Bold Opposition to the New Constitistion
—Gov. Wietelieell •
between. Catholics and Feninas. ,
Sr. Lorna. Aug. 81,.1866
The stand taken by the disloyal _clergy of this State.
in opposition to the new Constitu tion oath, continues ,
to excite attention. • The Catholics. have lately deed— •
aped their .opp:union in the , boldest manner. Ara.. -
bishop Benrick.s rumored prohibition to confirmed „hy.
the publication of , bit circular, dated July 28,Wherein
the clergy are informed that the oath mentioned canoot
lie taken without.a surrender of reclean/41ml liberty.
and is,,therelore„ hiadmissible/ Re directs the priests
to inform him of the circumstances in mute they are mo.,
tested_ Now , mark the, result. of this circular. Laat
Sunday Father Ottholic clergymen in Jeffer
son City. stated to his congregation, directly under the,
nose of. and as If intending to defy,Gor. Fletcher. that
heWould not take the new oath; and if molested.there.-
for he will resist,. and expects the assistance - of lds
flock.- Other. Catholics in the State have nor b een
open. but they are equally'resolute,•and freely express ,
their belief that an - attempt to Mato** this provision of
law will lend to a bloody riot.. , . „ --• .
It is not clear that the Governor can order an arreit' •
under this clause as the matter now etands. Probably
the l.egislatero will be required to provide the mashie
nery necessary for the purpose. %The. penalty to laid •
down in the Constitution. but the method of arraigning
and convicting offenders is left int' sulnequent legisla. -
tion. The Governor evidently appreciates the ditheal.
ty, as he writes thus to a friend in thisetty "
abldthemen will. I presume, cause warrants
to be issued for persons who violate the law by preach.
ing or teaching without first taking the oath. or who
may take it faleely, and Will cause -them to be boubd
over,to appear at the next Circuit Court of -the county ,
to answer Indictments for their offenses. The whole
military force - of the State will, be at' the command. of .
the officers of the law, to enforce legal proems in .11115:
as in all other eases "
The case now stands thus ' : The Cathiflice are
rayed.in a body against the oath by the official prohibi
tion of the Archbishop: The Southern Methodists - art
likewise adverse to the oath as a - body, owing to their .
Southern arrived:ties and by advice of -Bishop -Kiv
anagh. A large number of Old School Presbyteriene.
apd other denomination' , will decline tolake the oath.
Thus banded together.lhe oppOnents of the measure
control-tn-20ths of the pulpits in the-,State.. On-the
other hand. a large amber of loyal ministers have
already taken' the oath. Bishop Hawke!, Episcopal .
Bishop of thief/thecae. has taken the oath, and advises
all others to take It who can doer! conscientiously. The
Governor's hands are tied in the matter by the want of
the requisite' machinery, and fora time we shall probs.
lily enjoy the spectacle of disloyal preachers continuing •
the exercise of their ftinctiobs in defiance of. law., The
lawyers may not 'have sash an easy time.
' Before dismissing the churches the row between the
Fenian?' and the Archbishop ehonld be mentioned.—
Last , .week the Deptity Read Center of the Fenian
Brotherhood 'of Missiluil died in lit. Pant. Ills body
'has berga brought to this. city and n funeral senice and "

Archbishop Bernick thereupon' issued a•bull prohibit
ing the use of St. Patrlck'schutch for the delivery of
an oration or other reit:Arms ceremony to take place on
that occasion. Be also directed the Superintendent of
the (Catholic) Calvary Cemetery not to admit any pro
cession of men or women bearing the insignia of Feni- -
anisni within the sate of the Cemetery. Not satisfied
