voting at all elections in the several
counties in this Commonwealth," as

Section 1. Be it enacted lit tJic

lives, dc, That the qualified voters of
the several counties ol this Common
wealth, at all general township and spec
ial elections are hereby kereatter author
lzed and required to vote by ticke
printed or written, or partly writteu an
partly printed, severally clasified as f ol
lows : One ticket shull embrace the
names of all the Judges of the Courts
to be voted for and to be labelled on th
outside, "Judiciary;" one ticket shall
embrace the names of all St&te officers
to be voted for and labelled "State,1
one ticket shall embrace the names of
all county offices to be voted for, includ
ing the office ot senator, member or
members of Ascmbly, if voted for, mem
bets of Congress, it voted for ana
belled "County ;" one ticket shall em
brrce names ot 'all the township officers
voted tor and be lubellei "tsorougii or
"Township;" and each shall be depos
ited in separate ballot boxes
I also make known and give notice
as in and by the 15th section of afore
said act, I am direoted that every per
son except Justices of tho Peace, wb
shall hold any office appointment of
trust or profit, under the Government of
the United States, or this State, or any
city or incorporated district whether
commissioned officer or otherwise
subordinate officer or agent who is or

Also in the 4th section of the Act
of Assembly, entitled "An act relating
to elections and lor other purposes, ap
proved April 16tb 18G9, it is enaeted
that the 14th section shall be so con
Btrued as to prevent any militia or
boroughloffioer from serving as Judge
Inspector, or Clerk, at any general
or special eleotion in this Common
wealth.
Also that in the 61st, section of said
act it is enacted "That every general
or special election shall be opened be
tween the bours ot six and seven in
tbo fore-noon, and shall remain without
interruption until seven o clock in the
evening when the polls shall be closed
No person shall be permitted to vote
at any election as atoresaid, but a tree
man of the age of twenty-one years, or
more, wbo shall nave resided in this
State at least one year and in the elco
tion distriot where he offers bis vote,
at least ten daya immediately preceed-
init such election, and within two venrs I
paid a State or County tax, which shall
ave Dceo assessed at least ten days I
cfore the eleotion. But a eitisen of
the United States, who has previously
been a qualified voter of this State, but
removed therefrom and returned, and
hull have resided m the election dis
tirct and paid taxes as aforesaid, shall
bo entitled to vote alter residing in this
Mate six months. J'rovided, That the
freemen, citizens of the United States,
who are between the ages of twenty-one
nd twenty-two years, and who have
resided in the election district ten days
as aforesaid, shall be entitled to vote,
although they bavo not paid taxes.
Vvhrhkas, the Fifteenth Amend
ment of tho Constitution of the United
States is as follows :
Section 1. The right of citizens of
the United States shall not be denied
or abridged by the United States on ac
count ol race, color, orj previous 4eoo
dition of servitude.
Section 2. That 7oneress shall
have power to enforce this article by
appropropriato legislation.
And whereas, The Congress of the
United States on the thirty-first day
of March 1870, passed an act entitled,
'An act to enforce the right of citizens
of the United States to vote in the sev
eral States of the Union, and for other
purposes," the first and second scetions
of which are as follows :
Be it enacted, &e.t That all citizens
of the United States who are or shall b
otherwise qualified to vote at any elec
tion by the people ot any state, .terri
tory, district, city, county, parish, town
snip, school district, municipality, or
other territorial subvision shall be en
titled aud allowed te vote at all such
elections, without distinction of color
race, or previous condition of servitude ;
any constitution, law, custom, usage, or
regulation of any State or territory, or
by or under its authority, to the contrary,
notwithstanding.
Section 2. And be it further en
acted, That if, by or under the consti
tution or laws ot any State or the laws
of any Territory, any act is or shall be
required to be dune as a prerequisite or
qualihcation tor voting, and by such
constitution orlaws persons or officers
are or shall be charged with the per
formance of duties iu furbishing to citi
zens an opportunity to perlonu such
prerequisites, or to become qualified to
vote it shall be the duty of every such
person aud officers to give all citizens ot
the United States, the same and cquul
opportunity to pertorm such prerequisite
aud to become qualified to vote without
distiction of race, color or previous con
dition of scrviture; and it any such per
sons or officers shall reluse or kncwiugly
omit to give full effect to this section,
he shall for every such offence, lorl'eit
and pay the sum ol five huudred dollars,
to the persons agrieved thereby, to be
recovered by an action on the ca.se, with
iu'1 costs and Buch allowance lor coun
sel fees as the court shall deem just, and
shall also for every such oli'enco be
deemed guilty of a misdemeanor, and
shall on conviction thereof be fiucd not
less than fivo hundred dollars or to be
imprisoned not less than one mouthiaod
nut more than one year, or both, at the
discretion ot the court.
And whereas, It is declared by the
secoud section of the VI article ot the
Constitution of the United States, that
"This Constitution of the United States
which shall be made in pursuance
thereof, shull be the supreme law of the
laud auythiog in live Con
stitution or laics of any Stale, to the con
trary, notwithstanding"
And whereas. The Legislature of
this Commonweath, on the Oth ol
April 1870, passed an act entitled "A
further supplement to the act relating
to elections in this Commonwealth,
the tenth section provides as follows
Section 10. That so much of every
act ot Assembly as provides that only
white freeman shall bo entitled to vote,
or be registered as voters, or as claim
ing to vote at any geueral or special
election ot this Commonwealth, be uud
the same is hereby repealed, aud that
boreatter all freemau without distinct
ion of color, shall be enrolled and regis
tcred according to the provisions of the
first section ot the act approved the
17 of April I860, entitled "An act fur
ther supplemental to an act relative
to the elections of this Commonwealth,"
and shall when otherwise qualified
under existing laws, be emitted to vote
at all general and special elections in this
Uommonwealth
No person shall be permitted to vote
whose uaine is not contained on the list
of taxable inhabitants furnished by the
LCommisbioners, unless be first produces
a receipt for the payment witbiu two
years, ot State or County tux, assessed
agreeably to the Constitution, and give
satisfactory evidence either on his own
oath or affirmation of another that
he has paid such tax, or on fuilure to
produce such receipt shall make oath
ot the payment thereof; if he claims to
vote by being an elector between tfce
ages ot tweuty-one and twenty-two
yeare he shall depose on oath or anima
tion that he has resided in the Stare
at least oue year betore his application,
and make proof ot his residence withiu
his district as required by the act, and
that he does vsriully believe from ac
counts given him, that be is of the age
aforesaid aud give such other evidence
us is required by the act whereupon the
name ot the person so admitted to vote
shall be registered in the alphabetical
lint by the inspector, and a note made
opposito thereto by the word "tax," if
he shall tave been admitted to vote
by reason of having paid tax, or the
word "age," if he shall have been
admitted to voto by reason of ago,
shall bo called out to the clerks, who
shall make like notes in the list kept bv

