Saint Joseph's Orphan Asylum's Appeal. Ap
peal dismissed at the coat of the appellant.
Meal' Appeal. On the Bth of May, 1851, Thomai
Davis and wife leased to Michael Ryan, his heire,
de., for 99 years, the entire mining right in a cer
tain tract of land in Chester county, and the lessee
agreed to pay to the leaser $250 every six months ;
the find payment to be made May 8, 1851; the se
cond November 8; 1851, and the' same 'sum' to be
paid semi-annually thereafter 'until the ore-leave
should amount ,to $l,OOO per year, then the semi
annual payment to cease. - If at any time thereaf
ter the amount of' ore should tall short of $l,OOO
per year, then the same-annual rent to be conti
nued, and $3 per ton, over the above mentioned
SL,OOO per year. - It was further agreed that if the
lessee should cease mining operations on said tract
for twelve consecutive "months, then the indenture
'should become void and of no great. .
The lease was, assigned to the Montgomery Mining
Company, which commenced operations in mining
and prosecuted' them for several years ; but stopped
on or about the Bth April, 1854, and never resumed.
The plaintifFe. (Moss) execution was issued to
April term, 1858, and some property belonging to
the company, lying on the premises described in
the lease, about the mine, was sold. Out of the
proceeds of this sato Thomas A. Davis (appellee)
claimed to be paid six months rent, provided the
proceeds of the goods sufficed to pay D.
Moss restated this claim on the ground that
the right of distress was', gone, and that therefore
the former landlord was not entitled to be paid
rent out of the proceeds of the plaintllre execu
tion. The auditor reported ?a favor of the plain
tiff, and against the claim of Thomas Davis. To
this report Davis took one ption, and the court
after argument made a decree in his favor. The
plaintiff appeals from the decree to the court. Ar
gument made by Wayne MoVeagh for appellant,
and Wm. Pennypacker for appellee. The ergo.
merit of Mr. MoVeagh was exceedingly able and
exhibited great learning and research.-_

hour of adjournment the case was not concluded,
Mr. Coffey having but finished his address to the

TRIAL OF TfIE MORELIA HOMICIDE CASE—
TIIE VERDICT OF THE JURY. ,
COURT OF OYER AND TenniNES.—Yestorday,
in the Court of Oyer and Timnizier, Judges Allison
and Thompson on the bench, the ease of Daniel
Price, James Gheegan, John Carr, George Alex.
"ander, and William Hats, charged with the mur
der of John Echols, at his residence, on the 29th
of last April,-was continued, Leonard R. Fletcher,
Esq., making the closing speech in behalf of the
defence. This effort was listened to by an over
crowded court-room, and occupied nearly two
hours In its delivery. Mr. Fletcher earnestly con
tended that the defence bad clearly shown that the
attack was made in the first place by some of
the inmates of Richele's house, and further, that
the defendants, with the exception of Price, were
unarmed ; that they all acted upon the defensive
and not upon the aggressive; that one of their
number, Ghoegan, was shot while in the very act
of endeavoring to make pence ; that an alai. had
been proven so far as Hats and Alexander wore
concerned; and that, as the Commonwealth's tes
timony was shaken in this respect, its soundness
should be doubted in every particular. Mr.
Fletcher also forcibly argued that the good charac
ter which his clients had proven did not entitle
them to be chuated as those who harbor murder in
their heath!, but, on the contrary, in view of all
the peculiar circumstances of this case, and, more
especially, the conflicting nature of the tostimeny,
that character should stand around and about
them as an impregnable shield. Mr. Fletcher con
eluded by referring to the youth of the prisoners,
and the afflicted Condition of those who were near
and dear to them, and asked the jury to render a
verdict which their consciences approved. With
snob a result he would be entirely satisfied.
District Attorney Mann closed the speaking on
behalf of the Commonwealth, strenuously urging
a conviction of murder in the first degree as to
Price, and in the second degree as to the other de
fendants. Be dwelt_ upon ( the evidence elicited,
And the law as applicable thereto, at some length.
There could be no doubt that. John Eiehele bad
been brutally murdered in his own house on the
29th of April last, and no doubt that these defen
dants .were, present, armed with pistols, when the
deceased tell upon his own floor mortally wounded.
Mr. Mann alluded to the dying, declaration of
Eichele, as placing the mark of the murderer
upon Prise, who was confronted with him at his
bedside. The statement of the deceased, made In
a solemn and impressive hour, was corroborated by
other testimony lithe cause, and muathave its fall
effect upon the minds of the jury.
There may be some mystery about this ease, but
yet sufficient light to reveal the guilt of at least
one of the defendants, who has been prominently
named in connection with this bloody transaation.
The doubt; which have been suggested on the
other side and various portions of the evidence I
leave the ease somewhat disguised in myet.sry— ,
enveloped in a cloud as thick as was that which
filled the room of Ebbe% with the nude of pis
tols, when he fell a victim to a sudden and unpro.
yoked murder, but amid all this smoke and doubt
there is one form at least clearly discernible, and
that, gentlemen of the jury, the sworn evidence In
this cause assures us is Daniel Price. "
Judge Allison charged the Jury fully and Im
partially, after which they retired, shortly before
two o'clock, for deliberation.
At 4P. M. they came into court; speculation in
the meantime having been exceedingly rife as to
the probable result. Their foreman announced
that they had agreed upon a verdictorlitch was
received amid the most profound silence. This
verdict was as to Daniel Price, " guilty of murder
In the second degree ;" and as to John Carr, James
Gheegan, George Alexander, and William Hats,
"Nov anturr."
Those who were acquitted were at once set at

