CONGRESS AND ME FENIANS
The Fenian business Was mi in the House
this week, and, from. the
,debates and votes it.
1,4 evident that it is ready to give an official
expression to the popular disapproval Of cer
tain features of johnsou's policy in regard to
the Fenians; It was expected, that the law
would be vigoronaly, • executed by the -.Presi
dent, and that tlte Fenian leaders would be
dealt with in good faith: fn doing neither,.
Ali Johnson hai alienated malty of his sup
porters, and himself open twthe charge
of conciliating the good will of Great Britain
by an ostentatious display. Ofzeal. which
was .not. deinanded. by - the circumstances.
.It is now, prOposed.to repeal the, neutrality
act, but that would seem unnecessary, for
there is nothing in . the set, which "compels':
the Government to use force against tne Fe
Diana. So much of the law as authorizes the
use of the land and naval forces is permissive
merely, and it was - wholly optional with h.the
Administration whether they should or should,
not employ the military resr.urces of the Uni
ted. States against citizens - of this country
-in
behalf of -a colony of Great Britain, The
law eontemplates.the exercise of a discretion
by the President. It imposes no duty, what
ever upon: him; it simply . declares that
- shall be laWfUl for the President-of the 'United
'States, - or such other person as be,shall haie
•

* the land hi the.naval.forces of the 'Col-.
ted States • • .for thepnrpo , e of pre

saw that:Cases might arise in which consid
eration of justice or of °policy :would require
no -more, than fl wierobservaiice 'of the de
mands of • the international laW, and they, did
not intend:to Into such a law as should de
prive the Executive ot_ all option and all re
gard to circumstances. : •- • 1. •
It follows that the action of .the President
in 'respect to the - Fenians is to be considered
, as an exercise of bisaiscretiou. and not 38 an
execution of a Mandatory statute. The Neu
trality Act is not to blaine. The President,
and be . alOne, assumed "the responsibility 'of
so interpreting that act as tofrustrate" the
Fenian expedition, while it was equally open
tohint to have Omitted the extraordinary em- -
ployment al, - ,the military in .defence Gf the
Canada border It Would, for have
been a "complete execution of the . law had he
ehoien to follow the" line marked out lu Mr.

together, we hail this great rneasure as a har

amid great opposiarin and unprecedented
