On the 22d ult., the Committee appointed
to investigate the murder of three soldiers in
South:Carolina, made report., The Commit
tee detail,s the butchery ; the arreat and.con
viction by a military-court of the murderers;
their sentence to death; commutation by the
Preeident to imprisonment for life at-Tortu
gas; their transfer to Fort Delaware, and
that finally when the prisoners did arrive
there. Colonel Howard, whe was in com
mand of the fort. vas served with ewrit of
HABEAS CORPUS, from the United States Dis
trtct Court of Delaware, Judge Hall Col.
Howard was directed by the War Depart
ment to respond to the writ. A hearing was
had before Judge Hall. and the prisoners
were, discharged on the ground that :the
Judge claimed ,to have had judicial knoWl
edge that the rebellion was aupptissed, and'
peace restored. in ,June, 1865, and further,
that the civil courts of • South Carolina were
open for the administration of justice at. the
time of the arrest and trial of these murder- .
ers. But Gen. Sickles 'states that "at the
time there were no civil courts in South Car
olina that could have tried them—neither the
United States Dietrict Court or Circuit Court.
or State Courts - were open., Steps wera in
progress to that end, but they had not been
consummated." -
The assassins, when discharged; returned
to th&r home* where - tbey are still at large,
and no attempt has been made to bring them
to trial by the civil courts. . • It is a striking
commentary on the state, of authority there
that, 's hile, according to the testimony of
Surgeon Pillsbury, no doubt appears to have
been entertained in the minds of that corn
tenuity of the guilt of at least two of the per
sons discharged, they were all received by
the inhabitants of the town with an Ovation
and congratulation, which terminated in a
"general drunk."-

They have had the best opportunity, for•ob
taining information, both personally, and
also through the reports of their subordinates,
and they.have been constantly on the alert:

military forces should be auxilliary and au

force, - if necessary,. to induce the people- to
feel.thaf the authority is sufficient to enforce
its advice and instructione." . .
The government , of. the 'country could in

the war-are sufficient guarantee that •it will
not be - abused. Such government should, of