berty, and were surrounded by at leasta thousand
people in the vicinity of the court-home. Much
excitement prevailed outride, and it was a long
tire before the crowd began to disperse. Price
received the verdict without any manifestation of
emotion. Ills counsel, we learn, will file renew!
fora new trial, as they allege that they eau now
predicts affidavits whieh will establish his inns
eenee beyond all doubt. This case .has occupied
much of the time and attention of the court; but
not 'more than Its great importance demanded.
Of course. there wore various opinions as to the
verdict; but the friends of Gheegan, Carr,Alex
ander, and Hats Imre not among those who were
disposed to express their diseatisfaotten.
TRIAL OP JOHN SWEENEY FOR THE
DER OF CHARLES CARTEN
Yesterday afternoon, in the Court of Oyer and
Terminer, the case of John Sweeney for the mur
der of Charlet Carton was called up for trial,
District Attorney Mann and Wm. Brantley Hanna
appearing for the Commonwealth, and Messrs.
• Henry B. Warriner and Wm. N. Aebman for the
' defence. Tho murder is alleged to have been per ,
~ petrated on the 30th of November last, in Nugent's
I court, Shippen street, above Seventh. The defend.
, ant went to the house of the deceased in the even
ing, and after calling for "Ids child," (referring to
his wife, who bad a room in Carton's house,)
stabbed Carton with a pair of shears, inflicting a
V, mortal wound. There had been some ill-fooling
f between the parties, Sweeney on one occasion
previous, baring committed an assault and battery.

