of the Stockholders of the Pennsylvania Railroad Com
pany will be held in this city on TUESDAY, the 12th
day of November, 1861, at 11 o’clock A. M., at the SAN
SOM-STIiKET HALL, for the purpose of taking into
consideration a proposed contract with, and a loose of
the road of, the Philadelphia and Erie Railroad Com

four .persons selected by the Prothonotary of the Court
of Common Pleas to attest the opening of the packages
of the army returns, and to authenticate the papers
therein enclosed, are induced by the publication in to
day’s papers of a protest of Messrs. McFadden and Down
ing, tlie other two citizens selected for the same purpose,
to make the following statement:
1. That they understood their duty to be a simple one
to authenticate the papers opened and found.
2. That it was not their duty to count the vote, nor to
form or express any opinion, much less to publish one, on
the correctness, regularity, or irregularity of the papers.
. 3. Hence they have not expressed, nor do they intend
to express or publish, Any opinion oh the vote purporting
to be the vote of the companies and regiments of Colonels
Ballier, Owens, Scbimmelpfennig, or Koltes, or of the
company of Captain Power, belonging io the Excelsior
Brigade or Regiment, of the State of New York.
