ied on by the Sheriff under the folibwiug circumstances:
The dens. obtained a Judgment against Thos. H. How
ard, oil which they issued an execu tion , , end under it
the Sheriff :evied on alot of liquor at the Reading Rail
road depot in Pottsville, consigned to Howard, In St.
Clair. The plaintiff' 4ome forward and claim the pro
perty as I heirw. It appeared that they bed sold the pro
perty to Howard, and shipped it to him from Philadel
phia,consigneti tOSLCiair. Subsequently, ascertaining
that Howard was insolvent, they directed the liquor to
be stopped, while laying it the Pottsville depot, and be
fire 1t had reached St. Clair, the place of consignment.—
But the Sheriff bad already levied on it, and the ques-
tiontio be tried wee whether the property was the pro.
party of ilciward, and liable to be levied on, or whether
it was still in Maude, and liable to be stopped by the
plaintiffs before it reached.tts place ofdesUnation. The
freight on the liquor had not been paid at the,time of
the levy. The Court charged that being ermsigWed to
St. Clair, and lo the 'absence of any agreement to take
It to Pottsville, they were bound to take It to St. Clair,

place of destination, and liable to be stopped by the
plaintiffs. The jury found a verdict for the plaintiffs.
