was mistakeir; I did not tell before the alderman
that Mr. Riley said if ryrould take less than the
legalitate it would be done.
Samuel I. McMullen, aweria.-I.,ain the discount
. clerk in the City Bank, and was in the year 1855;
Ors entry of oath in Young'a book is in the hand
writing of Mr. l'aggart,' the - receiving teller,
now
the paying teller ; the 7th of December, 1855, was
a discount day; there 'was no note of George
Payne's offered for discount that day; I took out
all: the notes that were in the box, and entered
them is the proper book; (book p roduced ;) if the
note had been Offered, it would have appeared on
that book;' I never varied from that duty inten
tionally
,or accidentally; I am positive that if
that note had been put in the discount box, it
wouldhave. been entered in that book ; I Rd no
note on tbe'4th December, 1855, of George Payne,
offered by Mr. Young, nor any other note; there
Were ninety-four notes offered that day; forty
eight were discounted ; it was my duty to return
the notes that were not discounted ; I did not re
turn snob 'notes to Mr. Young; anthem entries
are in my handwriting; there was no person in
.charge of my duties on these days; no person
could have returned these notes, for if they bad
bean there they would have appeared on this book;
there is no profit of $lO3 on the books of the bank,
arising from this transaction; if the bank had re
ceived the profit, it would have appeared on the
books of the bank ; it would have boon my duty
to have entered it, if there had been any profit; I
Imam .that the bank has not received a mint of
profit from-this transaction.
- John Taegarr, sworn—l Was receiving teller of
the City Bank in 1855; the entries of the 7th
December in the bank book is in my handwritingc
I do not recollect the particulars of this transao l i
-
tion; I must have received the money to have
given the credit; on my scratcher is the entry
"Cheek, John Young, $600;". I can't tell whose
check that woe; if it, were Mr. Eastwiok's chock
his account would show it; I would not credit Mr.
Young with $6OO if I had not received it; if Mr.
Eastwlek or Mr: Riley told MO to enter- $6OO to
Young's credit, I would have required some show
from them for my settlement in the mei% on
December Bth there is a shack in Mr. Eastwick's
account of $600; it hoe never been required of me
to make a credit unless a check or the money bee
been paid; the bank received no profit from this
transaction.
After hearing this testimony, the District At
torney, with the approval of the court, stated that
the Commonwealth did not consider a sufficient
case bad been made 'out, and that the defendant

States is a vessel of 950 tons register, and had plenty of
water Into dock on the night of her arrival ; but as she
only got opposite to the entrance to the dock at high
water, the crow (20 in number, including officers, boys,
stewards, Ac.) were not able to get up the anchor before
the tide set down; consequently she lay on the beach
for one tide, where she made a little water. She got off
and into dock, however, next tide, where she Is now dis
charging. She was drawing 18 feet on her arrival. (The
former report was much exaggerated.)
A telegraphic despatch from Port Mend states that
the Gloucester fishing vessels previously reported ashore
