the petition of IV. Brown, oxoepting to the re.
port of viewers, appointed to assess damages in the
right of way of the Pittsburg and Connellsville
Railroad Company, the argument of which we re.
ported some week or ten days ego. The report of
the viewers won set aside, because the company
bad not made the necessary affidavit to accompany
the report. The Jude was of Opinion, however,
that under the affidavit, filed by the company on
the 24th of December, the company oould take
possession of the lino through Mr, Brown's tract,