If any person shall prevent or attempt
to prevent any ftfficer of any election un

erly interfer witb him in the execution
of his duty, or shall block up the win
dow or avenue to any window where
the same may be holding, or shall riot

restrain the freedom of choice, such per
sons on conviction shall be fined in any

offending was not a resident of tho city,
ward, district or township where the
said offence was committed, and not
entitled to vote therein, and on con
viction he shall be sentenced to pay
fine ot not less than one hundred or
more than one thousand dollars, and bo
imprisoned not less than six months or
more than two years.
Whereas, By the act of the Con
gress ot the United states, entitled "An
Act to amend the several sots heretolore
passed, to provide for the enrolling and
calling out the national forces, and for
other purposes, and approved March
third, one thousand eight hundred and
sixty-five, all persons who have deserted
the military or naval service ot the
United States, and who have not been
discharged, or relieved from the penalty,
or disability therein provided, are
deemed, and taken, to have voluntarily
relinquished, aud forfeited, their rights
ot citizenship, and their rights to become
citizens, and are deprived of exercising
any rights of citizens thereof:
And ichercas, Persons, not citizens of
the United States, are not, under the
constitution and law of Pennsylvania,
qualified electors ol this commonwealth :
Section 1. Be it enacted lu the
Senate and House of Representatives of
the Commonwealth oj Pennsylvania in
General Assembly met, and it is hereby
enacted by the authority of the same.
Ibat in all elections hereafter to be held
in this commonwealth, it shall be unlaw
ful for the judge or inspectors ot any
such election 'o receive any ballot, or
ballots, from auy person, or persons, em
braced in the provisions, and subject to
the disability, imposed by said act of
Congress, approved March third, one
thousand eight hundred and sixty-hve,
and it shall be unlawful for any such
persons to offer to vote any ballot, or bal
lots. Section 2. That if any such judge
and inspectors of election, or any oue ol
them snail receive, or consent to re
ceive, any such unlawful ballot, or bal
lots, from any such disqualified person,
he, or they, so offending, shall be guilty
of a misdemeanor, and upon conviction
thereof, in any court ot quarter sessions
ot this commonwealth, be shall, tor each
offence, be sentenced to pay fine ot
not Icps than one hundred dollars, aud
to undergo an imprisonment, in the jail
of the proper county, for not less than
sixty days.
Section 3. That if any person de
prived ot citizenship, and disqualified
as atoresaid, shall, at any election, here
after to be held in this commonwealth,
vote, or tender to tbo officers there, and
offer to vote, a ballot, or ballots, any
person, so offending, shall be deemed
guilty of a misdemcanDr, and on con
viction thereof, in any court of quarter
sessions ot this commonwealth, shall,
for each offence, be punished in a like
manner as is provided in the preceding
section of this act, in the case of officers
of election receiving such unlawful bal
lot or ballots.

shall hereafter persuade, or advise, any
person, or persons, deprived of citizen
ship, and disqualified as aforesaid, to
offer any ballot, or ballots, to the officers
ot any election, hereafter to be held in
this commonwealth, or shall persuade
or advise, any such officer to receive any
ballot, or ballots, from any person de
prived of citizenship, and disqualified as
atoresaid, such person, so ottcnding.
shall be quilty of a misdemanor, and
upon conviction thereof, in any court
ot quarter sessions of this commonwealth
shall be puuished in a like manner as is
provided in the second section of this
act, in the case of officers of such elee
tion receiving such unlawlul ballot, or
ballots.
Pursuant to the provisions contained
in the 4th section as aforesaid the
Judges ot the aforesaid districts shall
respectivelyjtake charge of the certifi
cates or returns of election to their re
spective districts and produce them at
a meeting ot one Judge from each dis
strict at the Court House in the Town
ship of Ridgway on FRIDAY, thb
17th day op OCTOBER next, the
and there to pertorm the duties re
quired by laws of said Judges; also
where a Judge by sickness or unavoida
ble accidents is unable to attend such
meeting of Judges then a certificate as
aforesaid shall be taken(in charge of by
one ot the inspectors or clerks or tn
election of said district who shall do
and perform the duties of said Judge
to attend ; and the return Judges of
tbe said district! aforesaid are requested
to meet in Uidgway, the couuty-seat of
said county, on Kiiday, after the seeood
Tuesday oi Ootobor next, then and
there to discharge the duties required
by law.
