lor .the theft, and was,bailed and left the oity and
retuftietf.to prison, and'was now brought np on n
writ of habeas corpus as a witness' for the plain
tiffs. He gave his evidence with great confidence,
and admitted that he had stolen thegoodsand car
ried awhy what was most valuable and least likely

For thp defence',Jt was contended that the de
fondants were entirely innocent of any wrong in
the trsutahtionl Jhat they received and sold the
goods in .the hsualoourse of business,' and had no
knowledge of auspicion that they had boon stolen
or improperly obtained: For the plaintiffs it was,
however, bontendedthat there were.oiroumst&nces
connected .with'the . oase which should have put
the‘defendants on their guard! There' were other
circumstanced (.adduced in evidenoe tending to
confirm the'evidenoe of Parmalee. Mr. Farness,'
one of-the defendants, vrasoalled te the stand and
toatifled that he received the seeds in goodfaith,
and that after he learnod the fact of the robbery,
he‘gave evory faulty he oould to Mr. Clark, one
Of tho ‘plaintiffs, to obtain repossession of, the
goods. i > . v
The -.Court Charged the jary. this was a oase of
oonßiderablo importanoe to' the parties conoerned,
and W&s'entitled to their oareful consideration.
It was peonliar in its aspeot, and wasln somo way
unlike any- other ' ever presented before us. But
whether peculiar or not, it must he decided like.
othor oa?es ; and the same law and rules mtist govern
the jury in ’determining on the questions brought
before them. The action is. what is technically
known as anflotion of Trover,-brought to reoovor
the Value of goods whioh wero claimed to belong
to the plaintiffs, and oahie into possession of de-.
fendams ahd-wereconverted'to defendants’ use.:
The two principal questions In the oase are: whe
ther,thegoods in controversy, or. any portion ofi
them,' belonged to plaintiff, and .whether, if they,
goods of plaintiff, wore they converted ;
ta defendants’.use? • *
, The law applioablo to -the'oasoa of this kind is,l
that if the-goods wore owned by plaintiff, and, :
while so owned/ were stolon by Parmalee, and'
transported and cons'gned: to defendant, and of-,
terwards re-sold by defendant at Philadelphia; if
so, it .would entitle plaintiff to recover tho value
of the goods at the time of sale. No matter bow'
honest the defendants may have been—and I see*
nothing to doubt their honesty, but much to oom<
mend in theirconduol—but if the alleged foots of
the ease wore proved,-the defendants must be held
responsible. ■ • j
The court then recapitulated theevidonoe, and
commented on it, and gave the onse to the jury,
who retired. After being oht for a short time, the
oourt sont for them, and told them that if in their
judgment Parmalee was not snch a credible witness
as that his evidence, with the other evidenoe bear
ing pn the cose! was not saflioiont to establish the
facts of the' ownership of the goods, and the theft of
them, the jury ' must find for defendants ' The'
xjury then retired, and were out about an hour
without agreeing, and the court ordered them to
‘bring in a sealed .verdict in the morning. For

unotnlng exertions to preserve both the vessel and
cargo from the danger with which tbey were thteateoed.

den extreme eold weather has caure much inconvenience
to consumers of GAS by obstructing their supply-pipes
and meters, it may be useful to many of them to know
how to remove the obstruction, and obtain their usual
light
This can be done in a few minutes by the application
of a few qnsrte of boiling water.
The beat method of applying it is to cover the meter,
and the pipe that comes in'thiough the front wall, with
a piece of doth, (the common tow-linen house-cloth
answers very well,) and to pour the hot water
cloth until it is thoroughly soaked. w
The cloth serves to retain the hot liquid, and thus,
in a short time, the coating of frost within theploe and
meter is thawed, leaving all dear for the flow of Gas.
In many cases, the trouble arising from the freezing
of meters can be entirely avoided by the exercise of
proper osre in dosing the cellar doors and windows, so
as to exclude the cold draught of air, especially in the
vicinity «f the meter.
Should tbs above procedure fait td give immediate
relief, it will be-advisable to send notice to the GAS
OFFICE, No 20 South SEVENTH Street, where persons
are in attendance night and day, to give all needful as

Of SIX PER OENT. on the Capital Stock of the Com
pany, and on the Certificates of Profits outstanding, for
the year ending December 31, 1858, without deduction

and examine policies eiTeoted by others (in most cases)
free of extra charge

Mr. Ullman, pursuing the policy of his management,
which Is in favor of great works by great composers, has
the honor to announce that he will, on Saturday: pro
dace Mozart’s celebrated opera of The Marriage of
Figaro.” For many jeers this famous production has
been the choice bait of operatic management. Every
successive impressario has promised to give it, and as
oonsta&tly failed to de so Aa in the case of “ The Hu
guenots,” it was reserved to him to bring out the work
tor the first time in America

is a curiosity in musical liter -tore, in addition to being
one of the finest productions of its oelebrated master.
Popular tradition says that it was written at the insti
gation of a wager, and to prove that an opera could be
made to succeed without a tenor put In it. Mcaart
felt that nothing but the purest streams of malody,
and the loveliest creations of fancy could reconcile the
public or eeoure the success which was essential to the
Issue of the wrger. Certain it is, that on the three
characters of Susanna, the Ooont, and Figaro, he haa
expended all the infinite pathos, playfulness, and ge
niality of bis Tatars. rJ
The “Nozze” was preceded by tl Idomaneo/* and
w s followed by “ Don Glov*noi.” Thus connected in
the golden oh&m of the composer’s chief works, it has
long maintained its European celebrity; bnt for acci
dental reason?, it has never been produced here. Fore
most amoLgvtheee may be mentioned the fact, that
since the dajeofMidame Bontag, there has been no
artist in this conntry capable or interpreting the role
of Susanna. It is fortunately in Mr. UUman’s power to
present the work with a cast that cannot be surpassed.
He refers 'confidently to the Busanna of M’lle Piccolo
mini as one of her greatest impersonations, exceeding,
(n the joyous details of girlish emotion, her Zerlins,
la ‘ Don Giovanni,” and to the Figuo of Cart Formes,
which, in artistlo conception, stands as high as any
role in which the great basso has yet appeared. M’ila
Ghioni will make her debut as the Oouotess, and Signor
Plorenzi as the Count. %These are the principal cha
racters on which tbe success of this opera depends, and
it is hoped the public will acknowledge that they could
not be in better bands
