for tbo passage of boats, the water
having been admitted some tiine since.
The Snsnuehaniia Canal, north of the junction, will
soon open navigation, giving transportation from the
coal regions to tide water earlier than usual.
Ihe Juniata Canal will be open about the first of
April.
The Tld6 Wider Canal will be open and in navigable
order by Thursday.
The retes of toll on the Delaware and Raritan Canal
have Lem reduetd 15 cents a ton, and the rates of freight
to New York, it is thought, will open at $1.39 to New
York and 55 to Philadelphia, from Port Carbon and
mount Carbon, and $1.25 and 50 from Schuylkill Haven
i<j J!t,w Vorfc at-d Philadelphia. Roth carrying compa
nies allow a drawback on all coal east from Phila
delphia to meet the rates promulgated by the Pennsylva
nia Coni Company, but the extent of this drawback is
only known to the trade.
The Union Canal will commence navigation this week,

FLECTION CASE.—Yesterday, in the Supreme Court,
Justices Woodward, Thompson, Strong, anil Bead, this
case (b. Weller et al vs. E. 15. Coiling*} was again up.
It wid be remembered a petition'contesting the election
of Mr. Callings was filed four daj a after the count of
the aimy vote, and thirty-five days alter the day of elec
tion ,
A motion was made before Judge Couyngham to dis
miss the petition on the ground that it hail uot been filed
within ten days after the election.” The court at Lu
zerne did dismiss tbo complaint for tins reason, and a
writ of certiorari whs taken to the Supreme Court
Yesterday morning the Supreme Court affirmed the de
cree of Judge Conyngham, but the court was equally
divided on the subject. Au opinion will bo filed here
afttr.
Robbery.— Yesterday morning Clias.
fipilcan and his wife, Elizabeth, were before Alderman
King, of fiermanbwn, upon ihe charge of larceny of u
number of aiiiclts of clothing, Ac., the property of Dr.
Ash, who b asurgoou in tho army, and rtpon leaving home
deposited his movable property with Mr. Samuel East
burn for safe keeping. Spilcau and wife were In the em
ploy of hlr. Karttburn. Mr. Eastbum suspected them of
nnothtr matter, and a house in Hermann street, which
they had retently taken, was eearaied. There some of
the articles btluugiiig to l>r. Ash were found hidden
away. The accused were held to bail for a further
heating.
Badly Burned.—s catevUay morningj
about quarter past one o’clock, a fir* uccurrM at ti»e
New England House, on Dock street, above Spruce. The
fiamcß originated from the stove, and cominmicntivj to
a bod upon which a woman named Elizabeth Yimng
was sleeping. In attempting to extinguish the flames,
she wag badly burned about the head and body. The
damage to the building was about $76.
Arrested.— James Maloney and Clias.
Fupplee were arrested, in the Twentieth ward, upon tho
charge of having stolen a trunk containing $2OO in
money, the property of James Farrell, residiug in Ridge
avenue, above Columbia avenue. The accused were both
comm ji ted lo answer.
The Tonnage Tax.—A substitute
for the bill restoring the tonnage tax h-m been offered in
the Legislature; authorizing ihe Attorney General to In
stitute proceedings in trinity, in the name of the Com
monwealth, against the Pennsylvania Railroad Company,
for the purpose of testing the constitutionality of the act
repealing the tax.
Liberal Bequests.—From wills just
recorttri wo learn that James McAller, deceased, makes
tic following bequests: $5O to the Seminary of St.
•Charles Borrouico, $5O to the Males* Orphan Asylum of
.St. John’s Roman Catholi- Church, and $5O to the Or
phan Asylum of St. Vincent de Paul.
The Constructor op the Monitor.

a chief engineer of a special department of the navy for

this city.
Passengers During a Tear. The
total number of passengers carried over the Pennsylvania
Central Railroad, during the year 1861, was 1,059,08 k,
each pnpwnger travelling an average distance of nearly
68 2-10 miles.
Meeting of Common Council.—A
special meeting of Common Connell was held yesterday
afternoon, for the purpose of considering the bill appro
priating a certain sum to the Controllers of Publio
Schools. « . «
Council resolved Itself into ft Committee of the Whole*
Mr. Freeman in tho chair. The following changes were
made in certain items of the ordinance *.
For repairs in the Seventh section, $5OO in place of
$250.
For furniture iti the Seventh section, $550 in place
of $2OO.

For repairs in the Sixteenth section, $3OO in place
of $2OO
For furnaces and stoves in the Sixteenth section, $6OO

Barger, the former urging the reduction. Finally, tho
amendment was dropped and the first mentioned sum

raised from $2OO to $3OO.
Tlie item for repairs In the Twenty- third section was in

Item 218, for $325 for porterage on books, was struck
out altogether.
The item nppropriaaing $4OO for carriage hire, Ac.,
for the Committee on Property and grammar schools, was
stricken out on motion ol Mr Cattell.