Patrick Gallagher sworn --I was present the
night Sweeney came to Carton's; I left Carton's
house, him asleep; I went to the hydrant; heard
Sweeney say "he should have his child," and
something about the alloy; a woman told me to
throw the water on the man ; I 'went in the door ;
I heard the noise; him d--g the alley; I went
oat; looked under the archway; paw two men
climbed about fifteen feet off; nearly opposite Car.
ten's door; saw Sweeney; he was one; I beard
Sweeney say " you got that, or take it," or some
such words; he came out towards sae on the street,
and went away at a moderately smart walk ; the
other man went in Carton's own house ; that man
was Carton, as far OR / can say.
Officer Selby sworn.—l am an officer; was with
Mr. Dick ; beard a noise in the court; saw the
prisoner; Officer Diok took hold of him; saw
nothing in his hand then ; took him down towards
Shippen street; I was behind him; just before he
got to Seventh street, he threw away, a pair of
shears; I picked them up; these,are the ones;
they werebloody; fresh blood on them ; I kept the
shears, and put them in my pocket.
Cross.examined.--This was November 30; be
tween eight and nine o'clock ; I heard a noise in
the alley—ballooing ; it drew my attention ; the
prisoner was on a walk; he threw the shears;
saw him; they did not fall; ho had them in hie
hand; I did not go to the station; often saw him
before.
Officer Dick sworn —I arrested this defendant;
saw hie hands; good deal of blood on them,
Susan Kane sworn.—l live in the neighborhood ;
I was standing ou my own floor; ray house is about
Seven or eight yards from (Wien's; I was at the
hydrant; I heard Sweeney fulling for his child to
come out of this house, he'd have her; he went at
the shutters, giving it a great slam, and repeated,
" he would have his child ;" then Carten came out ;
I told him not to oome out; he wont out; had no
weapon; just put him away from the door; Carton
said nothing; he went towards Sweeney; did not
see any blows struck ; saw Carton go in ; he came
out and said he was stabbed ; did not know it until
then ; it was light enough to see the blows.
Bridget Gorman sworn.—Am a sister of Mrs.
Carton; I was at the house; I was 'sewing when
the knock came to the door; it was a loud knock ;
next heard Sweeney's voice; he then slammed the
shutters and said something about his child; Cas
ten got up from the settee, and said What's the
matter; he was asleep; I says, " Charley, don't go
out;" he says, I'll go out and put him away ;
said, don't go; ho opened the door and went out;
I went to the door after him ; I stood in the door;
went to step out and Sweeney clams up to Carten ;
Carton said nothing; I saw Sweeney draw his
hand and stab him, and said, "Take that—that
will do for you Carten came in end said, " BWee•
nay has stabbed me again;" I did not look after
the prisoner; looked after Charley; I saw the out
and the blood coming.
The court adjourned until this =min, at ten

CHARITIES OF THE SONS OF MALTA.—At the
last stated meeting of the members of the Minne
ha-ha Lodge. and the Supreme Grand Council of
the Sons of Malta of Eastern Pennsylvania,
held at their hall, corner - of Tenth and Chestnut
streets, the executive committee on the late
Charity Ball reported to the Grand Council that
the entire net proceeds of that festive occasion
were $1,520.48, whereupon it was unanimously
agreed to increase the amount of the oharity fund
to $2,000, and that an additional appropriation of
5,000 bread tickets be made to the different soup
societies.

A STORY Old MYSTERY AND IthavenTrXE.—
On Tuesday evening, Hr. George Hawkins, resid
ing on Chestnut street, near Twauty.second,
changed his clothing, and went out on business.
About an hour after his departure his wife bad oc
casion to enter her husband's chamber, when ebe
discovered his discarded clothing banging over the
chair, and in flames. She removed them to the
yard, placed them under the hydrant, and drowned
the flames. The matter was forgotten ; when yes
terday forenoon, while Mrs. Hawkins was engaged
in the discharged her domestic duties, a stranger
rang the bell and told her that smoke was issuing
from thewindows of an upper story. On repairing
to the place indicated she found that a parcel of
clothing in a closet was almost consumed. The
flames had charred the woodwork of the closet, the
mantel piece, the furniture in the room, the walls,
and glass. By some little effort theeo flames ware
also extinguished. One or two fire companies same
on the ground, but were unnecessary, as the flames
had been subdued without their assistance.
Fire Marshal Blackburn repaired to the pre•
miser to make an investigation of the ease yester
day afternoon. Circumstances led him to suspect
a little girl in the family, about fourteen years of
age, of having a guilty knowledge of the mar
ranee. She was taken in custody by the Fire
Marshal, and subjected to a eroas-examination.
Her story is a strange one. She says she was born
in the State of New York, her parents dying
while she was at an early age, in a destitute con
dition. She was placed in a reformatory institu
tion on Itandell•e island, where she served some,
years, and was then bound out to a family In New
Jersey. This family treating her badly, she ran
away, and, getting on a train, she came as far as
Bordentown, and was found strolling around the
streets by a friend of Mrs. Hawkins. Mrr. H.,
hearing of the case, brought her here, and domes.
Heated lior in her fatally, where she remained up
to the time of her arrest. She Is an ignorant, dull,
little girl, and shows the bad effects of the vicious
propensities and habits so common with unfortu
nates of her class and condition.
ANNUAL MEETING OP THE MERCHANTS'
Futin.—On Tuesday afternoon the Merchants' Fund
Association held its sixth annual meeting at the
Board of Trade rooms. David 8. Brown, EN..
was called to the chair, and Thomas F. Brady up
pointed secretary. The annual report, which was
read, states that, eines the formation of the society,
one hundred and ninety•one donations have been
made, in amounts not exceeding $3OO per annum
to any ono individual. The donations during the
past year amounted to 52,047.50. Ono of the bene
ficiaries died sine° the last anniversary. The pre
sent number receiving regular aid is ten, whose
ages range from over sixty to eighty years. None
of the recipients applied, directly or indirectly,
for aid. It was extended by the voluntary action
of the committee, upon their own knowledge, or at
the suggestion of those who bad witnessed the des.
Mutton of the parties, and the unavailing efforts
they had made for their own support. Tito assist•
once rendered by the society is strictly private anti
oonfidential.
The report aoknowledges the continued interest
of the members of the modelle°, and the prompt
ness with which their contributione are made.
Upon the annual contributions. the continuance of
the beneficent work of the muddy almost wholly
depends. The permanent fund, $4,200, is invested
in city and State loans. The treasurer reported
the cash receipts of the year to be $5.004 31, and
the expenditures $3,9130.83, leaving a balance in
Mil of $1,103.48.

FUNERAL Or FATHER MoDElutorr.—The
funeral of the late Rev. John McDermott, the Ca
tholic clergyman whose death has been announced
by up, took place 'yesterday morning. The funeral
services took place at the Church of St. Philip de
Neri, on Queen street, between Second and Tbird
streets. At nine o'clock, the solemn requiem for
the dead was celebrated, the church being filled
with people, and many were compelled to remain
upon the outside. After the sermon had boon de
livered, the body was removed to the Cathedral
Cemetery, in the Twenty-fourth ward, where the
interment took place. The funeral cortege was
very long, and the display was very imposing.
Several of the Catholic associations of the city ap
peared in the line.
CHARGED WITH STEALING LEAD PIPE.-00
Tuesday afternoon two colored men named Daniel
Niohole and Obadiah Twiford wore arrested at Wa
ter and Vine streets, on suspicion of having stolen
about forty-five pounds of lead pipe, which they
had in a box, and which Is supposed to have been
taken from some distillery. The accused were
committed for a further hearing, and the property
awaits an owner at the Cherry-street station.

ACCIDENT.— Yesterday afternoon a man
named Andrew Bayrow, while driving a cart
loaded with oyster shells, in Second street, near
Spruce, fell from the load, and the wheel passing
over one of his legs, it was broken, He resides In
the upper part of the city.

Judge Stroud yesterday committed three girls and
one boy to the Northern Rome for Friendless
Children. They were all in the most destitute
condition, hungry, and shivering with cold. Two
of the little girls wore begging in the streets, with
out even shoos or hose to their tender little feet.
None of them had homes. Two of them ore or
phans, and the parents of the others are being sup
ported elsewhere, at the public, cost.