Celebration of <3t. Patrick’s Day.

was clear and pleasant. During the morning, there wero
no clouds or-signs of rain, but in the afternoon tbe sky
daikened, and occasionally a few flakes of snow would
fall. The celebration of tho day was not as marked as it
lias sometimes been in tho way of military displays,
owing to ihe fact that all onr Irish volunteer companion
uro now oiififtged in tho defence of tho sta. s and strlpes.
Beligi msly, the day was commemorated with zeal and
spirit. St. Patrick’s Church, in Tweuiieih street, was
crowded to excess in every part. Pol tilioial high mass
was celebrated, lU. Rev. Bishop Wood officiating. The
main altar was handsomely decorated and lit up in
gorgeous stjle. The performance of the choir was
creditable to those who participated. It comprised the
principal ningtrs of all The Catholic choice of the city -
Tho contralto part was ably and gracefully carried out
by the talented, lady who performs the same part in St
Joseph’® choit. Haydn’s Grand Mass No. 3 was given
with a full orchestral accompaniment, under the direction
of Mr. Alcdo.
Before the sermon, the Vtni Creator Spiritui was
most exquisitely given.
At thu Offwtorp. 11 quartette from Domini was per
formed. entitled O fralutaris J[ostia* It was tho gom
of the exercises, and was suug by the Missus E. and C.
McCaffrey, of St. Augustine’s, as first nod seceud so
prano, Mr. J. Burke, of St. Patrick’s, as tenor, and Mr.
T. E. Harkins, of St. John’s, basso.
The sermon or acldr* ps was delivered by tho Rev. B.
Mflpuire, ol Washington city. It was an eulogy of St.
Patrick, and was moat eloquently delivered.
The Papal beneciction was pronounced by the Bishop,
after it had been announced and explained by the Rev.
Mr. O’Hara, pastor of St. Patrick’s Church- It was re
ceived with deep devotion by the vast congregation.

J., ha* just been launched. The vessel is 213 feet long,
h*r breadth of beam 2t> feet, depth of hold 11 feet 5
inchfß, and draught of water fl foot 0 inches- Her build is
similar to that of the Attaint, launched from the navy
yard last November, being fiat-bottomed, with a rudder
ate-ch end, guarded by an-iron cutwater. This con
struction will enable her to onter narrow rivers or iolols,
and retire from ihens without the necessity of turning.

morning Detectives Levy and Wrigley received Informa
tion that certain pickpockets were operating ut a funeral

A Fkeleton Found.— Some excite
ment was ci oated yet terday afternoon by the discovery of

of No. 419 Sou»b Eleventh street. It was subsebuently

Increasing.—The subscription in aid
of the erection of tho Bishop Bowman Memorial Church
new amounts to 53,597.46.
About Crossing a Riyer. —Dr. Bellows, of New
York, in his sermon on Sunday, gave an account of
an interview with the President. The Doctor asked
what should be done with the slaves that were cap
tured as the army advanced. The President hesi
tated a little, and then, according to custom, related
a story, or as it might be called a parable. He said
that a company of clergymen, being.once at a con
ference, suddenly received the intelligence that a
bridge, by which most of them had to return home,
had been carried away by a freshet. Upon this
they stopped talking oa religious topics, aad began
debating upon how they could cross the swollen
liver. The old-fashioned minister, however, was ob
served to keep entire silence throughout the contro
versy, and, after wasting hours in useless dispute,
they asked the old gentleman why be did not give
bis opihlOfc. 11 My brethren,” said be, “I have
lived a great many years, and I never yet have been
able to tell how I should cross a river until I came
to it.”

Tins increase is very near 50 per cent en the earnings
of lust j car. The road has thus in five months increased
more than Bix months 1 interest on the debt, and six
moDthß dividend on the preference shares, which require
about a million of dollars. If March shows the same in
crease as February, there will be a surplus of earnings,
det noting CO per cent, for working expenses, of about
$650,000 on iho first half of ibe fiscal year, which would
be applicable to a dividend on the old stock, being About
6 per cent., if the assessment scrip, and one or two over
due coupons, were out of tlie way. The capacity of the
road to earn 6 per cent, on the common shares is, how
ever, conclusively shown. The receiver’s final report
will be ready in a few days, and will show that half the
road was reironed under his administration.

The weekly bank statement shows a decrease of

approved the ninth day of April, one thousand eight
hundred and fifty-six
Skctios 1. Be it enacted by ihe Senate and House
of °f tht Gmmnv/wtth of Pennsyl
vania, in General Assembly met , and it is hereby
ewaefed by the authority of ihe same,.That the con
tractor or contractors for the public printing and biudiug
shall hereafter be allowed for tdo translation of English
matter required to be printed in the German language
the sum of forty cents per thousand ems. Provided^
That no charge shall he alio *ed for figures or other mat.

Sue. 2. That iu addition to the charges allowed for tho
furnishing of*"blanks, by the eleventh section of the act
to v hich this is a supplement, there shall hereafter be al

Sec. 3. That it is the intent and meaning of tho act to
which this is a supplement-, that there shall be no charge
allowed for composition on any extradocuments ordered,
unless the composition has actually been performed, of
which an affidavit of the public printer shall be required
by the Auditor General
Sec. 4. That on Tuesday, the eighteenth day of
March, oue thousand eight lmndred and sixty-two, and
on the fourth Tuesday of January every third year
thereafter, the Legislature shall meet iu joint convention
in the Hall of the House of Representatives, and let
the Public Printing and Binding for three yeqjfMccord
ing to the provisions of this act, and tbo act to which

notice may be given of the time of the allotment for the

them, to be opened, announced, and allotted, on the 18lk
day of March, instant, agreeably to the provisions of the
act of 9ih of April, 1856, aud the supplement thereto,
